Wasco Planning Commission Meeting
May 10, 2004 – 7:00 P.M.

1.      Chairperson Steward called the regular Planning Commission meeting to order.

2&3.    Chairperson Steward offered flag salute and Invocation

4.      Present: Commissioners Steward, Brown, Mitchell, Santillan, Voth
Commissioner Hunt entered at 7:15 p.m.

Also present: Acting Planning Director Leonard, Associate Planner McNamara and Secretary Rodriguez.

5.      AWARDS AND PRESENTATIONS – None

6.      HEARING FROM PUBLIC ON ITEMS NOT ON AGENDA – NONE

8.      CONSENT CALENDAR

a) Approval of Minutes for April 12, 2004 meeting.
b) Approve the Reading of all Resolutions by Title only

Commissioner Brown moved to approve the consent calendar as presented seconded by Commissioner Mitchell.  All in favor, motion carried.

9.      MINUTE MOTION

a)      Amendment to the City of Wasco Municipal Code, Title 8, Chapter 8.32.010 regarding noise caused by construction activities.

Associate Planner McNamara reported on having received citizen complaints regarding the impact of noise generated by new construction activities.  Staff recommends that the Planning Commission, recommend to the City Council that a change to the Municipal Code be approved; Adding to Title 8, Chapter 8.32, Section 8.32.010 – Unlawful Acts of the City of Wasco Municipal Code.

Furthermore, any construction activity, located within 300 feet of residential development shall be limited to the hours between 7:00 a.m. and 7:00 p.m. on weekdays and 9:00 a.m. to 6:00 p.m. on Saturday and Sunday.

There were comments on the time limit especially concerns were voiced on concrete pouring, roofers, policing and how many complaints had been submitted.

There was discussion on the community changing with new homes and growth.

Commissioner Hunt entered the meeting at 7:15 p.m.

There was a consensus of the commissioners to refer back to staff for further research.

10.     PUBLIC HEARINGS – NON POLICY ITEMS

a)      Amendment to the Wasco Zoning Ordinance, Categorical Exception and Resolution

a)      Amending Table 17-3, regarding mineral extraction and oil drilling in residential areas.

Chairperson Steward opened the public hearing at 7:18 p.m.

Associate Planner McNamara reported on the proposed amendment to the Zoning Ordinance Table 17-3.  The Zoning Ordinance currently allows “mining and mineral extraction” in certain residentially zoned properties in the city with a Conditional Use Permit.  The Planning Department has heard concerns from current property owners and potential property owners regarding this issue.  Some concerns are aesthetics, financial (which would decrease the value of homes and lots) and safety (blowouts).  The change in the ordinance would not prevent future drilling or mining in other designated zones and would not prevent slant drilling provided that the applicant obtains a Conditional Use Permit.  Staff recommends that mineral extraction not be allowed within any residentially zoned area in Wasco and that Table 17-3 of the Zoning Ordinance be amended.

There was a brief discussion on drilling in residential areas, and near schools.

Hearing no further comments Chairperson Steward closed the public hearing at 7:29 p.m.

Commissioner Voth moved for Amending Table 17-3 of the Wasco Zoning Ordinance, regarding mineral extraction and oil drilling in residential areas and the Resolution.  Seconded by Commissioner Santillan.  All in favor, motion carried with the following vote:

AYES: Commissioners Steward, Brown, Hunt, Mitchell, Santillan, Voth

b)      Amending Section 16019 (N) Residential Architectural Design Criteria in regards to residential fencing: (Categorical Exemption) Applicant City of Wasco, 764 E Street, Wasco, CA

Chairperson Steward opened the public hearing at 7:30 p.m.

Acting Planning Director Leonard reported on the wood fencing issue.  Staff recommends that the commission adopt and recommend to the City Council a fence construction detail as provided in the staff report.  Once these details are redrawn, they should be included in the Subdivision Ordinance.  Staff will provide fencing details to persons obtaining site plans for fences.

Brief discussion on treated wood.  With no further comments Chairperson Steward closed the public hearing at 7:34 p.m.

Commissioner Brown moved to approve the fence recommendation revising the 2004 Zoning Ordinance regarding wood fencing and Resolution.  Seconded by Commissioner Hunt.  Motion carried with the following vote:

AYES: Commissioners Steward, Brown, Hunt, Mitchell, Santillan, Voth

Secretary Rodriguez read the title of Resolution 04-11

Resolution 04-11 – A Resolution of the Planning Commission of the City of Wasco in the Matter of the 2004 Zoning Ordinance revision regarding amending Table Chapter 17-19 (N) Residential design criteria regarding wood fencing and Title 16 of the Wasco Municipal Code Section (Subdivision Ordinance).

c)      Vesting Tentative Tract 6334, Negative Declaration and Resolution of the Wasco Planning Commission for Tentative Tract 6334 for one hundred and forty eight (148) single family dwellings located approximately one half mile northwest of the intersection of Palm Avenue and Hwy. 46 in the City of Wasco.  APN 487-010-41 and 487-010-27; Applicant: Central Valley Home Development, LLC, 7911 Herschel Ave., La Jolla, CA 92037.

Chairperson Steward opened the public hearing at 7:36 p.m.

Associate Planner McNamara distributed revised maps that had been submitted by the applicant stating that four lots, 143 thru 147, the square footage had been changed.  The applicant is now proposing to build detached single-family dwellings on 144 lots and dedicate the four remaining lots for an on-site storm water retention basin.  The applicant is proposing to preserve some of the existing walnut trees that are currently located on the project site.  The trees are located in the parkway along Palm Avenue and the rear yards of the lots that abut the southern and western edges of the tract.  Staff recommends approval of Vesting Tentative Tract 6334 with the conditions listed.

There was discussion of the on-site retention basin, infrastructure, walls, fences, parking and the ½ street design of  Margalo Street.

Commissioner Hunt announced that he would abstain from voting, as one of the applicants was a client of his.

Acting Planning Director Leonard suggested several amendments to some of the conditions proposed.

PLANNING DEPARTMENT conditions amended:

2) The Developer shall place the entire subdivision, including the existing walnut trees to be preserved and protected in the rear yard areas, within a Landscape and Lighting Maintenance District, prior to the acceptance of Phase 1 improvements by the City.  The developer shall be required to maintain all landscaping, including the replacement of any trees or shrubs  that do not survive, within the public right-of-way and landscape easements for a period of six months after final inspection of the landscape improvements.  The developer shall be fully responsible for the formation of the Landscape and Lighting Maintenance District, as directed by the City Engineer.  The developer shall be fully responsible for paying the cost of the water for all landscaping and electricity for the street lights until such time as the maintenance district is formed.

8) A detailed elevation of the sound walls and landscaping located on Palm Avenue and Margalo Avenue shall be submitted to the Planning Department for review and approval, along with perimeter walnut trees located in the city right of way.

PUBLIC WORKS conditions amended:

2) Prior to review of any improvement plans, a drainage study, performed by a registered civil engineer, and a grading plan including a maintenance road into the drainage basin shall be submitted to and approved by the City Engineer.  The drainage study shall include the ability of the existing storm water drainage basin facility to accommodate new development.  Additionally, the study must demonstrate the ability of any off-site street carrying the development’s storm water.  Storm drainage protection and disposal of water into and from the Tract shall be by a method approved by the City Engineer.

3) Eliminate Condition 3-which read: Developer shall be fully responsible for any necessary expansion and/or upgrade of the existing storm water drainage basin facility.

9)      The following Street improvement widths shall be used for the development:
 ?  32’ Flowline:      All Local Cul-de-sacs
 ? 36’ Flowlines:      Minor Collector/Local
 
?  Developer shall provide a performance bond with the City for the construction of the landscaped median required along Palm Avenue and Margalo St. and tree pruning for the existing walnut trees.

17)  Sidewalks and parkways shall be constructed in accordance with the City’s subdivision standards.  The parkway design on Palm and Margalo Avenues to be returned to the Planning Commission for review and comment.

23)  No final inspections shall be approved for any lot until all required improvements have been completed by the developer and accepted by the City with the exception of model homes, not to exceed 5 in number.

With no further discussion Commission Brown moved to approve Vesting Tentative Tract 6334 as amended, Negative Declaration and Resolution.  Seconded by Commissioner Santillan.  Motion carried with the following vote:

AYES:   Commissioners Steward, Brown, Mitchell, Santillan, Voth
NOES:    NONE
ABSTAIN:  Commissioner Hunt
