7. CONSENT CALENDAR
a) Approve the Reading of all Resolutions by Title only
Commissioner Hutson made a motion to approve the consent calendar. Seconded by Commissioner Drescher. All in favor. Motion carried.
8. PUBLIC HEARING - CONTINUED
a) Conditional Use Permit 09-03 -Continued from December 9, 2009 Meeting.
An amendment to Table 17-1 Permitted and Conditional Uses/ Nonresidential Zones to allow for a natural stone processing facility, excluding the manufacturing of masonry products in the C-S (Service Commercial) zone.
Chairperson Santillan opened the public hearing at 7:07 p.m.
Senior Planner McNamara reported on the project with staff recommending approval.
Questions raised by Commissioners on sidewalk requirements, notification of residents and fencing requirements. Staff explained the conditions of approval and reported that notices had been sent out to property owners in the three hundred foot area.
After hearing no further discussion Chairperson Santillan closed the public hearing at 7:11 p.m.
Commissioner Forrest made a motion to approve Conditional Use Permit 09-03. Seconded by Commissioner Drescher. Motion carried with the following vote:

Senior Planner McNamara read the Resolution by title - Resolution 10-01 - A Resolution of the Planning Commission of the City of Wasco approving Conditional Use Permit 09-03 and the accompanying Categorical Exemption.
9. PUBLIC HEARING - NEW ITEMS
a) Zoning Ordinance Text Amendment 09-07 -
City of Wasco Zoning Ordinance Text Amendment 09-07 to amend Chapter 17.03 Definitions, Chapter 17.15 Medium Density Residential, 17.16 High Density Residential, Table 17-1 Permitted and Conditionally Permitted Uses in Nonresidential Zones and Table 17-3 Permitted and Conditionally Permitted Uses in Residential Zones of the City of Wasco Municipal Code to include certain definitions and amend the allowable uses in the C-O (Professional Office), C-D (Central Business District), R-1-6 (Low Density Residential), R-2 Medium Density Residential and R-3 (High Density Residential) zone

Chairperson Santillan opened the public hearing at 7:12 p.m.
Senior Planner McNamara reported on amendments to the housing requirements.
Questions were raised by the Commissioners on the need for the law and if the City had a choice. They also questioned the need for a vote at this meeting. Interim Director Allinder explained that the State created the law and the time frame of the vote would affect funds from the State.
After lengthy discussion on any group homes existing in Wasco and Bakersfield being a Charter City, discussion on staff putting limitations on requirements. Chairperson Santillan closed the public hearing at 7:26 p.m.
Commissioner Hutson made a motion to approve Zoning Ordinance Text Amendment 09-07. Seconded by Commissioner Drescher. Motion carried with the following vote:

Senior Planner McNamara read the Resolution by title - Resolution 10-02 - A Resolution of the Planning Commission of the City of Wasco recommending the City Council of the City of Wasco approve Zoning Ordinance Text Amendment 09-07, an amendment to Chapter 17.03, Chapter 17.15, Chapter 17.16, Table 17-3, of the City of Wasco Municipal Code as reflected in Exhibit A.
b) Zoning Ordinance Text Amendment 09-08 -
City of Wasco Zoning Ordinance Text Amendment 09-08 to Table 17-1 of the City of Wasco Municipal Code to amend the allowable uses in the P-F (Public Facilities) zone designation to include those uses consistent with the stated purpose of the P-F zone district;
Chairperson Santillan opened the public hearing at 7:28 p.m.
Senior Planner McNamara reported on the text amendment as it relates to public facilities with staff recommending approval.
Discussion by Commissioners on the need for hospital in Wasco and the location with City Manager Zervis inviting the Commissioners to attend the City Council meeting where the annexation for Tulare Hospital location would be heard.
Chairperson Santillan closed the public hearing at 7:37 p.m.

c) Zoning Ordinance Text Amendment 09-09 -
City of Wasco Zoning Ordinance Text Amendment 09-09 to Chapter 17.03, Table 17- 1, Table 17-2 and Chapter 17.19 of the City of Wasco Municipal Code to clarify the requirements for multifamily developments
Chairperson Santillan opened the public hearing at 7:40 p.m.
Senior Planner McNamara reported on text amendment 09-09 clarifying the requirements for multifamily developments.
After a brief discussion on changes to existing requirements, Chairperson Santillan closed the public hearing at 7:44 p.m.
Commissioner Hutson made a motion to approve Zoning Ordinance Text Amendment 09-09. Seconded by Commissioner Drescher. Motion carried with the following vote:

Senior Planner McNamara read the Resolution by title - Resolution 10-04 - A Resolution of the Planning Commission of the City of Wasco recommending the City Council of the City of Wasco approve Zoning Ordinance Text Amendment 09-09, and amendment to Chapter 17.03, Table 17-1, Table 17-2 and Chapter 17.19 of the City of Wasco Municipal Code as reflected in Exhibit A.
11. PLANNING DIRECTOR'S REPORTS
Interim Director Allinder reported that Denny's is moving along and KFC is going through an insurance issue.
12. COMMISSIONERS COMMENTS
Commissioner Forrest commented on the sign ordinance, asked about the house on the corner of 3rd and Palm as to a two story and asked about Hubert Holtermans 80 acre property, he heard rumors of a development. Senior Planner explained that the property owner on 3rd and Palm cannot make it a two story house and that the City has not received any application for development on that 80 acre parcel.
Chairperson Santillan asked if the lawsuit against Wal-Mart by the City of Delano would put a damper on Wal-Mart coming to Wasco. City Manager Zervis did not see that changing the possibility.

Commissioner Hutson made a motion to adjourn. Seconded by Commissioner Drescher. All in favor. Motion carried. Meeting adjourned at 7:54 p.m.
