WASCO PLANNING COMMISSION MEETING
April 11, 2005 – 7:00 P.M.

1.      Chairperson Brown called the regular Planning Commission meeting to order at 7:00 p.m.

2&3.    Chairperson Brown offered the flag salute and invocation.

4.      Present: Chairperson Brown, Commissioners Arredondo, Mitchell, Santillan,  and Voth.  Absent: Commissioner Steward.  Also present were: Planning Director Leonard, Senior Planner McNamara and Secretary  Rodriguez.

6.      HEARING FROM PUBLCI ON ITEMS NOT ON AGENDA – NONE

7.      AGENDA ADDITIONS/DELETIONS - None

8.      CONSENT CALENDAR

a)      Approval of Minutes for March 14, 2005
b)      Approve the Reading of all Resolutions by Title only

Commissioner Voth moved to approve the Consent Calendar as presented.  Seconded by Commissioner Santillan.  All in favor, motion carried.

10.     PUBLIC HEARINGS

Conditional Use Permit 05-02 and Resolution – Applicant requesting a Conditional Use Permit to open a martial arts school in a residential zone at 1145 E Street., APN# 030-391-10.  Applicant: Roque Quezada, 685 Woodside Dr., Wasco, CA 93280

Chairperson Brown opened the public hearing at 7:07 p.m.

Senior Planner McNamara briefly reported on the applicant’s request for a Conditional Use Permit to open a martial arts school in a residential zone.  The applicant is proposing to lease a former dance club at the northwest corner of E and 11th Street.  The area has both residential and commercial uses, therefore staff has determined that the proposed martial arts school will not have an adverse effect on the surrounding properties.  Staff recommends approval with the conditions listed.

Mr. Rigoberto Solorio, 301 Peters St., Wasco, submitted a letter and photo of the conditions of Mr. Quezada’s old martial arts school.  Mr. Solorio has been a resident of Wasco for  30 years.  There seemed to be problems with dirty bathrooms, no tissue and no drinking water available for students.  He was concerned for the safety of the children.  The letter submitted stated that Mr. Quezada was not a good businessman.  Also submitted was a copy of a contract showing that Mr. Quezada had transferred his business (Azteca’s TKD School at 1334 F St) to Mr. Solorio.  Mr. Solorio requested that he not be allowed to operate his business at 1145 E Street, Wasco.

The applicant Mr. Roque Quezada was not present at the meeting.

Chairperson Brown closed the public hearing at 7:15 P.M.

There was some discussion on the area of the proposed school, lighting, parking the operation of a bar close by.

Commissioner Santillan moved to deny the CUP.  Seconded by Commissioner Arredondo.  After a brief discussion, Commissioner Santillan withdrew his motion. Commissioner Arredondo also withdrew her motion.

Chairperson Brown moved to continue Conditional Use Permit 05-03 public hearing to the May regular meeting. Seconded by Commissioner Voth.  All in favor, motion carried.  Staff was referred to research further on hours of operation, prior violations, code enforcement issues, parking, sign, lighting, policing and also inquired how many students will be attending the school.  

The CUP hearing was continued to May 9, 2005.

b) General Plan Amendment 05-01 and Zone Change 05-01, Mitigated Negative Declaration and Resolution – to allow change in the General Plan designation of approximately 3.5 acres of Assessor’s Parcel Number 03-450-07 from Neighborhood Commercial to High Density Residential (R-3) and the zoning from Neighborhood Commercial to R-3 (High Density Residential).  Applicant: C.F.Y. Development, Inc., 1001 Sixth St., Suite 200, Sacramento, CA 95814.

Chairperson Brown opened the public hearing at 7:32 p.m.

Senior Planner McNamara reported on the applicant’s request to amend the Land Use Map of the General Plan and a change to the Official Zoning Map.  The parcel in question is 7 acres in size and has the General Plan designation of Neighborhood Commercial and the Zoning designation of C-N (Neighborhood Commercial).  The proposed General Plan Amendment and zone Change would re-designate approximately 3.5 acres to High Density Residential and re-zone the same 3.5 acres to R-3 (High Density Residential) with the remaining 3.5 acres retaining the Neighborhood Commercial uses.  Based on the change in land uses the maximum allowable units would be eighty four (84).    The General Plan Amendment and Zone Change is the first of three projects for this 7 acre parcel.  The second project will be a Conditional Use Permit to construct an eighty one unit senior housing facility and the last project will be a Parcel Map which will only be processed if the applicant secures funding for the proposed project.  Based on the staff report the planning department recommends approval with the conditions set. Change the General Plan designation of approximately 3.5 acres of the aforementioned parcel from Neighborhood Commercial to High Density Residential and the zoning from Neighborhood Commercial to R-3 (High Density Residential)

Mr. John Cicerone, C.F.Y. Development, Inc., representative spoke briefly on the proposed project.  He stated he was in agreement with the conditions.  Mr. Cicerone distributed a project summary flyer with several developments.
He also requested amending condition #3 including allowing the property owner to request to revert the property designation back to Neighborhood Commercial if necessary.

After a brief discussion, Commissioner Brown closed the public hearing at 7:45 p.m.

Condition #3 was amended to read:

Condition #3 – Failure to commence construction within two years of this action will result in the re-classified and re-zoned 3.5 acres automatically being rezoned to Neighborhood Commercial, unless the property owner requests a General Plan Amendment or Zone Change.

In either case, duly noticed public hearings are required.

Commissioner Voth moved to approve General Plan Amendment 05-01 and Zone Change 05-01 with the Mitigated Negative Declaration and Resolution as amended.  Seconded by Commissioner Santillan.  Motion carried with the following vote:

AYES: Commissioners Brown, Arredondo, Mitchell, Santillan, Voth
NOES: None
ABSENT:  Commissioner Steward

Chairperson Brown read the title of Resolution 05-11.

RESOLUTION 05-11 -  A Resolution of the Planning Commission of the City of Wasco in the Matter of the Application of  C.F.Y. Development for General Plan Amendment 05-01 and Zone Change 05-01.

c)  General Plan Amendment 05-02, Zone Change 05-02, Mitigated Negative Declaration and Resolution – The City of Wasco is proposing to update General Plan Land Use Map and the Zoning Map, the Planning Commission has approved three development projects that are contingent upon several amendments to the maps.  Prior to the recordation of a Final Subdivision Map the land use designations must be consistent with the proposed development.  The affected areas have been divided into three (3) areas and correlate with approved tentative maps.  Area 1 encompasses Tentative Tract 6334, Area 2 encompasses Tentative Tract 6473 and Area 3 encompasses Tentative Tract 6432.  Applicant: City of Wasco, 746 8th Street, Wasco, CA 93280.

Chairperson Brown opened the public hearing at 7:50 p.m.

Senior Planner McNamara reported that the City of Wasco was proposing an update of the General Plan Land Use map and the Zoning map, the Planning Commission has approved three development projects that are contingent upon several amendments to the maps.  Prior to the recordation of a Final Subdivision Map the land use designations must be consistent with the proposed development.  The affected areas have been divided into three (3) areas and correlate with approved tentative maps.  Area 1 encompasses Tentative Tract 6334, Area 2 encompasses Tentative Tract 6473 and Area 3 encompasses Tentative Tract 6432. Hearing no other comments, Chairperson Brown closed the public hearing at 7:55 p.m.

Commissioner Santillan moved to approve General Plan Amendment 05-02 and Zone Change 05-02, Mitigated Negative declaration and Resolution.  Seconded by Commissioner Mitchell.  Motion carried with the following vote:

AYES: Commissioners Brown, Arredondo, Mitchell, Santillan, Voth
NOES: None
ABSENT:  Commissioner Steward
