PLANNING COMMISSION MEETING
JULY 11, 2005 – 7:00 P.M.
1. Chairperson Brown called the meeting to order at 7:00 p.m.
2&3. Chairperson Brown offered flag Salute and Invocation.
4. Present: Commissioners Brown, Arredondo, Campbell, Mitchell, Santillan, Steward, and Voth. Absent: Commissioner Arredondo
Also present: Planning Director Woodcock, Senior Planner McNamara and Secretary Rodriguez.

Secretary Rodriguez introduced the new Planning Director Keith Woodcock.

Commissioner Voth moved to accept the Consent Calendar as presented. Seconded by Commissioner Mitchell. All in favor, motion carried.
9. MINUTE MOTION
a) Site Plan and Elevation of proposed Store adjacent to existing Kmart: Applicant: JLH Properties, LLC, 2200 Pine St., Bakersfield, CA 93301
Senior Planner McNamara reported on the site plan or building design that is required to be reviewed by the Planning Commission. The builder does not have a firm commitment from a lessee. The building would be a modern shell building and would be filled by a tenant that typically utilizes a 10,000 sq. ft. building, such as a Dollar Store. Staff recommends that the Commission, by minute motion, make any suggestions on the architecture or needed site improvements and refers the item back to the staff for issuance of building permits.
Mr. Michael Dhanes, architect for the project was present as was Jeff Gutierrez of DeWalt Engineering who are the project engineers.
Commissioner Santillan moved to approve the project as presented. Seconded by Commissioner Campbell. All in favor, motion carried.
10. PUBLIC HEARINGS
a) Conditional Use Permit 05-06 – Large Family Day Care Facility and Resolution -for a Large Family Day Care Home Permit pursuant to Section 17.19.01 of the Wasco Zoning Ordinance to allow an in home day care for up to 12 children in an R-1-6 (Low Density Residential) zone located at 1418 Poso Dr., Wasco, Ca. Applicant: Leticia Morales, 1418 Poso Dr., Wasco, CA 93280
Chairperson Brown opened the public hearing at 7:13 p.m.
Dennis McNamara, Senior Planner gave a brief report on the applicant’s request to operate a Large Family Home Day Care out of her residence located at 1418 Poso Dr.; the applicant is currently licensed for a Small Family Home Day Care that per the requirements of the State of California can service up to eight (8) children. Upon approval of this application by both the Planning Commission and State of California, the day care operation will be able to provide services for up to fourteen (14) children. Staff recommends approval with the listed 10 conditions.
After a brief discussion on the play area, backyard and fencing. Chairperson Brown closed the public hearing at 7:22 p.m.
Commissioner Voth moved to approve CUP 05-06 and the Resolution. Seconded by Commissioner Mitchell. Motion carried with the following vote:

RESOLUTION 05-17 – A resolution of the Planning Commission of the City of Wasco in the Matter of the Application of Leticia Morales for Conditional Use Permit 05-06 located at 1418 Poso Drive
b) General Plan Amendment 05-03 and Zone Change 05-03, Resolutions – Applicant is requesting that the acreage designated as Medium Density Residential and Community Retail (5.4 acres total) be re-designated to Low Density Residential. Concurrent with the General Plan land use re-designation the applicant is also requesting a portion of acreage zoned R-2 Medium Density Residential and Commercial Retail (5.4 acres total) be reclassified to R-1-6 Low Density Residential 6,000 square feet lot. Location: Approximately one half mile northeast of the intersection of Palm Ave., and Hwy. 46, Wasco, CA. Applicant: B.J. Sahota, P.O. Box 394, San Ramon, CA 94582; APN: 487-040-08
Chairperson Brown opened the public hearing at 7:23 p.m.
Dennis McNamara, Senior Planner reported that the City had accepted an application for a 68 lot subdivision on approximately 13.66 acres of a larger 18.95 acre parcel. The proposed subdivision is for single family houses to be built on lots that are a minimum of 6,000 sq. ft., in size. With the current General Plan designations and Zoning classification the proposed subdivision could not be approved, therefore the applicant is requesting the aforementioned General Plan Amendment and Zone Change. The applicant is requesting that the acreage designated as Medium Density Residential and Community Retail (5.4 acres total) be re-designated to Low Density Residential. Concurrent with the General Plan use re-designation the applicant is also requesting the acreage zoned R-2 Medium Density Residential and
Commercial Retail (5.4 acres total) be reclassified to R-1-6 Low Density Residential 6,000 sq. ft. lots. Based on the information provided in the staff report, staff recommends approval of General Plan Amendment 05-03 and Zone Change 05-03 with the conditions set.
There was a brief discussion on the development of Margalo, and Poplar Streets.

Commissioner Brown moved to approve General Plan Amendment 05-03 and Zone Change 05-03 with the conditions set. Seconded by Commissioner Steward. Motion carried with the following vote:

RESOLUTION 05-18 – A Resolution of the Planning Commission of the City of Wasco in the Matter of the Application of BJ Sahota for General Plan Amendment 05-03 and Zone Change 05-03
b) Tentative Tract 6533 and Resolution – Map approximately one half mile northeast of the intersection of Palm Ave., and Hwy. 46, Wasco, ca: APN 487-040-08; Applicant: B.J. Sahota, P.O. Box 394, San Ramon, Ca 94582
Chairperson Brown opened the public hearing at 7:32 p.m.
Senior Planner McNamara reported on the applicant’s request for Tentative Tract 6533 for a 68 lot subdivision on approximately 13.66 acres of land. The project is to be built over 3 phases with Phase 1 consisting of 24 lots, Phase 2 consisting of 22 lots and Phase 3 consisting of the remaining 22. There is an additional 5.3 acres of land and it will be developed for commercial purposes and fronts Hwy. 46. As a result of the designated remainder the project does not currently have access to any City rights of way however the applicant has submitted a letter stating that access would be provided along Margalo Ave., by the construction of approved Tentative Tract 6473 located west of the site. Staff recommends approval with the amended conditions.
Senior Planner McNamara recommended amending conditions 5 and 7 in the Planning Department conditions.

Commissioner Brown moved to approve Tentative Tract 6533, Mitigated Negative Declaration and the amended Resolution. Seconded by Commissioner Voth. Motion carried with the following vote:
