1)      CALL TO ORDER Mayor Espitia called the meeting to order at 7:00p.m.

2)      FLAG SALUTE  Mayor Espitia led the flag salute

3)      INVOCATION:  Danny Arellano of Primera Iglesia Bautista offered the invocation.

7)      CONSENT CALENDAR:       
a)      Approval of Minutes from the regular meeting on May 18, 2010.

b)      Approval of Bill Paying List, total amount of $847,555.98

c)      Possible Approval and Acceptance, RE:  Acceptance of off-site improvements, authorization to start the required 12-month warranty period and authorize staff to reduce performance security bond to 10% of the existing bond on Griffith Avenue off-site improvements adjacent to the DSJB III, LLC property (Fresh & Easy).

d)      Report and Possible Approval, RE:  Awarding of the Prop 1B Various Roads Reconstruction Project.

e)      Report and Possible Approval, RE:  10-2712 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO DECLARING ITS INTENTION TO REVIEW THE IMPROVEMENTS AND ASSESSMENTS FOR WASCO MAINTENANCE DISTRICT NO. 1, WASCO LANDSCAPE AND LIGHTING MAINTENANCE DISTRICTS NO. 01-01, NO. 01-02 AND NO. 06-1 FOR TAX YEAR 2010-11 AND AUTHORIZING THE CITY CLERK TO PUBLISH THE RESOLUTION SETTING THE PUBLIC HEARING.

f)      Report and Possible Approval, RE: 10-2713 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO CONFIRMING THE ASSESSMENT FOR THE LEVY AND COLLECTION OF ASSESSMENTS WITHIN SPECIAL TAX AREA ZONE 2005-1 WITHIN THE WASCO SPECIAL POLICE TAX AREA FOR SUBDIVISION FOR FISCAL YEAR 2010-11.

g)      Report and Possible Approval, RE: 10-2714 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO CONFIRMING THE ASSESSMENT FOR THE LEVY AND COLLECTION OF ASSESSMENTS WITHIN SPECIAL TAX AREA ZONE 2006-1 WITHIN THE WASCO SPECIAL POLICE TAX AREA FOR SUBDIVISION FOR FISCAL YEAR 2010-11.  

h)      Report and Possible Approval, RE: 10-2715  A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO CONFIRMING THE ASSESSMENT FOR THE LEVY AND COLLECTION OF ASSESSMENTS WITHIN SPECIAL TAX AREA ZONE 2006-2 WITHIN THE WASCO SPECIAL POLICE TAX AREA FOR SUBDIVISION FOR FISCAL YEAR 2010-11.  

i)      Report and Possible Approval, RE: 10-2716 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO CONFIRMING THE ASSESSMENT FOR THE LEVY AND COLLECTION OF ASSESSMENTS WITHIN SPECIAL TAX AREA ZONE 2006-3 WITHIN THE WASCO SPECIAL POLICE TAX AREA FOR SUBDIVISION FOR FISCAL YEAR 2010-11.

j)      Report and Possible Approval, RE: 10-2717 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO CONFIRMING THE ASSESSMENT FOR THE LEVY AND COLLECTION OF ASSESSMENTS WITHIN SEWER LIFT STATION DISTRICT 2008-01 FOR FISCAL YEAR 2010-11.

k)      Acknowledge Receipt of Correspondence.

l)      Approve the Reading of All Ordinances and Resolutions by Title Only and  
      Approve Publication of All Ordinances in Summary Form.


Without discussion, Member Cortez made a motion to approve the consent calendar, 2nd by Member Hively.  Motion carried with the following vote:

8)      Report, Public Hearing and Possible Approval, RE:  10-2718 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO ADOPTING THE ANNUAL OPERATING BUDGET FOR THE CITY OF WASCO FOR FISCAL YEAR 2010-11. (Zervis)

Mayor Espitia opened the public hearing.

City Manager Zervis reported that the budget before the council was balanced and prepared in the framework of the three budget workshops with the council over the last four months.

        Mayor Espitia inquired if the Council wanted to see the prepared PowerPoint presentation.

        Members agreed that the prepared budget had been heard.
Mayor Espitia asked for questions or comments from those in attendance.  Hearing none closed the public hearing at 7:07p.m.

Without discussion, Member Cortez made a motion to approve, 2nd by Member Hively.  Motion carried with the following vote:

        AYES:        Espitia, Cortez, Hively, Wegman, West
        NOES:        None
        ABSTAIN: None
        ABSENT:   None

9)      Report and Possible Approval, RE: 10-2719 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING AMENDMENT NUMBER 2 TO A CONTRACT WITH THE KERN COUNTY SHERIFF'S DEPARTMENT TO PROVIDE LAW ENFORCEMENT SERVICES WITHIN THE CITY OF WASCO. (Zervis)

City Manager Zervis gave staff report explaining the 90 day extending the expiration date of the current contract with the Kern County Sheriffs Department.  HE also stated that the contract would terminate upon the adoption of the new contract if adopted before the 90 days were met.  

Member Hively made a motion to approve, 2nd by Member Cortez.  Motion carried with the following vote:

        AYES:        Espitia, Cortez, Hively, Wegman, West
        NOES:        None
        ABSTAIN: None
        ABSENT:   None

10)     Report and Possible Approval, RE:  A Contract with the Kern County Sheriff regarding participation in the County Work Release Program. (Allen)

Assistant City Manager Allen gave the staff report explaining that this contract is revisited every two years and recommended approval.

Mayor Espitia conferred with counsel regarding a possible conflict of interest.  Attorney Schroeter responded that Mayor Espitia could vote if he chose to.  

Member Cortez made a motion to approve contract subject to approval of City Attorney as to form and content, 2nd by Member Hively.  Motion carried with a 5-0-0 vote.

11)     Report and Possible Approval, RE:  Vehicle and Equipment to be removed from the City's Capital Inventory and sent to Auction. (Allen)
Assistant City Manager Allen gave a staff report and presented a list of items to be auctioned in a sealed bid process.

There was brief discussion regarding location and time of event.

Attorney Schroeter asked about waivers and liability release.  Staff confirmed that there is a waiver and liability release established.

Member Hively made a motion to approve, 2nd by Member Cortez.  Motion carried with 5-0-0 vote.

12)     REPORTS FROM CITY STAFF
Sgt Craig gave a recent activity report

13)     REPORTS FROM CITY ATTORNEY none

14)     REPORTS FROM CITY MANAGER
Commended Sheriffs Department on the recent Bike Patrol
He spoke of the High Speed Rail meeting in Sacramento on Thursday that he would be attending, and of his vacation plans for the following week.
        
15)     REPORTS FROM CITY COUNCIL
Hively heard regarding the High Speed Rail heavy maintenance facility and the front runner seemingly being Fresno and Wasco's need to be competitive.

Member Cortez made a motion to adjourn to the RDA agenda, 2nd by Member Hively.  Motion carried.
Mayor Espitia reconvened regular meeting and adjourned to closed session at 7:30 p.m.

16)     CLOSED SESSION:

a)      Approval of close session minutes from the May 18 & May 25, 2010 meetings.

b)      Government Code Section 54956.9(a): Pending Litigation.

c)   Conference with Labor Negotiators:

Mayor Espitia reconvened regular open meeting at 8:02p.m.

Attorney Schroeter reported that on motion of Member West and Wegman the minutes were unanimously approved.
No other reportable action taken.

17)     ADJOURNMENT Mayor Espitia adjourned the meeting at 8:02 p.m.
