6. HEARING FROM PUBLIC ON ITEMS NOT ON AGENDA - this portion of the meeting is reserved for persons desiring to address the commission on any matter not on this agenda and over which the commission has jurisdiction. Speakers are limited to two (2) minutes. NONE
7. CONSENT CALENDAR
a) Precise Development Plan No. 08-03. Confirmation of Planning Commission Resolution No. 09-14 approving Precise Development Plan No.08-03 to operate construction debris recycling facility and a gypsum processing facility at 1316 J Street.
b) Approval of Minutes for May 11, 2009 regular meeting.
c) Approve the Reading of all Resolutions by Title only
After a brief discussion on item a Commissioner Hutson made a motion to approve items on the consent calendar. Seconded by Commissioner Drescher. All in favor. Motion carried.
8. PUBLIC HEARING
a) General Plan Amendment 08-03,/Zone Change 08-05/Precise Development 08-06, a proposal to amend the General Plan Land Use designation from Medium Density Residential to High Density Residential, Amend the Zoning Classification from R-2 (Medium Density Residential) to R3/PD - 0806 for Assessor's Parcel Numbers 488-151-02, 488-151-03, 488-151-04, 488-151-05, 488-151-06, 488-151-07, 488-151-08, 488-151-09 and 488-155-10, and approve a Precise Development for Assessor's Parcel Numbers 488-151-02 and 488-151-03Conditional Use Permit 09-01.
Chairperson Santillan opened the public hearing at 7:07 p.m.
Chairperson Santillan recused himself from this item.
Senior Planner McNamara reported on General Plan Amendment 08-03/Zone Change 08-05/Precise Development 08-06 and noted changes made to the project since the last time it came in front of the Planning Commission.
Marlene Swan - 700 Hollytree Lane, Wasco - Voiced concerns on traffic, parking and the adequacy of the alley to accommodate high density residential. Senior Planner McNamara explained that the developer would have to reconstruct the alley to residential standards as part of the conditions of approval given by Helt Engineering.
Questions by Commissioners on the landscaping and who would be responsible for the upkeep there were also questions raised on the parking along 7th Street. McNamara explained that each lot not unit would be sold and it would be the responsibility of the owners to keep the landscaping clean. Director Allen explained that the Commission could recommend No Parking or 30 Minute Parking signs for that area.
Richard Sharp - 100 Columbus Avenue, Bakersfield - Explained how the lots would be sold was still up in the air but each lot could be sold and each owner of the lot would be responsible for the lot. Interim Director Allinder explained that landscape and irrigation approvals will require maintenance regardless of ownership.
Alejandro Esquivel - 2660 Silvertree Lane, Wasco - Voiced his concerns on parking.
Commissioners spoke on their concerns of parking and lack of play space because of the vicinity to the park, also questions were raised by the Commission on the vicinity to the schools, the deviation from the 25' setback; rapid traffic on arterial and collector streets being a danger to children, enforcement of parking restrictions, not in favor of allowing the use of the park in place of open space requirement.
After further brief discussion Vice Chairperson Drescher closed the public hearing at 7:48 p.m.
Commissioner Elholm made a motion to disapprove General Plan Amendment 08-03/ Zone Change 08-05/Precise Development 08-06. Seconded by Commission Lawrence. Motion carried with the following vote:
AYES: Commissioners: Drescher; Elholm; Forrest; Hutson; Lawrence
NOES:
ABSTAIN: Commissioner Santillan
ABSENT: Commissioner German
Secretary Joslin read the resolution by title - Resolution 09-16 - A Resolution of the Planning Commission of the City of Wasco recommending disapproval to City Council General Plan Amendment No. 08-03, Zone Change No. 08-05 and Precise Development Plan No. 08-06 and the accompanying Notice of Exemption.
Chairperson Santillan returned to the meeting at 7:52 p.m.

a) City Council Minutes
Commissioner Forrest asked about receiving a report on Code Compliance. Director Allen stated that it could be supplied in the agenda packet.
10. PLANNING DIRECTOR'S REPORTS - NONE
11. COMMISSIONERS COMMENTS
Commissioner Hutson - has no problem with R-2 for the project brought before the Commission but not R-3.
Commissioner Lawrence - agreed with Commissioner Hutson and was also concerned for having a lot of people with no place for the kids.
Commissioner Elholm - Apologized for not being at the previous two meetings.
Commissioner Drescher - No Comments
Commissioner Forrest - Encouraged staff to make a complete response so as to allow the applicant to better plan a course of action.
Chairperson Santillan - Thanked staff for hard work and the new format of the staff report makes it easier.
12. ADJOURNMENT
Commissioner Lawrence made a motion to adjourn the meeting. Seconded by Commissioner Forrest. All in favor. Motion carried. Meeting adjourned at 8:05 p.m.
