Wasco Planning Commission Meeting
February 14, 2005 – 7:00 P.M.

1.      A regular Planning Commission meeting was called to order by Chairperson Brown on February 14, 2005 at 7:00 P.M.  

2&3.    Chairperson Brown offered flag Salute and Invocation.

4.      Present: Chairperson Brown, Commissioners Mitchell, Santillan, Steward, and Voth. Commissioner Arredondo arrived at 7:15 P.M. Absent: Commissioner Hunt.

Also present: Acting Planning Director Leonard, Associate Planner McNamara and Secretary Rodriguez.

5.      AWARDS AND PRESENTATIONS – None

6.      HEARING FROM PUBLIC ON ITEMS NOT ON AGENDA - None

7.      AGENDA ADDITIONS/DELETIONS – Revised maps were distributed for Tentative Tract #6460 and Tentative Tract #6473.

8.      CONSENT CALENDAR

a)      Approval of Minutes of January 10, 2005 meeting
b)      Approve the Reading of all Resolutions by title only

Commissioner Voth moved to approve the Consent Calendar as presented.  Seconded by Commissioner Santillan.  All in favor, motion carried.

9.      MINUTE MOTION

a)      Convenience Recycling – business located at 1040 G Street (RV Recycling Center) request for Zoning Ordinance text amendment to modify Table 17-1, to allow for small recycling collection facilities to be located in a C-R (Community Retail) Zone.

Planning Director Leonard reported on the applicant’s request to allow a recycling center closer to the Barker Square Shopping Center. This would require amending Table 17-1 to allow a recycling facility in a C-R (Community Retail) zone.  The amendment would be run concurrently with any other text changes staff was working at the present time.  Planning Commissioners should give staff direction in initiating a text amendment to Table 17-1.

Mr. Jesus Gutierrez, Representing RV Recycling spoke briefly on their request stating this was a State controlled facility, it would be closer to businesses, and it would be color coordinated with the existing shops.

Paul Neufeld, Neufeld Construction, 1040 G Street stated that at the present time a recycling facility was located on his property, and it was kept clean and neat.  The business owner was a responsible party.

Commissioner Voth moved to initiate a text amendment to Table 17-1 of the Zoning Ordinance to allow for small recycling collection facilities to be located in a C-R (Community Retail) Zone.  Seconded by Commissioner Santillan.  All in favor, motion carried.

b)      General Plan Referral 05-02 and Resolution – City of Wasco – Tract 6432- Sale of and possible Abandonment of City Retention Basin – Approximately 2 miles south of Hwy. 46 at the northwest corner of the intersection of Poplar and Filburn Ave.,

Planning Director Leonard reported whereby the applicant was requesting the city to abandon a storm water retention basin located north of Filburn Avenue between Poplar and Palm Avenue.  The property is designated PF (Public Facilities) on the General Plan Land Use Map.  Upon the appraisal and sale of the property, Mr. Mack (the applicant) is proposing to backfill the sump creating buildable lots that would be included in Tentative Tract 6432.  After further research, and communication with City Attorney, it was determined that no appraisal or “sale” need take place – only abandonment of use and return to property owner is required by Govt. Code.  The Commissioners need to make findings of conformity with the General Plan and forward a Resolution to the City Council.  The actual General Plan Amendment and Zone Change must be completed before the Final Map is approved by City Council.

The applicant John Mack, 1141 Highland Way, Grover Beach, California was present at the meeting.

Commissioner Voth moved to approve General Plan Referral 05-02 and making findings of conformity with the General Plan recommended forwarding the approved Resolution to the City Council.  Seconded by Commissioner Steward.  All in favor, motion carried with the following vote:

Secretary Rodriguez read the title of Resolution 05-02.

RESOLUTION 05-02 – A Resolution of the Planning Commission recommending a Finding of Conformity with the General Plan and Zoning Ordinance in regards to the Abandonment of a Temporary Retention Basin, Assessor’s Parcel No. 489-010-19 (GPR 05-02)

10.    PUBLIC HEARINGS – POLICY ITEMS

c)      Tentative Tract 6432, Mitigated Negative Declaration and Resolution- Tentative Map for 39 single family dwellings.  Approximately 2 miles south of Hwy. 46 at the northwest corner of the intersection of Poplar and Filburn Avenue. APN #489-020-03; Applicant Blumer Development 1414 Valhalla Dr., Bakersfield, CA 93309

Planning Director Leonard reported on the proposed 39 lot single-family subdivision to be built on 7.08 acres located at the northwest corner of Filburn and Poplar Avenues.  As a part of this proposal the applicant is requesting that the City of Wasco abandon an existing retention basin (APN #489-010-19) so the basin can be filled and the site developed.  Therefore, as part of the development, an amendment to the General Plan Land Use Map and Zoning Map must be approved by the City Council prior to the final map being approved.

Chairperson Brown opened the public hearing at 7:40 P.M.

John Mack the applicant stated he proposed to build a quality neighborhood.

There was discussion on the retention basin, the project and design.

Chairperson Brown closed the public hearing at 7:45 p.m.

Commissioner Steward moved to approve Tentative Tract 6432, the Mitigated Negative Declaration and the conditions set.  Seconded by Commissioner Santillan.  Motion carried with the following vote:

Secretary Rodriguez read the title of Resolution 05-03

RESOLUTION 05-03 – A Resolution of the Planning Commission of the City of Wasco in the Matter of the Application of John Mack for Tentative Tract 6432

b) Tentative Tract 6449, Mitigated negative Declaration and Resolution – For 105 single-family dwellings.  Approximately one mile south of Hwy. 46 at the southwest corner of Central Avenue and 7th Street.  APN# 488-020-04, 488-020-03; Applicant: Blumer Development, 1414 Valhalla Dr., Bakersfield, CA 93309

Chairperson Brown opened the public hearing at 7:51 p.m.

Associate Planner McNamara reported on the applicant’s request for Tentative Tract 6449 for 105 single family subdivision on two twenty acre parcels.  General Plan designation is Estate Residential and one parcel designation of R-E (Estate Residential) and one parcel is zoned R-1-10 (Low Density Residential 10,000 sq. ft.  All development shall be required to comply with the standards set forth in the General Plan, Zoning Ordinance and Subdivision Ordinance in addition to any conditions required by affected agencies.  Staff recommends approval of Tentative Tract 6449 with conditions.

Steve Blumer of Blumer Construction, the applicant stated he was proposing a nice development with block walls, upscale landscaping, with a gated community look without the gates.  There will be CC&R’s, Architectural Review Committee, different contractors, different elevations, landscaping and concrete rooftops.

Randy Burquist, Porter Robertson requested deleting a section from condition 22  in the Planning conditions, which read:

Remove Lot 5 and provide access point to similarly zoned area to the south.

Mr. Blumer stated there were two accesses to the tract and a crash gate/pedestrian path proposed.  He would build a block wall at the sump.

Chairperson Brown closed the public hearing at 8:15 p.m.

There was a brief discussion on leaving the pedestrian gate closed until more development, because of the liability.

There were two conditions added:

Temporary drainage basins may be allowed as approved by the City Engineer. These basins shall have a block wall on the northern, western and southern sides and shall be landscaped.  The wall and landscaping plans shall be submitted to the Planning Department for approval prior to construction.

The applicant shall be required to construct a ten (10) ft. walkway in the easement located in Lot 1.  This walkway shall remain gated until such time as the park called for in the General Plan is constructed.

There was a brief discussion on the park site designation.
Chairperson Brown requested Secretary Rodriguez to take roll on the vote.

Commissioner Steward moved to approve Tentative Tract 6449 as amended and the Mitigated Negative Declaration. Seconded by Commissioner Mitchell.  Approve as amended voting 4 Ayes; 2 Noes; 1 Absent.  Motion carried.

Chairperson Brown opened the public hearing at 8:41 P.M.

Amended maps were distributed and reviewed.

Associate Planner McNamara reported the applicant is proposing to split Parcel 487-010-15, 487-040-24 and 487-040-25 into 4 new parcels.  Parcel 1 will be 9.91 acres, Parcel 2 will be 8.66 acres, Parcel 3 will be 6.67 acres and Parcel 4 will be 1.46 acres.  This parcel map was filed in unison with Tentative tract 6473; Parcel 4 will not be included in boundary of the accompanying Tentative Tract 6473.  Staff recommends approval of Tentative Parcel Map 11244 with the conditions set.

Mr. Ramsey, the applicant and a representative from DeWalt Engineering were present.

Greg Black, DeWalt Engineer spoke briefly on the project.

APN# 487-040-15, 487-040-24 and 487-040-25; Applicant P.H.R. Developments, P.O. Box 614, Wasco, CA
Chairperson Brown opened the Public Hearing at 8:51 p.m.

Associate Planner briefly reported on Tentative Tract 6473 which would be a 96 lot subdivision with 80 of the 96 lots being designated as single family residential and the remaining 16 lots being designated as multi family residential.  The applicant is requesting a parcel map as part of this project.  The project will be built in 3 phases, which will mirror the proposed parcels created by the parcel map request.  Currently the project site is designated for Low Density Residential, Medium Density Residential and Commercial Retail uses.  As a result of these designations there must be an amendment to the General Plan Land Use Map and Zoning map.  Staff recommends approval of Tentative Tract 6473 with the listed conditions.

Greg Black and Jeff Gutierrez from DeWalt Engineering gave a brief report on the proposed project, requesting changes to conditions before final map review.  There also was discussion on block wall, Master Storm Drain Plan, and Zoning.

Chairperson Brown closed the Public hearing at 9:20 p.m.

It was the consensus of the Commissioners to change the required site plan conditions as requested by the Engineers.

Condition # 6 was amended to incorporate 6 through 22.

Associate Planner McNamara reported on the applicant’s proposed split of APN 487-010-09 into 4 smaller parcels.  Parcel 1 will be 21.60 acres, Parcel 2 will be 18.43 acres, Parcel 3 will be 19.75 acres and Parcel 4 will be 20.27 acres.  This parcel map was filed in unison with Tentative Tract 6460.

Greg Black with DeWalt Engineering was present at the meeting.

Chairperson Brown opened the Public Hearing at 9:28 p.m.

Associate Planner McNamara reported on the proposed Tentative Tract 6460 a 376 lot single-family subdivision on approximately 80 acres.  The land has a General Plan designation of Low density Residential and a Zoning designation of R-1-6 the project s currently under Williamson Act Contract; the applicant has requested that the City Council of the City of Wasco make the necessary findings approving the cancellation of the contract.  This contract must be cancelled prior to final map approval.  Staff recommends approval of Tentative Tract 6460 with the listed conditions.

Greg Black again requested the changes to the conditions and stated he would comply with the block wall for the sump.  Mr. Black stated that instead of 376 there were now 369 homes proposed.

Chairperson Brown closed the public hearing at 9:44 p.m.

These conditions were amended:
