WASCO PLANNING COMMISSION MEETING
MARCH 13, 2006 – 7:00 P.M.

1.      Chairperson Steward called the regular Planning Commission meeting to order at 7:00 p.m.

2&3.    Flag salute and Invocation were offered by Chairperson Steward.

4.      Present: Chairperson Steward, Commissioners Arredondo, Brown, Campbell, Mitchell, Santillan.  Absent: Commissioner Voth.

Also present: Planning Director Woodcock, Senior Planner McNamara, Secretary Rodriguez.

5.      AWARDS AND PRESENTATIONS – NONE

6.      HEARING FROM PUBLIC ON ITEMS NOT ON AGENDA – NONE

7.      AGENDA ADDITIONS/DELETIONS – NONE

8.      CONSENT CALENDAR

        a)      Approval of Minutes February 13, 2006 meeting
        b)      Approve the Reading of all Resolutions by Title only

9.      MINUTE MOTION ITEMS – NONE

10.     a)      General Plan Amendment 06-01 and b) Zone Change 06-03 – Planning Director Woodcock requested that items a) and b) be CONTINUED TO 4/10/06.

Commissioner Brown moved to continue General Plan Amendment 06-01 and Zone Change 06-03 to the April regular meeting.  Seconded by Commissioner Santillan.  All in favor, motion carried.

        c)      Parcel Map Waiver 06-01 – A proposal to divide one 17,127 sq. ft. parcel into two smaller lots.  Location: 728 16th Street, Wasco, CA 93280; APN: 030-442-13; Applicant: Fortino and Maggie Valdivia.

Chairperson Steward opened the public hearing at 7:03 p.m.

Senior Planner McNamara reported on the request for Parcel Map Waiver 06-01 to divide one existing 17,127 sq. ft. parcel into two smaller parcel with Parcel A being 10,457 sq. ft. and Parcel B being 6,670 sq. ft.  Upon recordation the parcel map waiver the newly created parcels will be consistent with the provisions of the City’s general Plan and Zoning.  The parcel is currently designated as Low Density Residential and any proposed development shall be required to be consistent with the required density of this designation.  Staff recommends approval with the listed conditions.

John Koehne, Professional Land Surveyor for the applicant stated that upon review of the staff report he was in agreement with the conditions set.

Chairperson Steward closed the public hearing at 7:08 p.m.

Commissioner Brown moved to approve Parcel Map Waiver 06-01.  Seconded by Commissioner Arredondo, all in favor, motion carried with the following vote:

AYES: Commissioners Steward, Arredondo, Brown, Campbell, Mitchell, Santillan
NOES: NONE
ABSENT: Commissioner Voth

Secretary Rodriguez read the title of Resolution 06-09.

RESOLUTION 06-09 – A Resolution of the Planning Commission of the City of Wasco in the matter of the application of Fortina and Maggie Valdiva for a Parcel Map Waiver located at the northeast corner of Hwy. 43 and 16th Street

        d)      Zone Variance 06-01 – A variance to Section 17.19.01 of the City of Wasco Zoning Ordinance allowing an encroachment of eight (8) ft. into the required rear yard setback.  Location: Approx. 300 ft. west of the northwest corner of the intersection of Poso Dr., and Palm Ave., APN: 488-060-12;  ITP Development, LLC

Chairperson Steward opened the public hearing at 7:10 p.m.

Senior Planner McNamara reported the applicant ITP Development was requesting a zone variance to be allowed to encroach eight feet into the required fifteen feet rear yard setback.  The applicant proposes to construct a duplex on the site.  Staff recommends approval with the findings and conditions set.

There was discussion on the parking, backyard landscaping.

The applicant was not present.

Condition was added:

5) Prior to the issuance of a Certificate of Occupancy, the developer shall submit a landscape and irrigation plan to the City of Wasco Planning Department for review and approval.

Chairperson Steward closed the public hearing at 7:15 p.m.

Commissioner Brown moved to approve Zone Variance 06-01 with the added condition. Seconded by Commissioner Santillan.  Motion carried with the following vote:

AYES: Commissioners Steward, Arredondo, Brown, Campbell, Mitchell, Santillan
NOES: None
ABSENT: Commissioner Voth

Secretary Rodriguez read the title of Resolution 06-10.

RESOLUTION 06-10 A Resolution of the Planning Commission of he City of Wasco in the matter of the application of ITN Development, LL for Zone Variance 06-01, a proposal to encroach into a required setback

        d)      Conditional Use Permit 06-01 – A proposal to construct a duplex in a commercially designated zone.  Location: 1045 E Street, Wasco, CA; APN: 030-412-07; Applicant: Hector Delgado

Chairperson Steward opened the public hearing at 7:18 p.m.

Senior Planner McNamara reported that the applicant Hector Delgado had requested a conditional use permit to be permitted to construct a duplex on a 7,500 sq. ft. lot designated as Central Business District.  Because of the zoning any residential project is not allowed by right and requires a Conditional Use Permit.  The City has determined that the project is Categorically Exempt.  The project site is a vacant lot located in an area of mixed uses with residential and commercial uses being the most prevalent.   The proposed duplex will be approximately 2,130 ft.  and/or 1,260 ft., in of living area with an attached single car garage, 264 sq. ft; attached patio, 60 ft. in size. Also an additional detached 3 car covered parking structure.  Staff recommends approval of the request for Conditional Use Permit 06-01 with the findings and conditions set.

Commissioner Arredondo removed herself from the committee as she had a conflict.

Chairperson Steward closed the public hearing at 7:25 p.m.

Commissioner Brown moved to approve Conditional Use Permit 06-01 with the conditions set.  Seconded by Commissioner Campbell.  Motion carried with the following vote:

AYES: Commissioners Steward, Brown, Campbell, Mitchell, Santillan
NOES: None
ABSENT: Commissioner Voth
ABSTAIN: Commissioner Arredondo

Secretary Rodriguez read the title of Resolution 06-11

RESOLUTION 06-11 – A Resolution of the Planning Commission of the City of Wasco in the matter of the application of Hector Delgado for Conditional Use Permit 06-01 located at 1250 E Street

        a)      Planners Institute 2006 information was distributed to those attending.
        b)      Approved City Council minutes for review

12.     PLANNING DIRECTOR’S REPORTS

Planning Director Woodcock reported on the LAFCO meeting and the proceedings on Annexation 36.  There was a brief discussion.

13.     COMMISSIONERS COMMENTS

Commissioner Arredondo inquired about a stop sign at 5th and F Street and also on the Wasco Parks and Recreation district and the Quimby Act.  There was a brief discussion.

        Planning Director Woodcock reported on the AutoCad position.

14.     ADJOURNMENT – Commissioner Brown moved to adjourn at 7:30 p.m.  Seconded by Commissioner Campbell.  Motion carried.
