WASCO PLANNING COMMISSION MEETING
JUNE 12, 2006 – 7:00 P.M.

CALL TO ORDER by Vice Chairperson Campbell.
2&3.    Vice Chairperson Campbell led FLAG SALUTE and INVOCATION.

4.      Present: Vice-Chairperson Campbell, Commissioners Arredondo, Mitchell, Santillan, Voth.   Absent: Chairperson Steward and Commissioner Brown.

Also present Director Woodcock, Senior Planner McNamara, Secretary Rodriguez.

5. AWARDS AND PRESENTATIONS - NONE

Commissioner Voth moved to approve the Consent Calendar as presented.  Seconded by Commissioner Santillan.  All in favor, motion carried.

10.     PUBLIC HEARINGS – POLICY ITEMS
        
a) CONTINUED – PARCEL MAP 11497 and Resolution – A subdivision of one    fifteen (15.01) acre parcel into a four (4) smaller parcels with one (1) designated remainder; Location: One quarter (1/4) mile southeast of the intersection of Filburn and Central Avenues; APN: 489-020-04; Applicant: John and Julie Bean  

Vice Chair Campbell opened the public hearing at 7:04 p.m.

Planning Director Woodcock reported that the project site is on Palm Avenue approximately one-quarter mile of the intersection of Palm and Filburn Avenues.  The proposed project is a subdivision of a 15-acre parcel into four smaller parcels with a designated remainder.  The property was annexed with Annexation 35.  The applicant will be required to improve Palm Avenue, construct a minor collector street along the south property line of the property and construct any infrastructure required by the City.

There was discussion on the proposed minor collector street, walkway and bike path, school site, and the existing house.

Ken Paul, 2600 Silvertree Lane, Wasco representing the Wasco Elementary School Board stated that the school was in opposition of the proposed new road.  The school had already dedicated 60 ft to the city for improvements along Griffith Avenue, and any additional dedication would be cost prohibitive.

Bob Clark, 401 Peters stated he was working with Mr. Bean and was in opposition of the proposed collector road, he plans to build on Mr. Bean’s property.

Bob Clark, Jr., 625 Cedar stated that a planned road could create problems.

Vice Chair Campbell closed the meeting at 7:26 p.m.

There was discussion on increase traffic, bike trails, and the need for road, walkways, road dedication and improvements.

Other ways to travel to Palm Avenue like on the church property, open up the cul de sac on new tract.

After some discussion these conditions were added:

1)      The Planning Commission of the City of Wasco has determined that the required road along the southern edge of the property was not necessary.
2)      An amendment to the Circulation Element of the General Plan shall be considered to eliminate the required road improvements approximately one quarter mile south of Filburn Avenue.
3)      Improvements to Palm Avenue shall be completed at the sole cost of the applicant and shall satisfy City standards.

Commissioner Voth moved to approve with no road, but bike paths and walkways.  Seconded by Commissioner Mitchell.  Motion died with 2 Yeses; 3 Noes

Commission Arredondo moved to approve Parcel Map 11497and Notice of Exemption, with no road, no walkways and no bike trails.  Seconded Commissioner Santillan.  Motion carried with the following vote:

AYES: Commissioners  Arredondo, Campbell, Santillan,
NOES: Commissioners  Mitchell and Voth
ABSENT: Commissioners Brown, Steward
ABSTAIN: NONE

Secretary Rodriguez read the title of Resolution 06-22

RESOLUTION 06-22 – A Resolution of the Planning Commission of the City of Wasco in the Matter of the Application of John Bean for Parcel Map 11497

b) CONTINUED - Zone Change 06-06 and Resolution – Residential Design Criteria; Mechanical Equipment related to ground mounted and screening. Section 17.19(N)(5) City of Wasco

Planning Director Woodcock reported he had spoke with several developers and they were all proposing to built ground mounted units.  Mr. Woodcock requested this be continued to the next meeting.

Commissioner Voth moved to continue Zone Change 06-06.  Seconded by Commissioner Mitchell.  All in favor, motion carried.

c) ZONE CHANGE 06-07, Resolution-  A change to the Downtown Historic Overlay District to allow the addition to an existing commercial building located at 900 Seventh Street.  The Overlay District presently calls for Public Open Space at this location.  Location: Northwest corner of the intersection of 7th Street and “E” Street; Applicant: Salvador Cruz- CONTINUE JULY 10, 2006

Planning Director Woodcock requested Zone Change 06-07 be continued as they working with appraiser on the value of the property.

Commissioner Voth moved to continue Zone Change 06-07.  Seconded by Commissioner Santillan.  Motion carried.

c)      ZONE CHANGE 06-08 and Resolution A change to Zoning Ordinance Chapter 17.29 Commercial Standards of the City of Wasco related to Bar-B-Ques and open pit type fires in Commercial Districts; Location Commercial Zones – City wide; Applicant: City of Wasco

Planning Director Woodcock reported on the proposed zone change regarding barbeques and open pit type fires in Commercial District city-wide.  The outdoors preparation of foods includes the preparation of foods, the creation of smoke and odors, sanitation, and compatibility with adjoining uses.  The commercial businesses that have typically prepared foods outdoors include grocery type stores and restaurants. The City Council has requested that the Planning Commission review the matter and make recommendation.

Commissioner Santillan moved for no zone change relating to the barbeques and open pit fires in the commercial districts citywide.  Seconded by Commissioner Arredondo.  All in favor, motion carried.

e) ANNEXATION #39, PREZONING, Negative Declaration and Resolution – Annexation of approximately 80-acres of land bounded by Hwy. 46 (north), 7th Street (south) and Magnolia Ave., (east).  Project includes Pre-zoning the property in the R-1-6 (Low Density Residential District, 6,000 square foot minimum lot size) APN: 487-150-01,02,03; Applicant:  Striper Cove Wasco

Vice Chair Campbell opened the public hearing at 8:20 p.m.

Dennis reported on Annexation 39 consisting of 76.07 net acres of land that is bounded on the north by Hwy. 46, the east by Magnolia Ave., and the south by 7th Street.  The applicant is requesting that the property be pre-zoned with an underlying base zoning of R-1-6 with a Specific Plan Overlay District applied to the project area. The annexation is consistent with the City’s General Plan.  Based on the pre-zoning request, staff has determined that the property upon annexation will be developed into residential uses.  Prior to this occurring the following actions need to take place:  Cancellation of the Williamson Act Contract, General Plan Amendment to amend the Growth Boundary and  findings.   In addition the General Plan also has policies limiting the effect of urban sprawl.  These policies include postponing development of the subject property unless 35% of the parcel is continuous to existing development.  

Greg Black, DeWalt Engineering representing Striper Cove stated they were in agreement with the conditions set.

Nila and Mike Job, 15289 Magnolia, Wasco stated they opposed the zoning of R-1-6.  They were not in opposition of the annexation.  They had bought the property to have animals and corrals for the horses.  They were zoned Rural Residential.  The Jobs also stated that if their property were annexed than Striper Cove needs to install the necessary improvements.

Greg Black stated that the improvements would be when the tracts start.  They will work with the Jobs on grand fathering their property, possibly the project take care of the improvements and the current owner could leave there estate to their heirs leaving zoning as is.

The Jobs were concerned with the restrictions being put on them when the new development started.

Vice Chair Campbell closed the public hearing at 8:57 p.m.

After a brief discussion these conditions were added:

1)      The owners of the Assessor’s Parcel Number 487-150-05 shall be allowed to maintain their property and its current use.  Said use shall be in affect until the property is no longer in the Job family.

2)      At such time in change of ownership of the aforementioned property, the new owner shall apply for a Conditional Use Permit to allow for the keeping of livestock.

3)      Any urban development on the larger parcel shall be required to improve Magnolia Avenue from State Hwy 46 south to the intersection of 7th Street and Magnolia Avenue and 7th Street from the intersection of Magnolia Avenue and 7th Street west to the edge of the property.

Commissioner Voth moved to approve Annexation 39, Negative Declaration, Pre-zoning with the amendment based on the Job’s property.  Seconded by Commissioner Santillan.  Motion carried with the following vote:

AYES: Commissioners Campbell, Arredondo, Mitchell, Santillan, Voth
NOES:NONE
ABSENT: Commissioners Steward, Brown

RESOLUTION 06-23 – A Resolution of the Planning Commission of the City of Wasco Adopting the Negative Declaration and Proposing Proceedings for Prezoning, and Annexation of Territory to the City of Wasco identified as Annexation 39

Planning Director Woodcock reported on the concerns of the City Council regarding lot sizes, improving amenities of smaller homes, reviewing house plans, features and improving designs.

Commissioners were in agreement with the report.
