PLANNING COMMISSION MEETING

8.      CONSENT CALENDAR
a)      Approval of Minutes for February 9, 2009 regular meeting.
b)      Approve the Reading of all Resolutions by Title only

Commissioner Drescher made a motion to approve the consent calendar.  Seconded by Commissioner Elholm.  All in favor.  Motion carried.

9.      PUBLIC HEARING

a)      A Resolution of the Planning Commission of the City of Wasco approving Conditional Use Permit 08-04 A Conditional Use Permit Pursuant to Chapter 17.61 Signs and table 17-6 permitted signs of the City of Wasco Zoning Ordinance to allow for the construction of a ten (10) foot tall sign with an L.E.D (Light Emitting Diode) time and temperature device located at 1062 State Hwy 46, Assessor's Parcel Number 487-213-26.

Chairperson Santillan opened the public hearing at 7:04 p.m.

Director Heiser reported on Conditional Use Permit 08-04 A Conditional Use Permit Pursuant to Chapter 17.61 Signs and table 17-6 permitted signs of the City of Wasco Zoning Ordinance to allow for the construction of a ten (10) foot tall sign with an L.E.D (Light Emitting Diode) time and temperature device located at 1062 State Hwy 46 with staff recommending approval.
After a very brief discussion Chairperson Santillan closed the public hearing at 7:07 p.m.

Commissioner Hutson made a motion to approve Conditional Use Permit 08-04.   Seconded by Commissioner Lawrence.  Motion carried with the following vote:

        Secretary Lopez-Joslin read the resolution by title - Resolution 09-06 - A Resolution of the City of Wasco Planning Commission of the City of Wasco approving Conditional Use Permit 08-05 A Conditional Use Permit Pursuant to Chapter 17.61 Signs and table 17-6 permitted signs of the City of Wasco Zoning Ordinance to allow for the construction OF A ten (10) foot tall sign with an Light emitting diode (led) time and temperature device located at 1062 State hwy 46, Assessor's Parcel Number 487-213-26.

Senior Planner McNamara reported on Conditional Use Permit 08-09 A Conditional Use Permit Pursuant to Chapter 17.19 and 17-3 of the City of Wasco Zoning Ordinance to allow for the construction of a two story dwelling unit located at 1888 Broadway with staff recommending approval.

After a brief discussion by Commissioners in regards to on site water retention, Chairperson Santillan closed the public hearing at 7:16 p.m.

Commissioner Elholm made a motion to approve Conditional Use Permit 08-09.   Seconded by Commissioner Forrest.  Motion carried with the following vote:

AYES:  Commissioners:  Elholm; Forrest; Hutson; Lawrence; Santillan
     NOES:  
      ABSTAIN:  Commissioner Drescher

Chairperson Santillan opened the public hearing at 7:17 p.m.

Commissioner Drescher recused herself at 7:18 p.m.

Director Heiser reported on Conditional Use Permit 08-10 A Conditional Use Permit Pursuant to Chapter 17.19 and 17-3 of the City of Wasco Zoning Ordinance to allow for the construction of a two story duplex located at 1041 6th Street with staff recommending approval.

A question was asked as to the existing buildings if they would be removed.  Staff explained that the accessory structures were being removed.

Commissioners questioned the requirements of a block wall fence; Senior Planner McNamara explained due to the vicinity of the Church a block wall is required.  

Hector Delgado - 1041 6th Street, Wasco - explained that there was already a brick wall on the property so he would not have to construct one.

After hearing no further discussion Chairperson Santillan closed the public hearing at 7:20 p.m.

Commissioner Hutson made a motion to approve Conditional Use Permit 08-09.   Seconded by Commissioner Elholm.  Motion carried with the following vote:

d)      Precise Development 08-03 Pursuant to Section 17.31 Heavy Industrial of the City of Wasco Zoning Ordinance to allow for the construction and operation of a construction debris recycling/processing facility located at the northeast corner of Poso Drive and J Street, Assessor's Parcel Number 072-060-28, and accompanying Mitigated Negative Declaration.

Chairperson Santillan opened the public hearing at 7:25 p.m.

Senior Planner McNamara reported on Precise Development 08-03 Pursuant to Section 17.31 Heavy Industrial of the City of Wasco Zoning Ordinance to allow for the construction and operation of a construction debris recycling/processing facility located at the northeast corner of Poso Drive and J Street with conditions set by the City for the developer to improve J Street and Poso with staff recommending approval of the project.

There was lengthy discussion by Commissioners on the requirement of the street improvements by the developer.   A question was asked by Commissioners on whether the City would require medians be put in, staff explained that they would be required on Poso but not on J Street, when asked to explain why they would not be required on J Street staff explained that it was a requirement made by Public Works and they could not answer that question.

John Wilson - 2012 E Street, Bakersfield - The Engineer for the applicant submitted to Commissioners and Secretary Lopez-Joslin, a letter in response to the conditions that were recently put on the project.  Mr. Wilson spoke on the length of time the project has taken to get to Planning Commission, he also explained the cost the conditions of approval put on the project by the City would be to the developer which was considerably high for the project the developer was proposing.

More discussion was held by Commissioners with questions being asked of Mr. Wilson and City staff.

John Martin - 1316 J Street, 995 Cypress, Wasco - Spoke on his project not being required to have a building permit but he would still have to give up part of his property for the conditions of approval.  He explained that he has been working with the Planning staff and felt they were doing a good job however he questioned other city departments.  

Commissioners questioned the appeal process, staff explained that if a project is approved or denied either decision can be appealed to the City Council.

Mr. Martin urged the Commissioners to approve his project.
With no further discussion Chairperson Santillan closed the public hearing at 8:17 p.m.

Commissioner Forrest made a motion to approve Conditional Use Permit 08-09.   Seconded by Commissioner Drescher.  Motion carried with the following vote:

10.     INFORMATION ITEMS

a)      Housing Element Annual Report.  The City is required to file a report annually with the State Department of Housing and Community Development (HCD) on progress in meeting goals and objectives of the 2008 - 2013 Housing Element Update of the General Plan.  This report also addresses previous housing goals from 2006-2008.
Director Heiser reported on the Housing Element Annual Report and its status.

11.     PLANNING DIRECTOR'S REPORTS
Director Heiser reported on a letter received from Ennis Development that they had lost the financing on their development and had to file Chapter 11 Bankruptcy.  He also reported on a letter from the Governor's Office of Planning & Research that the review period for the Enterprise Zone was almost complete; Carl's Jr. estimated completion date was in 90 days; Best Western 90% complete; Denny's working on some issues with their site plan; Circle K under construction; sign committee has been added to the budget to fund the committee with funds being allocated for staff.
        
12.     COMMISSIONERS COMMENTS
Commissioners feel the City needs to be more business friendly.  Commissioner Elholm not understanding why Code Enforcement is bothering with cargo containers.  Commissioner Hutson would like to meet with City Council to discuss the issues from the meeting in regards to conditions being put on developers and voiced his opinion of Public Works and Engineering.  Chairperson Santillan thanked the staff for their hard work and agreed that the City needs to be more business friendly.
Commissioners discussed the Martin project until Senior Planner McNamara explained that the project was a public hearing and had been closed and the applicant was no longer in attendance during the discussion.

Commissioner Elholm made a motion to adjourn the meeting.  Seconded by Commissioner Drescher.  All in favor.  Motion carried.  Meeting adjourned at 8:38 p.m.
