WASCO PLANNING COMMISSION MEETING MINUTES
FEBRUARY 13, 2006 – 7:00 P.M.

1.      Chairperson Steward called the regular Planning Commission meeting to order at 7:00 P.M. on February 13, 2006.

2&3.    Flag Salute and Invocation were offered by Chairperson Steward.

4.      Present: Chairperson Steward, Commissioners Brown, Campbell, Santillan.
Absent: Commissioners Arredondo, Mitchell, Voth.

Also present Planning Director Woodcock, Senior Planner McNamara, Secretary Rodriguez.

        Planning Director Woodcock requested that Item 11. INFORMATION ITEMS a) Tentative Tract 6724 and b) Tentative Tract 6725 could be taken up at this time.  Mr. Scott Roylance from Stockton representing Eagle Meadows was present and requested to be heard.

Planning Director stated that staff had reviewed the maps and subject to revisions, is prepared to make a favorable recommendation to the Planning Commission for approval.  Both Tentative Tract 6724 and Tentative Tract 6725 will be before Planning Commission upon approval of the accompanying annexations.

Mr. Roylance distributed maps of the proposed tentative tracts, there was discussion on lot sizes, drainage basins, park land, landscaping, and lighting.  Also discussed was the upcoming LAFCO meetings and Annexation 36 and 38.

No action was taken as this was only an information item.

Commissioner Campbell moved to approve the Consent Calendar as presented.  Seconded by Commissioner Steward.  All in favor, motion carried.

10.     PUBLIC HEARINGS

a)      Parcel Map Waiver #05-02 – A Parcel Map Waiver to divide one (1) nineteen thousand eight hundred and forty five (198845) sq. ft. parcel into two (2) smaller parcels.  Parcel 1 being ten thousand two hundred and thirty seven sq. feet (10,237.05) and Parcel 2 being nine thousand six hundred and seven sq. ft. in size (9,607.95).  Location: The northeast corner of the intersection of Broadway and 10th Place, Wasco, Ca Applicant: Jesus Soto

Chairperson Steward opened the public hearing at 7:15 p.m.    

Senior Planner McNamara reported that the applicant, Jesus Soto was proposing to divide one 19,845 sq. ft. parcel into two parcels, Parcel 1 being 10,327.05 sq. ft. and Parcel 2 being 9,607.95 sq. ft.  Staff recommends approval with the conditions set.

There was a brief discussion on sidewalk and construction of new home.

Chairperson Steward closed the public hearing at 7:19 p.m.

Commissioner Brown moved to approve Parcel Map Waiver 05-02 with the conditions set.  Seconded by Commissioner Santillan.  All in favor, motion carried.

Secretary Rodriguez read the title of Resolution 06-04 – PMW 05-02

RESOLUTION 06-04 – A Resolution of the Planning Commission of the City of Wasco in the Matter of the Application of Jesus Soto for a Parcel Map Waiver located at the northwest corner of Broadway and 10th Place

b)      Parcel Map Waiver #05-03 – A Parcel Map Waiver to divide one (1) seven and three quarter (7.72) acre parcel into two (2) smaller parcels.  Parcel 1 being approximately three tenths (.34) of an acre and Parcel 2 being seven and three tents (7.38) of an acre.  Location: The southeast corner of the intersection of Hwy. 46 and Central Ave., in the K-Mart Shopping Center, Wasco, CA; Applicant: JHL Properties, LLC

Chairperson Steward opened the public hearing at 7:20 p.m.

Senior Planner McNamara reported that the applicant was proposing to divide one existing 7.72 acre parcel into two new parcels with Parcel 1 being 0.34 gross acres in size and Parcel 2 being 7.38 gross acres in size.  Upon recordation of this parcel map waiver the newly created parcels will be consistent with the provisions of the City of Wasco General Plan and Zoning Ordinance.  The parcel is located in the K-Mart Shopping Center at the southeast corner of Hwy. 46 and Central Ave.  The applicant is proposing to construct a Dollar Tree store on the 0.34 acre parcel directly east of the K-Mart store.  Staff recommends approval of Parcel Map Waiver 05-03 with the conditions set.

Bill Black, DeWalt Engineering representing the applicant stated they were in agreement with the conditions set.  There was a brief discussion on parking.

Chairperson Steward closed the public hearing at 7:25 p.m.

Commissioner Brown moved to approve Parcel Map Waiver 05-03 with the conditions set.  Seconded by Commissioner Santillan.  Motion carried:

RESOLUTION 06-05 – A Resolution of the Planning Commission of the City of Wasco in the Matter of the application of JHL Properties, LLC for a Parcel Map Waiver located at the southeast corner of Hwy. 46 and Central Avenue

c)      General Plan Amendment 06-01 – A Change to the General Plan Land Use Map of the City of Wasco re-designating approximately forty five (45) acres of a land designated as Commercial Retail to Low Density Residential; Location: The northeast corner of Hwy. 46 and Magnolia Ave., APN: 488-010-04 and 497-010-37; Applicant: Merjan Fiancial – CONTINUED

Chairperson Steward opened the public hearing at 7:27 p.m.

d)      Zone Change 06-03 – A change to the Official Zoning Map of the City of Wasco reclassifying approximately forty five (45) acres of a land designated as Community Retail Commercial to R-1-6 (Low Density Residential 6,000 sq. ft. lot).  Location: The northeast corner of Hwy. 46 and Magnolia Ave., Wasco, CA; APN: 488-010-04 and 497-010-37; Applicant: Merjan Financial – CONTINUED

Chairperson Steward opened the public hearing at 7:27 p.m.

The applicant had previously spoken with the Planning Director Woodcock requesting that the public hearings for General Plan Amendment 06-01 and Zone Change 06-03 be continued to the March meeting.

Commissioner Brown moved to continue the public hearings to the March meeting.  Seconded by Commissioner Santillan.  All in favor, the meeting was continued.

e)      General Plan Amendment 06-02 – A change to the Official General Plan Land Use Map of the City of Wasco re-designating approximately fourteen (14) acres of land designated as Low Density Residential to Rural Residential; Location: Approximately one quarter (1/4) mile south of the intersection of Palm and Filburn Ave., Wasco, CA; APN: 488-020-04; Applicant: John Bean

f)      Zone Change 06-05 – A change to the Official Zoning Map of the City of Wasco re-classifying approx. fourteen (14) acres of land designated as R-1-6 (Low Density Residential 6,000 sq. ft. lot) to R-R (Rural Residential).  Location: Approx. one quarter (1/4) mile south of the intersection of Palm and Filburn Ave., Wasco, CA;  APN: 488-020-04; Applicant: John Bean

Planning Director Woodcock stated this would be a combined staff report on the General Plan Amendment 06-02 and Zone Change 06-05 as it was the same area and owner.  The property is located approximately one quarter mile south of the intersection of Palm and Filburn Avenues.  The applicant is also requesting that the filing fee associated with the General Plan and Zone Change a total of $1,250 be waived as he felt that it had been paid for when the property was annexed and designated to Rural Residential later changed to R-1-6.    Staff recommends approval of GPA 06-02 and Zone Change 06-05 and forward to the City Council.  Also the Commission may make their recommendation on the request for the waiver of fees.

John Bean, the applicant was present and stated this would be large lots with country living, no curbs or gutters, have easements, own septic tanks.  Requested to the Commissioners that they waive the fees.

Chairperson Steward closed the public hearings at 7:45 p.m.

Commissioner Brown moved to approve GPA 06-02 and the exclusion of fee waiver. Seconded by Commissioner Santillan.  Motion carried with the following vote:

Commissioner Brown moved to approve Zone Change 06-05 and the waiving of the fees. Seconded by Commissioner Campbell.  All in favor, motion carried:

g)      Zone Change 06-04 – Amending the City of Wasco’s Zoning Ordinance to add Section 17.19.30, establishing design standards for swimming pools in Residential Zones; Location: Citywide; Applicant: City of Wasco

Chairperson Steward opened the public hearing at 7:47 p.m.

Planning Director Woodcock reported staff proposes to amend Section 17.19.01.0. entitled Swimming Pools be added to the Zoning Ordinance setting requirements for location, screening, lighting noise, maintenance, filling/emptying and Site Plan Review.

The definition of pool was discussed.

Chairperson Steward closed the public hearing at 7:54 p.m.
