WASCO PLANNING COMMISSION
MINUTES OF MEETING
FEBRUARY 12, 2007– 7:00 P.M.

1.      CALL TO ORDER by Vice Chairperson Santillan.
2 & 3.  FLAG SALUTE and INVOCATION led by Vice Chairperson Santillan.

4.      ROLL CALL - PRESENT: Vice Chair Santillan, Commissioner Arredondo, Drescher, Forrest, German, Mitchell; Absent: Chairperson Brown.

Also present: Planning Director Woodcock, Senior Planner McNamara, Associate Planner Manry, Assistant Planner Jaquez, Secretary Rodriguez and Assistant Lacey Jones.

6.      HEARING FROM PUBLIC ON ITEMS NOT ON AGENDA – this portion of the meeting is reserved for persons desiring to address the commission on any matter not on this agenda and over which the commission has jurisdiction.  Speakers are limited to two (2) minutes.  Please state your name and address for the record before making presentation. Commissioner Forrest requested items f) and g) be heard first.  Seconded by Commissioner German.  All in favor, motioned carried.

8.      CONSENT CALENDAR

a)      Approval of Minutes January 8, 2007, Special Meeting January 22, 2007
b)      Approve the Reading of all Resolutions by Title only

Commissioner Drescher moved to approve the Consent Calendar as submitted.  Seconded by Commissioner Mitchell.  All in favor, motion carried.

9.      PUBLIC HEARINGS – POLICY ITEMS

a)      GENERAL PLAN AMENDMENT 07-02 and Resolution –  An amendment to the Circulation Element of the General Plan regarding development’s responsibility to mitigate traffic impacts - City of Wasco

Vice Chairperson Santillan opens public hearing at 7:14 pm

Associate Planner Manry gave a brief presentation with PowerPoint regarding amending the Circulation Element of the General Plan regarding developer’s responsibility to mitigate traffic impacts.   Staff recommends that the Planning Commission, adopt a resolution recommending approval of this General Plan Amendment to the City Council.
Greg Black, Dewalt Corporation, comments that the city should consider a city wide traffic study and then determine what a fair impact fee is to incoming developers.

Commissioner German moved to approve General Plan Amendment 07-02. Seconded by Commissioner Arredondo.  All in favor, motion carried.

Secretary Rodriguez read the title of Resolution 07-02 - Traffic impacts.

Resolution 07-02 - A Resolution of the Planning Commission of the City of Wasco in the matter of the application of the City of Wasco for a General Plan Amendment to the City of Wasco’s Circulation Element of the General Plan - traffic impacts.


b)      ZONING ORDINANCE AMENDMENT 07-01 and Resolution –   
Amendment to the Wasco Zoning Ordinance to include new Subsection under the Special Use and Development Standards to include Subsection 17.63 Traffic Impact Studies – This new section will establish thresholds for determining when traffic impact studies will be required for new development and procedures for said traffic impact studies - City of Wasco

Vice Chairperson Santillan opened up the public hearing at 7:23 pm.

Associate Planner Manry presented a PowerPoint presentation to amend the special uses and development standards section of the Wasco Zoning Ordinance to include a new subsection 17.63 “Traffic Impact Studies.”  The planning staff is recommending adoption of the Institute of Transportation Engineers thresholds for requiring traffic impact studies.  Staff recommends that the Planning Commission adopt a resolution recommending approval to the Wasco Zoning Ordinance to the City Council.

Greg Black, Dewalt Corporation, responded with an opinion that a traffic study may take 60-90 days if other government agencies or Cal Trans has to review it.  With the addition of other agencies comments and review it may involve more time for a completed traffic impact study.

c)      ZONE VARIANCE 06-04 and Resolution – A Zone Variance to encroach five feet of the required ten foot distance from existing structure setback. Location: 1215 10th Place, Wasco, CA; APN: 029-352-01, Applicant: Roman Gutierrez

Vice Chairperson Santillan opens public hearing at 7:50 pm

Assistant Planner Jaquez gave a brief PowerPoint presentation on the applicants request to convert the existing one car covered parking into a bedroom. The applicant is requesting a zone variance to allow the proposed covered parking to be constructed and encroach within five feet of the required ten feet distance from existing structure setback.  The project is located at 1215 10th Place. Staff recommends approval.

Variance 06-04, a proposal to encroach five (5) feet of the required ten (10) foot               setback distance from existing structure.
 
d)      ZONE VARIANCE 07-01 and Resolution – A zone variance to allow one car garage per single family dwelling.  Location: Ten parcels within El Dorado Estates located north of Poplar Ave., at 1750 Poplar Ave., Wasco, CA 93280; APN: 489-171-02,04,07,08,14, 489-172-01,06,07,09,11; Applicant: Timothy Cox

Vice Chairperson Santillan opened the public hearing at 7:55 pm.

Assistant Planner Jaquez gave a brief PowerPoint presentation on the applicants request to provide a single covered parking space per single family dwelling unit.  The project is located at 1750 Poplar Avenue.  Staff recommends denial of the request because the City of Wasco Zoning Ordinance requires the applicant to construct two covered parking spaces per single family dwelling.   Staff also recommends redoing the design to better fit the lot size.  

Rebecca Smith resident of 1510 Isabel Road Bakersfield, CA, co-owner of the properties, comments that because the lots were small the two-covered parking requirement decreases yard size.  Their goal is to create larger, lower income homes.  Tim Cox resident of 15300 Abelardo Bakersfield, CA spoke on the size of the lot.  Commissioners question if they could double up on the size of the lots, and the substandard problems with the area.

Resolution 07-05 - A Resolution of the Planning Commission of the City of Wasco in the matter of the application of Timothy Cox for Zone Variance 07-01, a proposal to provide only one (1) car garage per single family dwelling- Denied.

  
e)      PARCEL MAP 11692 and Resolution – A subdivision of approximately one 19-acre parcel into two parcels.  Location: North side of Paso Robles Hwy (Hwy. 46), east side of Poplar Avenue. More specifically described was a division of the west half of the southeast quarter of the southwest quarter of Section 1, Township 27 South, Range 24 East, M.D.M.  Applicant: Billion Enterprises, Inc

Commissioner Drescher stepped down from the board, as she had a conflict.
Vice Chairperson Santillan opened the public hearing at 8:32 pm

Senior Planner McNamara reported on the applicants request for parcel map approval.  The project site is on the north side of State Highway 46 also being the southeast corner of (future) Margalo Street and Poplar Avenue.  The proposed project is a division of approximately one 19-acre parcel into two smaller parcels.  Staff recommends approval.  

Josh Willard, Dewalt Corporation, representing applicant Billon Enterprises, Inc. stated that this was only a division of parcels and requested that Planning Commission Condition #3 be dismissed.   Discussion on the improvements,
Cal Trans, and Poplar Avenue.  Staff did not recommend the modification.

Greg Black, Dewalt Corporation, spoke on the development, post impact of traffic impact study, and requested that it be deferred until the commercial property was developed.  He distributed pamphlet on Cal Trans “Trip Generation.”   

After a brief discussion Condition #3 was changed to read:
The applicant shall meet all the requirements of the California Department of Transportation as found in the attached letter.  The traffic study impact study shall be completed prior to the approval of the final parcel map.

f)       TENTATIVE TRACT 6473 Phase 3 – Extension Request and Resolution – A request to extend Tentative Tract 6473 Phase 3, Location: Approximately one quarter mile north of the northeast corner of Hwy. 46 and Palm Ave, Wasco, CA; Applicant: PHR Development LLC, APN: 487-040-31

Vice Chairperson Santillan opened the public hearing at 9:01 pm.

Senior Planner McNamara reports on the applicant’s one year extension request for Tentative Tract 6473 Phase 3.   The project is located one quarter of a mile north of the northeast corner of the intersection of Highway 46 and Palm Avenue.  Staff recommends approval.   Greg Black, Dewalt Corporation, stated that the extension will give the applicant time to complete the tract.

Senior Planner McNamara reports on the applicant’s one year extension request for Tentative Tract 6460.  The project is located at the southwest corner of the intersection of Palm and Gromer Avenues.  Staff recommends approval.

These amendments will affect the rear yard setbacks as it pertains to patios in the new residential construction – City of Wasco

Senior Planner McNamara reported on staff’s proposal to allow an encroachment of up to six feet into the required fifteen foot rear yard setback.

10.     MINUTE MOTION ITEMS

a)      CONSIDERATION OF DESIGN GUIDELINES for Commercial Development

Planning Director Woodcock briefly introduced the design guidelines to the Planning Commission.  Planning Commission agreed to discuss adoption at next meeting.   Discussion on how they liked the idea, concerns about security of parking in back of businesses.

b)      REQUESTS FOR SPECIAL MEETING Week of February 19th- Feb.23, 2007

Planning Director Woodcock requested for a special meeting to discuss the future construction of two hotels and a restaurant. The Commissioners were in agreement for the meeting.  

After brief discussion the commissioners were in agreement to meet one day of the week of February 19 thru 23, 2007, they would be advised.

12.     PLANNING DIRECTOR’S REPORTS
         
        Planner Director Woodcock commented on the Planning Institute meeting regarding the role of the planning commission.  The meeting will possibly be in April rather than March.

13.        COMMISSIONERS COMMENTS

        Commissioner Drescher comments on the ad in the Wasco Tribune advertising second dwelling.
        Commissioner Arredondo stated she would like to see the Planning Commission meet more often with the City Council.
