WASCO PLANNING COMMISSION
DECEMBER 13, 2004 – 7:00 P.M.

1.      Chairperson Steward called the regular Planning Commission meeting to order at 7:00 p.m.

2&3.    Flag Salute and Invocation were offered by Chairperson Steward.

4.      Present: Chairperson Steward, Commissioners Arrendondo, Brown, Hunt, Mitchell, Santillan, and Voth.

Also present: Acting Planning Director Leonard, Associate Planner McNamara and Secretary Rodriguez.

8.      CONSENT CALENDAR

a)      Approval of Minutes for November 8, 2004 meeting
b)      Approve the Reading of all Resolution by Title only

Commissioner Hunt made a correction to the minutes as he was not in attendance on November 8, 2004.

Commissioner Brown moved to approve the Consent Calendar as corrected, seconded by Commissioner Santillan.  All in favor, motion carried.

10.     PUBLIC HEARINGS

a)      Conditional Use Permit 04-02 and Resolution – to allow for mini mart at 1224 Hwy. 46, Wasco, CA. Applicant: Harvinder Singh, 8586 Rd., 120, Pixley, CA 93256

Chairperson Steward opened the public hearing at 7:04 p.m.

        Associate Planner McNamara reported that the applicant was proposing to convert an abandoned gas station into a convenience store.  The proposed use is allowed by right in the Commercial Retail Zone but the applicant’s proposal for off-site beer and wine sales requires a Conditional Use Permit.  Staff recommends approval with the conditions set.

Commissioner Arrendondo withdraw herself,  because she lived within the area of the project proposed.

Roy Shala, owner of Towne and Country Liquors located at 1209 Hwy. 46, voiced his concerns about another beer and wine sales in such close proximity to several others.  There was saturation already.

Associated Planner McNamara reported that CalTrans had made recommendations to remove several driveways into the project.

Chairperson Steward closed the public hearing at 7:10 p.m.

Commissioner Brown stated because of the Zoning Ordinance Chapter 17.29 Paragraph B.  He could not support the project.  Commissioner Voth stated an open business would be better than a vacant building.

Planning Director Leonard stated that a petition had been submitted against allowing another alcohol sales facility.

Commissioner Brown moved to deny CUP 04-02 pertaining to the sales of alcohol.  Seconded by Commissioner Mitchell.

Reason was that the project was within 100 feet of a residence, 1000 feet from a school which is Thomas Jefferson School and because of the current City Ordinance rules.
Motion carried with the following vote:
AYES:  Commissioners Steward, Brown, Hunt, Mitchell,
NOES:  Commissioners Santillan, Voth
ABSTAIN:  Commissioner Arrendondo

Staff will draft a resolution of denial with the findings of fact for Conditional Use Permit 04-02.  The resolution will return in January.

b)  Parcel Map Waiver #11226 and Resolution – Central and Beckes off Hwy. 46, Wasco, CA 93280.  Applicant: LARS Anderson, 4630 Jacquelyn Ave., Ste. 119, Fresno, CA 93722.

Chairperson Steward opened the public hearing at 7:20 p.m.

Commissioner Voth removed herself as she owned property in the project area.

Associate Planner McNamara reported on the applicant’s proposal regarding Parcel Map 11226 to divide one 18.79 acre parcel into three parcels.  Parcel 1 is to be 3.80 acres, Parcel 2 is to be 4.34 acres and Parcel 3 is to be 10.65 acres.  The applicant previously applied for an amendment to the City of Wasco’s General Plan Land Use map and the City of Wasco’s Zoning map (GPA 03-01/ZC 03-01).   The purpose of the amendment was to split zone the parcel with approximately 8.14 acres being assigned a zoning designation of R-2 (Medium Density Residential) and the remaining acreage to be zoned R-1-6 (Low Density Residential 6,000 sq. ft.).  The Planning Commission approved the applicant’s request at their meeting on September 16, 2003.  Upon receiving the Planning Commission’s approval the applicant submitted Tentative tract 6282 on the 10.65 acres that was zoned for single family dwellings.  The Planning Commission approved the request on February 12, 2004.  Staff recommends approval of  Parcel Map Waiver #11226 with the conditions set.

Present at the meeting were the applicants the Potts, and Steve Gair their agent.  There was a brief discussion on the lots, senior housing, and residential housing.

Hearing no other comments Chairperson Steward closed the public hearing at 7:27 p.m.

Commissioner Brown moved to approve Parcel Map Waiver #11226 and the resolution.
Seconded by Commissioner Hunt.  Motion carried with the following vote:
AYES:  Commissioners Steward, Arrendondo, Brown, Hunt, Mitchell, Santillan
NOES: None
ABSTAIN:  Commissioner Voth (conflict)

Secretary Rodriguez read the title of Resolution 04-16.

RESOLUTION 04-16 – A Resolution of the Planning Commission of the City of Wasco in the Matter of the Application of Anacapa Development for Parcel Map 11226.
