PLANNING COMMISSION MEETING
APRIL 13, 2009- 7:00 P.M.


1.      CALL TO ORDER by Chairperson Santillan at 7:01 p.m.

5.      AWARDS AND PRESENTATIONS - NONE

6.      HEARING FROM PUBLIC ON ITEMS NOT ON AGENDA - this portion of the meeting is reserved for persons desiring to address the commission on any matter not on this agenda and over which the commission has jurisdiction.  Speakers are limited to two (2) minutes.  NONE

7.      AGENDA ADDITIONS/DELETIONS - NONE

8.      CONSENT CALENDAR
a)      Approval of Minutes for March 9, 2009 regular meeting.
b)      Approve the Reading of all Resolutions by Title only

Commissioner German made a motion to approve the consent calendar.  Seconded by Commissioner Drescher.  All in favor.  Motion carried.

9.      PUBLIC HEARING

A)      Precise Development Plan 08-08, a proposal to construct a 3,600 square foot building located at 1633 State Highway 46 Assessor's Parcel Number 029-081-25 as reflected in Exhibit A and Conditioned in Exhibit B.

Chairperson Santillan opened the public hearing at 7:03 p.m.

Commissioner Drescher recused herself from item at 7:03 p.m.

Senior Planner McNamara reported on a proposal to construct a 3,600 square foot building located at 1633 State Highway 46 and pointed out the revised site plan provided to Commissioners to show new landscaping.  McNamara explained the proposed landscaping requirements and concluded with staff recommending approval of the project.

Questions were raised on truck parking and dedicated loading spaces McNamara explained these items.

Lengthy discussion by Commissioners in regards to on-site retention.

Chairperson Santillan closed the public hearing at 7:30 p.m.

Commissioner Hutson made a motion to approve option 2.  Seconded by Commissioner German.  Motion carried with the following vote:

AYES:  Commissioners:  Forrest; German; Hutson; Lawrence; Santillan
NOES:  
ABSTAIN:  Commissioner Drescher
ABSENT: Commissioner Elholm

Secretary Joslin read the resolution by title - Resolution 2009-10 - A Resolution of the Planning Commission of the City of Wasco conditionally approving Precise Development Plan 08-08, a proposal to construct a 3,600 square foot building located at 1633 State Highway 46 Assessor's Parcel Number 029-081-25 as reflected in Exhibit A and conditioned in Exhibit B with added waiver of dedicated loading and unloading space.    

Commissioner Drescher returned to the meeting at 7:33 p.m.

B)      Zoning Ordinance Text Amendment 09-01, Amending Title 17 Zoning of the City of Wasco Municipal Code as reflected in Exhibit A.

Chairperson Santillan opened the public hearing at 7:34 p.m.

Senior Planner McNamara reported on amending Title 17 Zoning of the City of Wasco Municipal Code.

After a discussion by Commissioners on fencing Chairperson Santillan closed the public hearing at 7:51 p.m.

Commissioner German made a motion to approve Zoning Ordinance Text Amendment 09-01.  Seconded by Commissioner Drescher.  Motion carried with the following vote:

AYES:  Commissioners:  Drescher; Forrest; German; Hutson; Santillan
     NOES:  Commissioner Lawrence
     ABSTAIN:  
     ABSENT:    Commissioner Elholm
Secretary Joslin read the resolution by title - Resolution 2009-11 - A Resolution of the City of Wasco Planning Commission recommending the City Council approve Zoning Ordinance Tex Amendment 09-01, Amending Title 17 Zoning of the City of Wasco Municipal Code as reflected in Exhibit A.   

C)      Zoning Ordinance Text Amendment 07-12, Amending Title 6 of the City of Wasco Municipal Code, Sections 6.04.010 Definitions and Section 06.04.300 Animals Creating a Nuisance and Title 17 of the City of Wasco Municipal Code, Chapters 17.03 Definitions and 17.79 Property Maintenance as reflected in Exhibit A.

Chairperson Santillan opened the public hearing at 7:53 p.m.

Community Development Director Heiser reported on amending Title 6 of the City of Wasco Municipal Code, Sections 6.04.010 Definitions and Section 06.04.300 Animals Creating a Nuisance and Title 17 of the City of Wasco Municipal Code, Chapters 17.03 Definitions and 17.79 Property Maintenance.  

Questions were raised by Commissioners on the wording of fur-bearing as it pertains to fowl and asked if that could be removed.

Lengthy discussion by Commissioners on pros and cons of fowl and the actual amount of complaints to Animal Services or Code Enforcement pertaining to fowl.

After no further discussion Chairperson Santillan closed the public hearing at 8:25 p.m.

Commissioner German made a motion to deny to the City Council Zoning Ordinance Text Amendment 07-12.  Seconded by Commissioner Drescher.  Motion carried with the following vote:

AYES:  Commissioners:  Drescher; Forrest; German; Hutson; Santillan
     NOES:  Commissioner Lawrence
     ABSTAIN:  
     ABSENT:    Commissioner Elholm

Secretary Joslin read the resolution by title - Resolution 2009-12 - A Resolution of the City of Wasco Planning Commission recommending the City Council deny Zoning Ordinance Tex Amendment 07-12, Amending Title 6 of the City of Wasco Municipal Code, Sections 6.04.010 Definitions and Section 06.04.300 Animals creating a nuisance and Title 17 of the City of Wasco Municipal Code, Chapters 17.03 Definitions and 17.79 Property Maintenance as reflected in Exhibit A.

11.     PLANNING DIRECTOR'S REPORTS
Director Heiser gave an update on KFC/A&W, Best Western and also reported on the High Speed Rail Alignment.     

12.     COMMISSIONERS COMMENTS
Commissioner Forrest asked about the status of the joint meeting Commissioners had requested with City Council, he also stated the City needs to be more business friendly.
Commissioner Drescher also would like to City to be more business friendly and is concerned people are given contradicting information.
Commissioner Lawrence agrees with being business friendly but not to go against City requirements to do that and would also like to know what other cities do.
Commissioner Hutson concerned the City is getting a terrible reputation and agrees with Commissioner Forrest on holding the joint meeting with City Council.
Chairperson Santillan thanked staff for hard work and also agreed on the joint meeting with City Council.

13.     ADJOURNMENT

Commissioner German made a motion to adjourn the meeting.  Seconded by Commissioner Drescher.  All in favor.  Motion carried.  Meeting adjourned at 8:54 p.m.
