5. AWARDS AND PRESENTATIONS
Introduction by Assistant City Manager Jim Zervis of PMC for Professional Consulting Services, approved May 5, 2009 by City Council to oversee the Community Development Department.
Assistant City Manager Zervis introduced Sara Allinder and Brian Millar from PMC Consulting, explaining they would be involved in the day to day work of the Community Development Department and also assisting in implementing processes in the department to improve the department. He explained that they would be here on a temporary basis until such time as the City felt it necessary and that after that time the City would look into hiring a new Community Development Director.
6. HEARING FROM PUBLIC ON ITEMS NOT ON AGENDA - this portion of the meeting is reserved for persons desiring to address the commission on any matter not on this agenda and over which the commission has jurisdiction. Speakers are limited to two (2) minutes. NONE
7. CONSENT CALENDAR
a) Approval of Minutes for April 13, 2009 regular meeting.
b) Approve the Reading of all Resolutions by Title only
Commissioner German made a motion to approve the consent Calendar. Seconded by Commissioner Drescher. All in favor. Motion carried.
8. PUBLIC HEARING
a) Conditional Use Permit 09-01. The application of Jose Lozano for a Conditional Use Permit Pursuant to allow for a cargo container to be used as storage in an R-2 (Medium Density Residential) zone district located at 1325 Adams Street (APN# 029-402-04) and accompanying Notice of Exemption.
Chairperson Santillan opened the public hearing at 7:06 p.m.
Senior Planner McNamara reported on the application of Jose Lozano for a Conditional Use Permit Pursuant to allow for a cargo container to be used as storage in an R-2 (Medium Density Residential) zone district located at 1325 Adams Street.
After a brief discussion Chairperson Santillan closed the public hearing at 7:10 p.m.
Commissioner German made a motion to approve Conditional Use Permit 09-01. Seconded by Commissioner Hutson. Motion carried with the following vote:
AYES: Commissioners: Drescher; Forrest; German; Hutson; Lawrence; Santillan

Secretary Joslin read the resolution by title - Resolution 2009-13 - A Resolution of the City of Wasco Planning Commission approving Conditional Use Permit 09-01 for the incidental us of a cargo container located at 1325 Adams Street as shown on Attachment A and accepting the proposed Notice of Exemption as the appropriate environmental document.
b) Precise Development 08-03. A Precise Development pursuant to Section 17.31 Heavy Industrial of the City of Wasco Zoning Ordinance to construct and operate a Construction Debris Recycling Facility and a Gypsum Processing Operation located at the northeast corner of J Street and Poso Drive Wasco CA, APN 072-060-28 and adopt the accompanying Mitigated Negative Declaration.
Chairperson Santillan opened the public hearing at 7:11 p.m.
Senior Planner McNamara reported on a Precise Development pursuant to Section 17.31 Heavy Industrial of the City of Wasco Zoning Ordinance to construct and operate a Construction Debris Recycling Facility and a Gypsum Processing Operation located at the northeast corner of J Street and Poso Drive with the added and revised conditions of not requiring the removing of obstructions, allowing the use of the existing fencing and not requiring the dedication.
Questions were raised on the height of the operations piles and the unprocessed, inert debris.
John Martin - 1316 J Street - Explained the height of the gypsum is mitigated by tarping and the debris is referring to concrete and gypsum which will not be on site at all time, refuse is daily. A concern is losing property to City, after many meeting feels that the project is back to square one.
Lengthy discussion between Commissioners, staff and applicant on dedications and where operation debris would come from.
After no further discussion Chairperson Santillan closed the public hearing at 7:40 p.m.
Commissioner Hutson made a motion to approve Resolution 2009-14 with the modification of striking items 1 and 2 under Helt Engineering conditions. Seconded by Commissioner German. Motion carried with the following vote:

Secretary Joslin read the resolution by title - Resolution 2009-14 - A Resolution of the Planning Commission of the City of Wasco approving Precise Development 08-03 pursuant to Section 17.31 Heavy Industrial of the City of Wasco Zoning Ordinance to allow for the construction and operation of a construction debris recycling/processing facility located at the northeast corner of Poso Drive and J Street, Assessor's Parcel Number 072-060-28, and accompanying Mitigated Negative Declaration with the modification of striking conditions 1 & 2 under Helt Engineering conditions.
c) Conditional Use Permit 08-04. A Conditional Use Permit Pursuant to Table 17-1 of the City of Wasco Zoning Ordinance to allow for the construction of a new 7,200 square foot sanctuary/hall at an existing church and allow for a cargo container to be utilized for storage located at 2000 Palm Avenue, Wasco CA, APN 489-020-01 and accompanying Notice of Exemption.
Chairperson Santillan opened the public hearing at 7:43 p.m.
Commissioner Drescher recused herself at 7:44 p.m.
Senior Planner McNamara reported on the application for a Conditional Use Permit Pursuant to Table 17-1 of the City of Wasco Zoning Ordinance to allow for the construction of a new 7,200 square foot sanctuary/hall at an existing church and allow for a cargo container to be utilized for storage located at 2000 Palm Avenue. McNamara went through the time line of the project.
Pastor David Downing - 2425 Sunset - Spoke on his conversations with staff and attorneys on waiving of off-site improvements or of giving an extension of time to put them in with five to ten years being the request. Also, questioned the process of being heard by the Planning Commission prior to being heard by City Council.
Assistant City Manager Jim Zervis explained the process is to be heard by Planning Commission first. Senior Planner McNamara explained that even if a Conditional Use Permit was not required the off-site improvements would still be required.
Darryl Fields - 456 E. Warren, Bakersfield - Asked for clarification of time frame of off-sites.
It was explained that if the Planning Commission approves the project as written then the applicant can appeal the decision to the City Council.
Chairman Santillan closed the public hearing at 8:15 p.m.
Commissioner German made a motion to approve Conditional Use Permit 08-04. Seconded by Commissioner Forrest. Motion carried with the following vote:

Secretary Joslin read the resolution by title - Resolution 2009-15 - A Resolution of the Planning Commission of the City of Wasco approving Conditional Use Permit 08-04 a Conditional Use Permit pursuant to Table 17-3 of the City of Wasco Zoning Ordinance to allow for the construction of a 7,200 square foot sanctuary/hall and allow a cargo container at 2000 Palm Avenue, Assessor's Parcel Number 487-020-01, and accompanying Notice of Exemption.
Commissioner Drescher returned to the meeting at 8:17 p.m.

10. PLANNING DIRECTOR'S REPORTS
Circle K under construction; KFC/A&W submitted a new grading plan to the City and a corrected building plan to NAFFA; Jack In The Box pulled the grading and building permits; Denny's grading plan was approved; Carl's Jr. grand opening tomorrow; Best Western is open; Fresh & Easy possibly opening in September; developer of the shopping center in talks with different companies and still expect a pharmacy to come into Wasco.
11. COMMISSIONERS COMMENTS
Commissioner German thanked staff for their professionalism; welcomed PMC to Wasco and thanked Assistant City Manager Zervis for attending meetings.
Commissioner Hutson agreed with Commissioner German and felt that something was accomplished as a result of staff.
Commissioner Drescher agreed with Commissioners German and Hutson and welcomed PMC.
Commissioner Forrest seconded all comments, gratifying to see people who have an interest attend the meeting and thanked staff.
Chairperson Santillan thanked staff and welcomed PMC. He also thanked Assistant City Manager Zervis for attending.
12. ADJOURNMENT
Commissioner German made a motion to adjourn. Seconded by Commissioner Drescher. All in favor. Motion carried. Meeting adjourned at 8:27 p.m.
