Commissioner Santillan moved to approve the Consent Calendar.  Seconded by Commissioner Forrest.  Motion carried.

10.     PUBLIC HEARINGS – POLICY ITEMS

a)      TENTATIVE TRACT #6924, and Resolution – a subdivision of 95.56 acres into a two hundred and seventy nine (279) lot subdivision with an accompanying 4.20 acre park/retention basin. Location: south of Filburn Ave., west of Hwy. 43, north of Jackson Ave and east of Griffith Ave. in the City of Wasco. APN: 489-020-08, 489-020-09 and 489-020-14.  Applicant: Newman, Ramsum, Ceraolo/Durando

Chairperson Brown opened the public hearing at 7:15 p.m.

Planning Director Woodcock reported on the applicants request to allow the creation of a two hundred and eighty (280) lot subdivision on approximately ninety five (95.56) acres of land with one (1) park/drainage sump lot and a four (4) acre designated remainder.  The project is on the north of Filburn Avenue, the east by Hwy. 43, the south by Jackson Ave., and the west by Griffith.  It is consistent with the General Plan. The applicant proposes to construct the subdivision in three phases. Director Woodcock also reported on a possible bike path condition being added, Caltrans condition, the basin/park area, a Traffic Study done before the final map recordation, reviewed the Traffic Impact and Noise elements.  

There was discussion on crosswalks, bike paths, drainage, right of way on Hwy. 43, police services tax, arterial streets, landscaping, drainage basin/park lot and the dedication of land to the City of Wasco, Jackson Street two inch (2”) overlay.  Also the recommendation to expand the eas5t ½ right of way made by Caltrans.

Greg Black, DeWalt Corporation representing the applicants Pat Newman, Harvey Ramsum, and Richard Ceraolo spoke briefly and made request to amend or remove several conditions. Mr. Black spoke in regards to the 200 foot radius being that it is standard for a cul-de-sac within a subdivision, the park once the final map is recorded the developer will dedicate to the City of Wasco.   Also requested clarification in regards to bike paths and were not in favor of the bike path condition.  Mr. Black also stated disapproval of the following conditions from the staff report:  Comment #8, 21, 23, 24, 25; Page 8 Water/Fire Condition #2; Page 10, comment #9

Harvey Ramsum, one of the property owners, voiced his concerns on the dedication of land requirements, Caltrans request, stating that there will be no traffic impact being created. Not in favor of the two inch (2”) overlay on Jackson Ave.

Mr. Loren Grant, resident at the corner of Griffith and Jackson, stated that Griffith needed to be widened, Griffith to Kimberlina is too narrow of a road for the traffic that will be created from new development. Also stated that the land needs to be cleaned from trash and debris before construction starts on the project.  There are people concerned with the trash and furniture dumped along Jackson Avenue .

Dr. Gordon Nipp, Vice Chairperson of the local Sierra Club, requested that the developer be  required to mitigate the loss of the prime ag land.  Read a letter from attorney.  Stating the Sierra Club had met with the developer. Not in favor of development.

Chairperson Brown closed the public hearing at 9:11 p.m.

There was discussion on Filburn’s alignment from Broadway to Hwy. 43, increased traffic on Filburn, cost of overlay on Jackson Street.  The conditions that were deleted were discussed and the changes or amendments to some conditions reviewed.

Planning Director reviewed deleted/amended the following Conditions of Approval:

General Conditions – Page 2 - Item #8 was deleted.

Planning Department – Page 6 – Item 21 -  Shall read:
The applicant shall meet all the requirements of the Shafter Wasco Irrigation District.

Item #23 – bullet #1 was removed.

Item #24 was removed.

Item #25 was changed to read:
The west bound travel lane that lies between the project area and State Route 43 shall be overlain with a two (2) inch cap.

Water/Fire
Item# 2 – shall read:
A twelve (12) inch water line shall need to be constructed in Jackson Avenue from Griffith Avenue to the eastern boundary of the Tract Map.

Public Works
Item #9 removed bullet #2  
Jackson Avenue from the edge of the tract to Hwy. 43 shall be refurbished to City and Caltrans standards.  WAS REMOVED.

Commissioner German moved to approve Tentative Tract 6924 as amended.  Seconded by Commissioner Santillan.  Motion carried with the following vote:

AYES: Commissioners Brown, Drescher, Forrest, German, Santillan
NOES: None
ABSENT: Commissioners Arredondo, Mitchell

Secretary Rodriguez read the title of Resolution 07-01 – Tentative Tract 6924 as amended
