WASCO PLANNING COMMISSION MEETING
JANUARY 9, 2006 – 7:00 P.M.
1. Chairperson Brown called the regular Planning Commission meeting to order at 7:00 p.m. on January 9, 2006.
2&3. Flag salute and Invocation were offered by Chairperson Brown.
4. Present: Chairperson Brown, Commissioners, Arredondo, Campbell, Mitchell, Steward, Voth. Commissioner Santillan entered at 7:09 p.m.
Also present: Planning Director Woodcock, Senior Planner McNamara and Secretary Rodriguez.

6. MINUTE MOTION ITEMS
a) NOMINATION OF CHAIRPERSON
Commissioner Voth moved to nominate Commissioner Steward for Chairperson. Seconded by Commissioner Mitchell.
Hearing no other nominations, Commissioner Campbell moved to close the nominations, seconded by Commissioner Voth. All in favor, motion carried.
Commissioner Steward was nominated Chairperson.
b) NOMINATION OF VICE CHAIRPERSON
Commissioner Campbell moved to nominate Commissioner Brown for Vice Chairperson, Seconded by Commissioner Arredondo. Commissioner Voth moved to nominate Commissioner Campbell for Vice Chairperson, Seconded by Commissioner Brown.
Hearing no other nominations, it was moved by Commissioner Steward to closed the nominations, seconded by Commissioner Brown.
A vote as held, Commissioner Campbell with 4 votes was nominated as Vice Chairperson.
Commissioner Campbell was nominated Vice Chairperson.

Commissioner Brown moved to accept the Consent Calendar as presented. Seconded by Commissioner Campbell. All in favor, motion carried.
10. PUBLIC HEAIRNGS
a) Zone Variance 05-02 and Resolution – a variance to Section 17.19.01 of the City of Wasco Zoning Ordinance as it relates to parking requirements at multi-family structures to allow parking in front of the proposed units. Located: The southeast corner of Central avenue and Central Park Drive, Wasco, CA; APN: 488-151-09; Applicant: Ulices Melendez
Chairperson Steward opened the public hearing at 7:10 p.m.
Senior Planner McNamara reported the applicant is requesting that the required setbacks be waived and that the required parking be located in front of the proposed duplex. The applicant’s request for a zone variance to allow relief from certain setback restrictions when special physical circumstances exist that would limit the development of a particular property in accordance with the development standards of a zoning district. Staff determined that the required findings have been satisfied. Based on the public testimony and staff report, staff recommends approval of Zone Variance 05-02 with the conditions set.
Ulices Melendez the applicant was present and in agreement with the conditions set.
Chairperson Steward closed the public hearing at 7:13 p.m.
There was a brief discussion on the parking area.
Commissioner Brown moved to approve Zone Variance 05-02 and the Resolution. Seconded by Commissioner Santillan. All in favor, motion carried.

RESOLUTION 06-01 A Resolution of the Planning Commission of the City of Wasco in the Matter of the Application of Ulices Melendez for Zone Variance 05-02 located at the Southeast corner of Central Avenue and Central Park Drive.
b) Amendment to the Subdivision Ordinance 06-01 and Resolution – Amendment to Section 16.46 of the City of Wasco Subdivision Ordinance changing the acreage requirement for park dedication from 2.5 acres per thousand residents to 3.0 acres: Applicant: City of Wasco
Chairperson Steward opened the public hearing at 7:15 p.m.
Planning Director Woodcock gave a brief report on the proposed amendment to the Subdivision Ordinance changing the acreage requirement. The amendment would be to Chapter 16.46 of the City’s Subdivision Ordinance related to setting the Quimby Dedications and Fee for park land. The amendments would be
* Increase the park dedication and in-lieu fee formulas to require 3.0 acres per 1,000 population instead of the current 2.5 acres. This is consistent with the maximum allowed under state law.
* No change is proposed to using fair market value in determining the in-lieu fee.
* The in-lieu fee will be paid to the City. The in-lieu fee is to be paid in total if the project consists of 50 or fewer dwelling units. Projects with more than 50 units may elect to pay a prorated amount at the time each building permit is applied for.
The fees collected would be for the acquisition of park space consistent with the consensus between the Planning Commission and the Recreation District. Staff is proceeding to work on a Recreation Element to the General Plan to help implement the District’s Master Park Plan.
Staff recommends approval of revising the City’s Quimby Program and forwarding the Resolution to the City Council.
There was a brief discussion on fair market value, and the maximum allowed by the state.

Commissioner Santillan moved to approve amending the Quimby Dedications and Fees for parkland. Seconded by Commissioner Brown. Motion carried with the following vote:

RESOLUTION 06-02 – A Resolution of the Planning Commission of the City of Wasco in the matter of amending Chapter 16 of the City of Wasco Municipal Code related to Park land dedication and a fee in-lieu program pursuant to the Quimby Act
c) Zone Change 06-02 and Resolution – A change to Section 17.1901H of the City of Wasco Zoning ordinance as it relates to the date of construction of a manufactured housing unit. Applicant: City of Wasco
Chairperson Steward opened the public hearing at 7:22 p.m.
Planning Director Woodcock gave a brief report on the proposed amendment to Section 17.19.01.H.4. adding subsection 3) establishing a maximum age limit of 10 years for manufactured housing. The city at the present time does not regulate the age of manufactured housing units being installed. Staff recommends approval of the amendment limiting the age of manufactured housing to a maximum of 10 years and forwarding to the City Council.
There was a brief discussion on age of manufactured homes, state requirements and permanent foundations.
Chairperson Steward closed the public hearing at 7:37 p.m.
Commissioner Santillan moved to approve Zone Change 06-02 and Resolution. Seconded by Commissioner Voth. Motion carried with the following vote:

12. PLANNING DIRECTOR REPORTS
Planning Director Woodcock reported on several projects that had been before the City Council. 2010 Growth Boundary, Annexation 38, Annexation 35. Zone Change 05-04 changing zoning from R-2 to R-3 had been denied.
Reported that a Special meeting was held on January 9, 2005 to discuss the golf course finances and to amend the requirements of the locations of pools and fencing.
Secretary Rodriguez was congratulated on 20 years of service to the City as a Planning Secretary.
13. COMMISSIONERS COMMENTS
There was a brief discussion on proposed new high schools and locations.
Commissioner Brown congratulated Chairperson Steward on his appointment.
