1)      CALL TO ORDER Mayor Espitia called the meeting to order at 7:00p.m.

2)      FLAG SALUTE

3)      INVOCATION:  Scott Allred of First United Methodist offered the invocation.

4)      ROLL CALL
Present: Mayor Espitia, Members: Hively, Wegman
Absent: Cortez and West
Also Present: City Manager Zervis, City Clerk Hight, Executive Assistant Rodriguez, Public Works Director Allen, Sgt Craig

5)      PRESENTATIONS AND AWARDS:  

a)      Commendation presented to Deputy Barron for his dedication to the Wasco SAL Program.

b)      Commendation presented to El Patio Mexican Grill.

Member Hively presented the commendation to El Patio Mexican Grill.   
        Member Cortez arrived at 7:05 p.m.

        Member Cortez presented the commendation to Deputy Barron.

6)      COMMUNICATIONS FROM THE AUDIENCE:

Bob Reeves 2325 Sunset St. asked about repaving of Beckes and Redwood and about cars parking in the gutter area and related code violations.


7)      CONSENT CALENDAR:
       
a)      Approval of Minutes from the following meetings:
-       Regular Meeting on April 20, 2010
-       Regular Meeting on May 4, 2010
-       Budget Workshop on May 5, 2010

b)      Approval of Bill Paying List, total amount of $1,152,015.73

c)      Acceptance of Sheriff's Activity Report for the Month of April 2010.

d)      Acceptance of Code Enforcement Report for the Month of April 2010.

e)      Acceptance of Animal Control Report for the Month of April 2010.

f)      Acceptance of Monthly Building Permit Report for April 2010.

g)      Acceptance of Investment Policy and Compliance Report for the Month of April 2010.

Member Cortez made a motion to approve, 2nd by Member Hively, all in favor motion carried with the following vote:

8)      Acceptance of Monthly Financial Report Related to Status of Quimby Fee Account.

City Manager Zervis gave the staff report.  No action taken.

9)      Continued Public Hearing for Consideration of an Ordinance, RE: 10-607 EXTENSION OF INTERIM ORDINANCE NO. 2010-606 OF THE CITY COUNCIL OF THE CITY OF WASCO ADOPTED PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 65858 PROHIBITING MEDICAL MARIJUANA DISPENSARIES UNTIL COMPLETION OF A ZONING ORDINANCE REGULATING THE LOCATION AND CONDITIONS FOR OPERATION OF SAME.

Mayor Espitia opened the public hearing.
City Manager gave staff report and recommended approval.
Mayor Espitia asked for comments or questions, hearing none closed the public hearing at 7:13 p.m.
Member Hively made a motion to approve, 2nd by Member Cortez.  Motion carried with the following vote:

10)     Public Hearing, Second Reading and Possible Adoption of an Ordinance, RE: 10-608 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING CHAPTER 13.06 (SANITATION IMPACT FEE), CHAPTER 13.10 (WATER SYSTEM IMPACT FEE), CHAPTER 13.12 (SEWERS), AND CHAPTER 13.16 (SEWER CONNECTION CHARGES) OF THE CITY OF WASCO MUNICIPAL CODE, AS REFLECTED IN EXHIBIT A (MUNICIPAL CODE TEXT AMENDMENT 10-02). City Manager gave staff report and recommended approval.
Mayor Espitia asked for comments or questions, hearing none closed the public hearing at 7:15 p.m.
Member Wegman made a motion to approve, 2nd by Member Cortez.  Motion carried with the following vote:

11)     Report and Possible Approval, RE: 10-2708  A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING DEFERRAL OF THE SANITATION IMPACT FEE, WATER SYSTEM IMPACT FEE, SEWER CONNECTION CHARGES, AND TRAFFIC IMPACT FEE FOR NONRESIDENTIAL DEVELOPMENT.

City Manager gave staff report stating the relationship to the previous ordinance and recommended approval.
Member Hively made a motion to approve, 2nd by Member Cortez.  Motion carried with the following vote:

        AYES:        Espitia, Cortez, Hively, Wegman    
        NOES:        None
        ABSTAIN: None
        ABSENT:   West
        City Clerk read the resolution title.

12)     Report and Possible Approval, RE: 10-2709 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO WHICH PROMOTES SAFE DRIVING ACROSS CALIFORNIA AND HEREBY JOINS AT&T IN ITS EFFORT TO EDUCATE THE GENERAL PUBLIC ABOUT THE DANGER OF TEXTING WHILE DRIVING.  (Council Member Wegman)
Councilmember Wegman presented the resolution and recommended the approval for the safety and education of our community.
Member Wegman made a motion to approve, 2nd by Member Hively.  Motion carried with the following vote:

        AYES:        Espitia, Cortez, Hively, Wegman    
        NOES:        None
        ABSTAIN: None
        ABSENT:   West

13)     Report and Possible Approval, RE:  10-2710 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING KERN COUNCIL OF GOVERNMENTS TRANSPORTATION DEVELOPMENT ACT PUBLIC TRANSIT CLAIM FOR FISCAL YEAR 2010 - 2011.  

City Manager gave staff report and recommended approval.
Mayor Espitia asked for comments or questions.  There were none.
Member Cortez made a motion to approve, 2nd by Member Hively.  Motion carried with the following vote:

        AYES:        Espitia, Cortez, Hively, Wegman    
        NOES:        None
        ABSTAIN: None

14)     Report and Possible Approval, RE:  10-2711 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO, CALIFORNIA, APPROVING AND ADOPTING THE ANNUAL APPROPRIATION LIMIT FOR THE FISCAL YEAR JUNE 30, 2011. (Zervis)

City Manager gave staff report, explained the requirements of adopting a spending limit for the city ending June of 2011 and recommended approval.
Mayor Espitia asked for comments or questions.  There were none.
Member Cortez made a motion to approve, 2nd by Member Hively.  Motion carried with the following vote:

        AYES:        Espitia, Cortez, Hively, Wegman    
        NOES:        None
        ABSTAIN: None
        ABSENT:   West

15)     Report and Possible Approval, RE:  Assistant City Manager Position Description and Approval of Employee Contract for Assistant City Manager. (Zervis)

City Manager Zervis gave the staff report covering the position description and contract.  
Mayor Espitia asked for comments.  There were none.
 Member Cortez made a motion to approve, 2nd by Member Hively.  Motion carried with a 4/0/1 vote.  Member West absent.

16)     REPORTS FROM CITY STAFF
Rodriguez reminded council of budget hearing workshop on Tuesday at 4:00p.m. and the retirement luncheon for Under Sheriff Marty Williamson.

Allen reported of bid opening for various street repair and apparent low bidder of Birch Construction.
        
         Sgt. Craig gave staff report of current activity in the city.

17)     REPORTS FROM CITY ATTORNEY none

18)     REPORTS FROM CITY MANAGER
Zervis gave a brief report on the latest from Sacramento regarding the States budget.

19)     REPORTS FROM CITY COUNCIL
Hively reported on the Chile Verde Cook-off.

Member Wegman made a motion to move to the RDA agenda at 7:34p.m., 2nd by Member Hively.  Motion carried 4-0-1 Member West absent.

Mayor Espitia reconvened regular meeting at 7:37

Member Hively made a motion to move into closed session at 7:37 p.m., 2nd by Member Cortez.  Motion carried 4-0-1 Member West absent.

Member Wegman left the council chambers at 7:37p.m.

20)     CLOSED SESSION:

a)      Approval of close session minutes from the May 4, 2010 meeting.

b)      Government Code Section 54956.9(a): Pending Litigation.
McIntosh v. City of Wasco

c)  Conference with Legal Counsel Re Potential Litigation per Government Code Section 54956.9(c).

Attorney Schroeter reported that member Cortez made a motion to approve the closed session minutes, 2nd by Member Hively.  Motion carried 3-0-2 Members Wegman and West absent.

 Attorney Schroeter stated that no other reportable action was taken in closed session.


21)     ADJOURNMENT Mayor Espitia adjourned the regular meeting at 9:16 p.m.
