Approval of Minutes for October 13, 2008 regular meeting.
Approve the Reading of all Resolutions by Title only
Commissioner Hutson made a motion to approve the consent calendar. Seconded by Commissioner Forrest. All in favor. Motion carried.
9. PUBLIC HEARINGS - POLICY ITEMS
a) Tentative Tract 7159 - The application of the Townsend Family Trust and the DeVincenzo Family Trust for a land division of 57 acres into 87 single family lots, with an additional lot (Lot A) that will serve as a park/sump one park and sump area of approximately 5.9 acres and is located approximately at the northwest corner of Gromer Road and Annin Ave (APN# 487-010-20 and 487-010-32) and Addendum of a Previously Filed Mitigated Negative Declaration for Annexation No. 37.
Chairperson Santillan opened the public hearing at 7:06 p.m.
Senior Planner McNamara gave a power point presentation on the application of the Townsend Family Trust and the DeVincenzo Family Trust for a land division of 57 acres into 87 single family lots, with an additional lot (Lot A) that will serve as a park/sump one park and sump area of approximately 5.9 acres and is located approximately at the northwest corner of Gromer Road and Annin Ave (APN# 487-010-20 and 487-010-32) and Addendum of a Previously Filed Mitigated Negative Declaration for Annexation No. 37. Senior Planner McNamara reported that two lots would be removed from the project due to the location of the two lots being in the County he also added that there would be additions to the Conditions of Approval for the project for the utilities and improvements for the Martin property.
Questions were raised by the Commissioners on the maintenance and landscape district and who would be responsible for the upkeep. Senior Planner McNamara reported that the subdivision would be a gated community and therefore responsible for the upkeep, the City does not maintain gated communities.
Another question was asked by Commissioners on who would be building on these lots.
Randy Gafner - 726 Maple Avenue, Wasco - Stated the developer would sell the lots and the buyer can hire who they want to build.
Isabel Juarez - 1017 Gromer Avenue, Wasco - Asked if there would be any fencing along Gromer.
Randy Gafner stated there would be a fence along Gromer Avenue.
Leticia Beltran - 1017 Gromer, Wasco - Asked which way the homes will face? Will they face the existing homes on Gromer?
Randy Gafner stated that no homes would face the existing homes, there will be a fence and that would be the new homes rear yard fence.
There was some confusion on the maps provided and was found that the Engineer for the Developer submitted the wrong map.
Tom Fallgatter, Attorney for Joanne Martin brought a copy of a CCR previously recorded that stated his clients' property would have utilities brought to her property by the developer.
Commissioners asked that these items be added to the conditions of approval and Senior Planner McNamara stated that would be included in the Conditions of Approval.
Chairperson Santillan closed the public hearing a 7:39 p.m.
Commissioner Forrest made a motion to conditionally approve Tentative Tract Map 7159 an 87 lot Single Family Subdivision as reflected in Exhibit A and conditioned in Exhibit B and the addendum to the Mitigated Negative Declaration prepared for Annexation 37 with the added conditions for Joanne Martins property on Annin and Gromer. Seconded by Commissioner Elholm. Motion was carried with the following vote:

Secretary Lopez read the Resolution by title - Resolution 08-43 - A Resolution of the City of Wasco Planning Commission conditionally approving Tentative Tract 7159, and 87 lot Single Family Subdivision as reflected in Exhibit A and conditioned in Exhibit B and the Addendum to the Mitigated Negative Declaration prepared for Annexation 37 with added conditions for the Joanne Martin property on Annin & Gromer.
b) Municipal Code Text Amendment - A proposed amendment to Tile 16 Subdivision Ordinance of the City of Wasco Municipal Code, amending Section 16.32.090 (Required Improvements - Storm Drainage) and Construction Standards Plate D5 to prohibit sole purpose retention/detention basins and require alternative methods of storm water/run off water control.
Chairperson Santillan opened the public hearing at 7:43 p.m.
c) Senior Planner McNamara reported on the proposed amendment to Tile 16 Subdivision Ordinance of the City of Wasco Municipal Code, amending Section 16.32.090 (Required Improvements - Storm Drainage) and Construction Standards Plate D5 to prohibit sole purpose retention/detention basins and require alternative methods of storm water/runoff water control with staff recommending approval.
Questions were asked by Commissioners how this would affect approved maps, if this was retroactive and if this could be added as a condition at the time an extension was requested. Director Heiser informed the Commissioners that this will be used for developments that still want to come in to the City and that it could be added as a condition at the time a request is requested.
After no further discussion Chairperson Santillan closed the public hearing at 7:55 p.m.
Commissioner Hutson made a motion to approve Municipal Code Text Amendment 08-005 with modification to Item 9 to the City Council, Amending Title 16 Subdivision Ordinance, Section 16.32.090. Seconded by Commissioner Lawrence. Motion was carried with the following vote:

Secretary Lopez read the Resolution by title - Resolution 08-04 - A Resolution of the Planning Commission of the City of Wasco recommending approval of Municipal Code Text Amendment 08-05 with the modification to Item 9, to the City Council, amending Title 16 Subdivision Ordinance, Section 16.32.090 (*Required Improvements (Storm Drainage) and Construction Standards Plate D5 to prohibit sole purpose retention/detention basins and require alternative methods of storm water/runoff water control as shown in Exhibit A and accompanying Notice of Exemption.
d) Conditional Use Permit 08-06. The application of the City of Wasco for a Conditional Use Permit Pursuant to allow for a cargo container to be used as storage in a C-D (Central Business District) zone district located at the northwest corner of G St and 8th St (APN#'s 030-071-05 and 030-071-06) and accompanying Notice of Exemption.
Chairperson Santillan opened the public hearing at 7:56 p.m.
Senior Planner McNamara reported on the application of the City of Wasco for a Conditional Use Permit Pursuant to allow for a cargo container to be used as storage in a C-D (Central Business District) zone district located at the northwest corner of G St and 8th St (APN#'s 030-071-05 and 030-071-06) and accompanying Notice of Exemption with staff recommending approval.
After a brief discussion Chairperson Santillan closed the public hearing at 8:02 p.m.
Commissioner Hutson made a motion to approve Conditional Use Permit 08-06. Seconded by Commissioner Elholm. Motion carried with the following vote:

Secretary Lopez read the Resolution by title - Resolution 08-41 - A Resolution of the City of Wasco Planning Commission approving Conditional Use Permit 08-06 for the incidental use of a cargo container located at the northwest corner of G Street and 8th Street as shown on attachment A and accepting the proposed Notice of Exemption as the appropriate Environmental document.
e) Zoning Ordinance Text Amendment 08-05- A proposed amendment to Title 17 Zoning Ordinance of the City of Wasco Municipal Code, amending Sections 17.19 (Residential Specific Standards) and 17.51 (Design District Guidelines) to require all new street, parking lot and park trees to have a minimum trunk caliper of two (2) inches at time of planting and accompanying Notice of Exemption.
Chairperson Santillan opened the public hearing at 8:03 p.m.
Senior Planner McNamara reported on a proposed amendment to Title 17 Zoning Ordinance of the City of Wasco Municipal Code, amending Sections 17.19 (Residential Specific Standards) and 17.51 (Design District Guidelines) to require all new street, parking lot and park trees to have a minimum trunk caliper of two (2) inches at time of planting and accompanying Notice of Exemption with staff recommending approval.
Questions were asked by the Commissioners on possible damage to concrete as the trees grow. Senior Planner McNamara reported that there are root barrier and irrigation requirements in place to try and prevent this from happening. Another question was if this would affect existing tracts. Senior Planner McNamara explained that as long as the map is not vested, a condition could be added to the tract when an extension was requested.
After no further discussion Chairperson Santillan closed the public hearing at 8:17 p.m.
Commissioner Elholm made a motion to approve Zoning Ordinance Text Amendment 08-05 to the City Council. Seconded by Commissioner Forrest. Motion carried with the following vote:

Secretary Lopez read the Resolution by title - Resolution 08-42 - A Resolution of the Planning Commission of the City of Wasco recommending approval of Zoning Ordinance Text Amendment 08-05 to the City Council, amending Title 17 Zoning Ordinance, Section 17.19 (Residential Specification Standards) and 17.51 (Design District Guidelines) to require all new street, parking lot and park trees to have a minimum trunk diameter of two (2) inches, at four (4) feet above finished grade as shown in Exhibit A and accompanying Notice of Exemption.

11. PLANNING DIRECTOR'S REPORTS
Community Development Director Heiser reported on a Downtown Public Workshop to be held November 20 at 7:00 p.m. in the City Council Chambers on the Revitalization Market Study. He also reported that the projects on Highway 46 were moving along and that the City had received the new aerials of the City and that properties could be seen much clearer and closer than the previous aerials.
Senior Planner McNamara reported on the status of the KFC/A&W project.
A reminder was also made to the Commissioners regarding the Special Planning Commissioner Meeting scheduled for November 24 at 7:00 p.m.
