1. Vice Chairperson Brown called the meeting to order at 7:00 P.M.
2 & 3. Flag salute and Invocation were offered by Vice Chairperson Brown.
4. Present: Vice Chairperson Brown, Commissioners Hunt, Mitchell, Santillan, Voth.
Absent: Chairman Steward.
Also present: Acting Planning Director Leonard, Associate Planner McNamara, Attorney Peake and Secretary Rodriguez.

Associate Planner McNamara welcomed the two new Commissioners Charles Santillan and Steve Hunt.

a) General Plan Amendment and Resolution – An Amendment to Chapter 16.26 of the Wasco Municipal Code Related to Tentative Tracts – City of Wasco, 764 E Street, Wasco, CA 93280
Vice Chair Brown opened the public hearing at 7:04 p.m.
Associate Planner McNamara gave a brief report on the proposed amendment to the Chapter 16.26 for Tentative Tracts. The title of Section 16.29.030 will be changed to read: 16.26.030 Consistency with the General Plan and Zoning Ordinance from 16.26.030 Consistency with Zoning and General Plan. Staff recommends that the Planning Commission forward a recommendation of
approval to the City Council for their approval.
Hearing no further comments Vice Chair Brown closed the public hearing at 7:11 p.m.
Commissioner Voth moved to approve the General Plan Amendment and Resolution; An Amendment to Chapter 16.26 of the Wasco Municipal Code Related to Tentative Tracts. Seconded by Commissioner Mitchell. Motion carried with the following vote:

Vice Chair Brown read the title of Resolution 04-04 - Resolution of the Planning Commission of the City of Wasco in the matter of Amending Chapter 16.26 of the City of Wasco Municipal Code.
b) General Plan Amendment 04-01 and Resolution – Generally South of 7th Street, between Central Avenue and Strawberry Drive in the City of Wasco, CA. APN 488-020-02 consisting of approximately 22.24 acres a portion of Tentative Tract 6315. Applicant: Interstate Land Co., 7112 Palm Tree Circle, Bakersfield, CA 93308
Vice Chair Brown opened the public hearing at 7:12 p.m.
Acting Planning Director Leonard briefly reported on the requested changes to the General Plan, which will provide consistency between the maps and plan. The applicant is requesting a General Plan Amendment for the property directly south of John L. Pruitt Elementary School. The property is designated Open Space in the General Plan and the applicant wants to change it to Low Density Residential thus eliminating a portion of a park that is called out on the Land Use Map of the General Plan. Staff recommends approval as amended and referral to the City Council.
There was discussion on drainage basins, street extensions and fencing, police tax, storm drainage, housing and lot size, sewers, parkland and half streets, particularly near the school.
Hearing no other comments, Vice Chair closed the public hearing at 7:40 p.m.

Vice Chair Brown read the title of Resolution 04-05 – Resolution of the Planning Commission of the City of Wasco in the Matter of the Application of Interstate Land Company for a General Plan Amendment 04-01.
c) Zone Change 04-01 and Resolution – Generally South of 7th St., between Central Ave., and Strawberry Dr., in the City of Wasco, Ca APN: 488-020-02, approximately 22.24 acres. A portion of Tentative Tract 6315. Applicant: Interstate Land Co., 7112 Palm Tree Circle, Bakersfield, CA 93308
Vice Chairperson Brown opened the public hearing at 7:42 P.M.
Associate Planner McNamara reported that the applicant was requesting a Zone Change for the property directly south of John L. Pruitt Elementary School. At the present time the zoning is Recreational Forest-Open Space and the applicant is proposing to change the zoning to Low Density Residential, 8,000 square foot lots (R-1-8) which would be consistent with the proposed General Plan Amendment 04-01. Staff recommends approval with the conditions listed.
The applicant, Dr. Michael Hair, representing Interstate Land Co., 7112 Palm Tree Circle, Bakersfield, CA was in agreement with the conditions.
There was discussion regarding the proposed sump, traffic, half streets, zoning, curb and gutters, and landscape lighting district for the proposed drainage basin.
Randy Berquist of Porter Robertson Engineering reported on the location of the sump for better drainage.
The applicant Dr. Michael Hair stated that these lots will be larger lots and now that he is proposing only 70 lots instead of 81 lots. They will be zoned R-1-8.
Hearing no other comments. Vice Chair Brown closed the public hearing at 7:58 P.M.

Vice Chair Brown read the title of Resolution 04-06. Resolution of the Planning Commission of the City of Wasco in the Matter of the Application of Interstate Land Company for a Zone Change 04-01.
d) General Plan Amendment 04-03 and Resolution, suggest Amending the General Plan Map, Circulation Element and interim policy language. Generally all territory west of Central Ave., south of Hwy. 46.
Acting Planning Director briefly reported on this proposed amendment, no action was taken. To be advertised for the next regular meeting.
e) Tentative Tract 6315, Mitigated Negative Declaration and Resolution of the Wasco Planning Commission for Tentative tract 6315 for eighty-one (81) single family dwellings located at the south side of 7th St., between Central Ave., and Strawberry dr., in the City of Wasco. APN: 488-020-02; Applicant: Interstate Land Co., 7112 Palm Tree Circle, Bakersfield, CA 93308

Associate Planner McNamara reported on the applicant’s request for Tentative Tract 6315. The applicant had proposed 81 lots and now is proposing 70 as per Dr. Hair of Interstate Land Co. The land is designated Low Density Residential and Zoning is designated R-1-8 (Low Density Residential 8,000 sq. ft.) All development shall be required to comply with the standards set forth in the recently updated 2002 General Plan, Zoning Ordinance and Subdivision Ordinance in addition to any conditions required. Staff recommends approval with the conditions as amended.
Dr. Michael Hair, representing Interstate Land Co., 7112 Palm Tree Circle, Bakersfield, California voiced his concern on several of the conditions. Discussion was on resource extractions and drilling, fencing, special tax, storm drainage, housing and lot sizes, sewers, parkland and half streets.
Ms. Rose Navarro, 433 Woodside voiced her concerns with the widening of Central Ave. and the additional traffic it will create.
Luis Normandi, 416 Woodside was concerned with the type of homes and zoning proposed.
These conditions were amended and added:
Condition 2) The developer shall place the entire subdivision within a Landscape Lighting and Maintenance District, prior to the acceptance of Phase 1 of the improvements by the City. The developer shall be required to maintain all landscaping, including the replacement of any trees or shrubs that do not survive, within the public right of way and landscape easements for a period of six months after final inspection of the landscape improvements. The developer shall be fully responsible for the formation of the Landscape, Lighting and Maintenance District, as directed by the City Engineer. The developer shall be fully responsible for paying the cost of the water for all landscaping and electricity for the streetlights until such time as the maintenance district is formed. At the
discretion, of the City Engineer the sump may be included into the Landscape, Lighting and Maintenance District.
Condition 4) The developer shall submit for review and approval a preliminary landscape and irrigation plan to the Planning Department prior to the submission of any improvements to the project. These plans shall include a wall elevation, tree names and locations. A more detailed plan shall be submitted at the time of the Final Map.
Condition 5) Submit a design section for the wood fencing detail on the north and west showing treated lumber when in contact with the ground or some other design standard to prevent fence failure.
Condition 14) Residential mechanical equipment shall be placed on the ground and screened from public view on the lots that back to an arterial or collector street.
Condition 15) The second story of a two story residence shall be offset to the rear of the first floor.
Condition 39) If allowed, mineral extraction shall require a Conditional Use Permit.
Commissioner Voth moved to approve Tentative Tract 6315, Mitigated Negative Declaration and Resolution as amended. Seconded by Commissioner Santillan.
Motion carried with the following vote:

Vice Chair Brown read the title of Resolution 04-07 – Resolution of the planning Commission of the City of Wasco in the matter of the Application of Interstate Land Company for Tentative Tract 6315.
f) Tentative Tract 6316, Mitigated Negative Declaration and Resolution of the Wasco Planning Commission for Tentative Tract 6316 for one hundred and seventy six (176) single family dwellings at the nw corner of 7th Street and central Ave., in the City of Wasco. APN: 488-020-06, 488-020-07 and 488-020-08 Applicant: Interstate Land Co.,7112 Palm Tree Circle, Bakersfield, CA 93308
Vice Chair Brown opened the public hearing at 9:03 P.M.
Associate Planner McNamara reported the applicant had submitted Tentative Tract 6316 with 176 lots for single family subdivision on 40 acres. The General Plan designation is Low Density Residential and Zoning designation is R-1-6 (Low Density Residential All development shall be required to comply with the standards set forth in the General Plan, Zoning Ordinance and Subdivision Ordinance in addition to any conditions set. Staff recommends approval of Tentative Tract 6316 with the conditions set.
Dr. Michael Hair, the applicant again voiced the same concerns on some of the conditions as he did on Tentative Tract 6315. There was discussion on the entrances to tract, treated fences, police tax, residential 2 story homes, mineral rights, street design, and adjacent properties.
Tim Holtermann, 942 Oak St., Wasco representing Hubert Holtermann and himself voiced his concern regarding fencing next to his farming property. Requested a fence be constructed with no outlets towards his property. (with west side)
Randy Berquist, stated that cul-de-sac would be placed on the right-of-ways to tie in for future development.
Peter Navarro 433 Woodside inquired about the sizes of the lots proposed.
Luis Normandi, 416 Woodside his concerns were with traffic, vandalism and Central Avenue being used as for racing.
These conditions were amended and added:

g) Tentative Tract 6308, (Previously subdivided) Mitigated Negative Declaration and Resolution of the Wasco Planning Commission for Tentative Tract 6308 for ninety eight (98) single-family dwellings located at the nw corner of Filburn and Griffith Ave., in the City of Wasco. APN: 489-010-16. Applicant: CenCal Construction 4044 Burr St., Bakersfield, CA 93308

Associate Planner McNamara briefly reported on the applicant’s request for a Tentative Tract 6308 with 98 single-family subdivision on 20 acres. The property General Plan designation of Low Density Residential and Zoning designation is R-1-6 (Low Density Residential 6,000 sq. ft.) The Planning Commission approved this project in 1998 as Tentative Tract 5888, which expired on February 9, 2003. The previous applicant applied for a Density Bonus on the tract due to the dedication of a belt park on Filburn Avenue. This request lots 56, 59 and 77 through 98 are slightly less than the required 6,0000 sq. ft. The applicant shall be required to work closely with the City Engineer due to improvements in place. Tentative Tract 6308 will substantially comply with all applicable Elements of
the General Plan. All development shall be required to comply with the standards set forth in the recently adopted (2002) General Plan, Zoning Ordinance and Subdivision Ordinance in addition to any conditions required by effected agencies. Staff recommends approval of Tentative Tract 6308 with the conditions set.
Mr. Patrick Padilla representing CenCal Construction Co, 4044 Burr St., Bakersfield, CA. stated they were still working on some issues as sewer lines, street improvements, and compaction. They were meeting with the City Engineer. They were in agreement with the conditions set. There was a brief discussion on the fencing in the area.
Hearing no other comments, Vice Chair Brown closed the public hearing at 9:59 p.m.
Commissioner Santillan moved to approve Tentative Tract 6308, Mitigated Negative Declaration and Resolution. Seconded by Commissioner Hunt. All in favor, motion carried with the following vote:
