6.      HEARING FROM PUBLIC ON ITEMS NOT ON AGENDA - this portion of the meeting is reserved for persons desiring to address the commission on any matter not on this agenda and over which the commission has jurisdiction.  Speakers are limited to two (2) minutes.  

Walt Desatoff, Mosby Farms 15850 Wasco Avenue - addressed the Commissioners to inform them that an employee of URS requested to place a sound/noise device on his property to monitor noise from trains for the High Speed Rail.  He wanted the Commissioners to be aware that this is proceeding without City knowledge.

7.      CONSENT CALENDAR
a)      Approval of Minutes for September 14, 2009 regular meeting.
b)      Approve the Reading of all Resolutions by Title only

Commissioner German made a motion to approve items on the consent calendar.  Seconded by Commissioner Hutson.  All in favor.  Motion carried


8.      PUBLIC HEARING

a)      Rose Industrial Park Project - Rescission of actions related to the Rose City Industrial Park Project.  Applicant: City of Wasco

Chairperson Santillan opened the public hearing at 7:04 p.m.

Brian Millar, PMC, reported on the original EIR that was brought before the Planning Commission and City Council and explained that the City had not approved any entitlements and that the actions from March of 2008 have not gone any further.  He explained that lawsuits had been filed and Rose City Renewables withdrew their application.  Part of the settlement agreement for the lawsuits was for the City to pursue a rescission of the EIR and Ordinances for the Rose City Industrial Site.

Hearing no discussion, Chairperson Santillan closed the public hearing at 7:09 p.m.

Commissioner Hutson made a motion to approve Resolution 09-20.  Seconded by Commissioner German.  Motion carried with the following vote:

AYES:  Commissioners:  Drescher; Elholm; Forrest; German; Hutson; Santillan

      ABSTAIN:

Secretary Joslin read the Resolution by title - Resolution 09-21 - A Resolution of the Planning Commission of the City of Wasco recommending the City Council of the City of Wasco rescind the Certification of the Final Environmental Impact Report (State Clearinghouse No. 2006061124) for the Rose Ci4ty Industrial Park Project and rescind approval of the Rose City Industrial Park Project.

b)      Zoning Ordinance Text Amendment 09-03 - Amendments to the City of Wasco's Precise Development Process.  Applicant: City of Wasco

Chairperson Santillan opened the public hearing at 7:10 p.m.

Senior Planner McNamara reported on amendments to the Precise Development process explaining each amendment and change requested.

Hearing no discussion Chairperson Santillan closed the public hearing at 7:17 p.m.

Commissioner German made a motion to approve Resolution 09-21.  Seconded by Commissioner Elholm.  Motion carried with the following vote:

AYES:  Commissioners:  Drescher; Elholm; Forrest; German; Hutson; Santillan

Secretary Joslin read the Resolution by title - Resolution 09-21 - A Resolution of the Planning Commission of the City of Wasco recommending the City Council of the City of Wasco approve Zoning Ordinance Text Amendment 09-03, an amendment to Chapters 17.23, 17.31, 17.51 and 17.54 of the City of Wasco Municipal Code as reflected in Exhibit A.


c)      Zoning Ordinance Text Amendment 09-05 - Amendments to the City of Wasco's Permitting Process.  Applicant: City of Wasco

Chairperson Santillan opened the public hearing at 7:18 p.m.

Senior Planner McNamara reported on the amendments proposed and explained the changes with staff recommending approval.

A question was asked by Commissioners on the existing appeal period and if there had been any problems with that.  McNamara explained the appeal period as it exists and that there had been missed appeals due to the existing appeal period.

After hearing no further discussion, Chairperson Santillan closed the public hearing at 7:22 p.m.

Commissioner German made a motion to approve Resolution 09-22.  Seconded by Commissioner Drescher.  Motion carried with the following vote:

AYES:  Commissioners:  Drescher; Elholm; Forrest; German; Hutson; Santillan

Secretary Joslin read the Resolution by title - Resolution 09-22 - A Resolution of the Planning Commission of the City of Wasco recommending to the City Council of the City of Wasco approve Zoning Ordinance Text Amendment 09-05, an Amendment to Chapter 17.54 and Chapter 17.75 of the City of Wasco Municipal Code as reflected in Exhibit A.

d)      Zoning Ordinance Text Amendment 09-06 - Amendments to the City of Wasco's Vehicle Parking and Storage Requirements.  Applicant: City of Wasco

Chairperson Santillan opened the public hearing at 7:23 p.m.

Senior Planner McNamara reported on amendments and explained proposed changes and asked the Commission to remove Text Amendment to Chapter 17.79 storage of vehicles to be heard at a later date.

Questions were raised by Commissioners regarding clarification on the item of paving under vehicle storage and R.V. parking.  Senior Planner McNamara explained the allowance of type of surfacing upon approval by the Community Development Director.  Brian Millar of PMC explained that some of the questions are part of the section that was removed from the hearing to be cleaned up and brought back to the Planning Commission at a later date.

Hearing no further discussion Chairperson Santillan closed the public hearing at 7:36 p.m.
Commissioner German made a motion to approve Resolution 09-23.  Seconded by Commissioner Elholm.  Motion carried with the following vote:

Secretary Joslin read the Resolution by title - Resolution 09-23 - A Resolution of the Planning Commission of the City of Wasco recommending the City Council of the City of Wasco approve Zoning Ordinance Text Amendment 09-06, an amendment to Chapters 17.19, 17.51. 17.60 and removing 17.79 from discussion to be heard at a later date of the City of Wasco Municipal Code as reflected in Exhibit A.
