Chairperson Steward called the regular Planning Commission meeting to order at 7:00 p.m.

Commissioner Brown moved to approve the Consent Calendar as presented. Seconded by Commissioner Campbell. All in favor, motion carried.

11. PUBLIC HEARINGS – POLICY ITEMS
a) General Plan Amendment 06-01 and Resolution – A change to the General Plan Land Use Map of the City of Wasco re-designating approximately forty five (45) acres of land designated as Commercial Retail to Low Density Residential; Location: the northeast corner of Hwy. 46 and Magnolia Ave., APN: 488-010-04 and 487-010-37; Applicant: Merjan Financial – CONTINUED FROM 4/10/06
b) Zone Change 06-03 and Resolution – A change to the Official Zoning Map of the City of Wasco reclassifying approximately forty-five (45) acres of land designated as Community Retail Commercial to R-1-6 (Low Density Residential 6,000 sq. ft. lot). Location: the northeast corner of Hwy. 46 and Magnolia Ave., Wasco, CA; APN: 488-010-04 and 487-010-37; Applicant: Merjan Financial – CONTINUED FROM 4/10/06
Chairperson Steward opened the continued meeting at 7:03 p.m.
Planning Director Woodcock reported on General Plan Amendment 06-01 and Zone Change 06-03 requesting that this item be taken off the agenda as it was not ready for action. It will return when the City Council takes action on the Williamson Act Cancellation, at that time the two items will be rescheduled and re-noticed.
Commissioner Brown moved to remove General Plan Amendment 06-01 and Zone Change 06-03 from the agenda until the outcome of the cancellation of the Williamson Act by the City Council. Seconded by Commissioner Santillan. All in favor, motion carried. These items will return for action by the Planning Commission.-----------------
Tentative Tract 6725, Mitigated Neg. Declaration and Resolution – A subdivision of an eighty (80.07) acre parcel into three hundred and twenty-six (326) dwelling units with an accompanying park/retention basin. Location: South of Gromer Ave., east of Magnolia Ave., and north of the Margalo Extension; APN: 487-010-11; Applicant: Eagle Meadows of Wasco.
Chairperson Steward opened the public hearing at 7:07 p.m.
Senior Planner McNamara reported on the applicant’s request, for a 326 lot subdivision on 80.06 acres of land located north of the Margalo Avenue extension, south of Gromer Avenue and west of Magnolia Ave. This parcel was annexed with Annexation 38. The General Plan designation is now Low Density Residential and zoned R-1-6. One lot will be used as a park/retention basin for the collection of any run-off associated with the tract. Staff recommends approval of Tentative Tract, Mitigated Negative Declaration with the conditions set.
Scott Roylance, Eagle Meadows stated they were in agreement with the conditions set. There was some discussion on time line, annexation and phases of tract and the extension of Margalo and Gromer.
Chairperson Steward closed the public hearing at 7:15 p.m.
Commissioner Brown moved to approve Tentative Tract 6725, Mitigated Negative Declaration and the Resolution. Seconded by Commissioner Campbell. Motion carried with the following vote:

RESOLUTION 06-19 A Resolution of the Planning Commission of the City of Wasco in the matter of the matter of the application of Eagle Meadows for Tentative Tract 6725
c) Tentative Tract 6901, Mitigated Negative Declaration and Resolution – A subdivision of a thirteen (13.60) acre parcel into a fifty nine (59) lot subdivision of which four (4) lots shall be used as a retention basin. Location: South of the Margalo Ave., alignment and east of Griffith Ave., APN: 487-040-09; Applicant: Del Valle Homes
Chairperson Steward opened the public hearing at 7:17 p.m.
Commissioner Arredondo removed herself from the board as she had a conflict.
Senior Planner McNamara reported on the request by Del Valle Homes for a 59 lot subdivision on 13.70 acres of land located south of Margalo Avenue west of Griffith Avenue. Has been annexed to the City as part of Annexation 35, designated Low Density Residential and zoned R-1-6. The subdivision will be 55 lots for single family houses the remaining four lots being used for retention of any run-off associated with the tract. The applicant will construct Margalo and Griffith Avenue to the street centerline and all internal streets.
Planning Director Woodcock reported on the requirements stipulated by the Shafter Wasco Irrigation District.
There was some discussion on the ½ streets being developed fully, signal at Hwy 46 and Griffith, SWID lines, retention basin, lot size, Master Plans and use of a CUP.
Sal Gonzalez, Del Valle Homes, representative stated they were in agreement with the conditions set.
Mark Elrod, Del Valle Homes, Vice President spoke on the proposed retention sump, making some suggestions for screening such as a living wall, screened slatted fence or block wall.
There was discussion on approving map and bring back at time of final map approval with design for wall and screening and have staff review.
Chairperson Steward closed the public hearing at 7:54 p.m.
Commissioner Brown moved to approve Tentative Tract 6901 with a condition addressing the wall for the retention sump to be approved by the Planning staff. Motion carried with the following vote:

d) Parcel Map 11497 and Resolution – A subdivision of one fifteen (15.01) acre parcel into a four (4) smaller parcels with one (1) designated remainder; Location: One quarter (1/4) mile southeast of the intersection of Filburn and Central Avenues; APN: 489-020-04; Applicant: John and Julie Bean
Planning Director Woodcock stated that the applicant requested this item be continued to the next meeting to resolve some issues on the staff report.
Commissioner Brown moved to continue Parcel Map 11497 to the next Planning Commission meeting in June. Seconded by Commissioner Campbell. All in favor, motion carried.
e) Zone Change 06-06 and Resolution - Amendment to City of Wasco Zoning Ordinance Sections 17.19(H) Mobile Home and Manufactured Housing; (N) Residential Design Criteria; Section 17.79(P) Use of canopies and Resolution; Applicant: City of Wasco
Chairperson Steward opened the public hearing at 7:56 p.m.
Planning Director Woodcock reported on the proposed amendments to the Zoning Ordinance. Amending Section 17.19.01 (H) related to mobile and manufactured homes. Amending Section 17.19(N) related to Residential Architectural Design Criteria: 1) Mechanical Equipment; II) Landscaping Requirements and III) Multi-story Architecture; Amending Section 17.79 (P) Property Maintenance Code Enforcement and Abatement.
Chairperson Steward closed the public hearing at 8:15 p.m.
It was the consensus of the commission to continue the Section related to Mechanical Equipment related to ground mounted and screening to the next meeting. Section 17.19(N)(5)
Commissioner Brown moved to approve Zone Change 06-06 except Section 17.19(N)(5) pertaining to Mechanical Equipment. Seconded by Commissioner Santillan. All in favor, motion carried.

13. PLANNING DIRECTOR’S REPORTS
Planning Director Woodcock reported on allowing Planned Developments under a Conditional Use Permit allowing more flexibility. Requiring more information up front on lot lines, elevations, lay-outs. This will be brought back to the Commissioners for consideration. Also discussed downtown standards and code enforcement, taco trucks.
Mark Foster representing Heller Development spoke briefly regarding Tentative Tract 6589 located at Central and Filburn.
14. COMMISSIONERS COMMENTS
Commissioner Santillan suggested that a meeting be set with the Recreation District regarding retention ponds possibly combining all.
Commissioner Arredondo stated that St. John School would be interested in closing off the Street between the Catholic hall and the school for safety as children cross between these streets all day.
Staff will refer to the City Engineer and Public Works for consideration.
