1)      CALL TO ORDER
Mayor Pro Tem Hively called the meeting to order at 7:00p.m.  Member Wegman asked that the meeting be dedicated in memory of residents Raquel Rodriguez and Lupe Sanchez.

2)      FLAG SALUTE
3)      INVOCATION:  Carlos Calderon of Free Will Baptist Church offered the invocation.
4)      ROLL CALL

5)      PRESENTATIONS AND AWARDS-  None

6)      COMMUNICATIONS FROM THE AUDIENCE:

Dave Abernathy 2781 Grapevine Lane heard regarding the neighborhood flooding in relation to the recent storm and asked how this will be remedied so as to not happen again.

Jennifer Abernathy 2781 Grapevine Lane, circulated pictures taken of the flooded streets.

Resident 2773 Grapevine Lane, heard regarding alleged flood damages.

Staff responded to residents to follow-up with staff on measures taken for future issues of storm water drain off and where to pick up a claim form.

7)      CONSENT CALENDAR:
       
a)      Approval of Minutes from the regular meeting on March 2, 2010

b)      Approval of Bill Paying List, total amount of $214,292.27.

c)      Acceptance of Sheriff's Activity Report for the Month of February 2010.

d)      Acceptance of Code Enforcement Report for the Month of February 2010.

e)      Acceptance of Animal Control Report for the Month of February 2010.

f)      Acceptance of Monthly Building Permit Report for February 2010.

g)      Acceptance of Investment Policy and Compliance Report for the Month of February 2010.
h)      Community Development Department Project Status Report for the Month of February 2010.


i)      Report and Possible Approval, RE: 10-2698 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING A COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM AUTHORIZED SIGNATURE CARD FOR REQUEST FOR FUNDS FOR CDBG GRANT NUMBER 09-STBG-6421.

j)      Report and Possible Approval, RE: 10-2699 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING A COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM AUTHORIZED SIGNATURE CARD FOR REQUEST FOR FUNDS FOR CDBG GRANT NUMBER 08-EDEF-5879.

k)      Acknowledge Receipt of Correspondence.

l)      Approve the Reading of All Ordinances and Resolutions by Title Only and  
      Approve Publication of All Ordinances in Summary Form.


Without question or comment Member West made a motion to approve calendar, 2nd by Member Wegman.  Motion carried with the following vote:
AYES:        Hively, Wegman, West
        NOES:        None
        ABSTAIN: None
        ABSENT:   Cortez and Espitia
        City Clerk Hight read the resolution title

8)      Acceptance of Monthly Financial Report Related to Status of Quimby Fee Account.
City Manager Zervis gave the account total of $138,444.78 stating differences in totals from last report are due to costs associated with the Annin Soccer Park.   No action taken.

9)      Report and Possible Introduction of an Urgency Ordinance, RE:  AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 65858 FOR THE PURPOSE OF PROHIBITING MEDICAL MARIJUANA DISPENSERIES INCLUDING, WITHOUT LIMITATION, ISSUING BUSINESS LICENSES FOR SAME, UNTIL COMPLETION OF A ZONING ORDINANCE REGULATING THE LOCATION AND CONDITIONS FOR OPERATION OF SAME. (Allinder)

Attorney Schroeter stated that an urgency ordinance must be adopted by a 4/5 vote and due to absences of two councilmember's suggested tabling the item.
Mayor Pro Tem Hively tabled the item, no action taken.

10)     Public Hearing, Second Reading and Possible Adoption of an Ordinance, RE:  10-604 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO REDUCING THE SIZE OF THE WASCO PLANNING COMMISSION AND AMENDING ORDINANCE NOS. 36 AND 139. (Hight)
Mayor Pro tem Hively opened the public hearing, and asked for comment, hearing none closed the public hearing at 7:14.
Member Wegman made a motion to adopt, 2nd by Member West.  Motion carried with the following vote:
AYES:        Hively, Wegman, West
        NOES:        None
        ABSTAIN: None
        ABSENT:   Cortez and Espitia
        City Clerk Hight read the ordinance title.

11)     Report, Public Hearing and Possible Introduction of an Ordinance, RE: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING ZONING ORDINANCE TEXT AMENDMENT (ZOTA) 10-01 AMENDING TITLE 17 OF THE CITY OF WASCO MUNICIPAL CODE, SECTION N OF THE HISTORIC DOWNTOWN WASCO OVERLAY DISTRICT TO CLARIFY THE PROCESS FOR THE DETERMINATION OF ACCEPTABLE BUILDING MATERIALS FOR USE IN THE DOWNTOWN AS REFLECTED IN EXHIBIT A. (Allinder)

Mayor Pro Tem Hively opened the public hearing.
Community Development Director gave staff report and asked for direction from council.
Mayor Pro Tem Hively asked for comments.
Bob Ellis heard in regards to the Historic Village and the plans for their project.
Sylvis Riddle heard regarding a project on 7th street at their church.
Mayor Pro Tem Hively closed the public hearing at 7:19p.m.
Member Wegman made a motion to approve the first reading, 2nd by Member West.  Motion carried with the following vote:
        AYES:        Hively, Wegman, West
        NOES:        None
        ABSTAIN: None
        ABSENT:   Cortez and Espitia
        City Clerk Hight read the ordinance title.

12)     Report and Discussion, RE: The General Plan Annual Report for the 2009 Planning Year. (Allinder)
Community Development Director Allinder reported that this was an information only item no action was needed at this time.  
There was no discussion.

13)     REPORTS FROM CITY STAFF
Sgt. Craig gave a recent activity report and introduced Deputy Amanda Young who is replacing Deputy Daniel Perez.

14)     REPORTS FROM CITY ATTORNEY none

15)     REPORTS FROM CITY MANAGER
City Manager Zervis reported on the Fresh and Easy opening date of April 14, and told of the CALGRIP grant award.  He also stated he would be watching the legislative gas tax swap.

16)     REPORTS FROM CITY COUNCIL       none

Member Wegman made a motion to move to the RDA agenda at 7:28 p.m., 2nd by Member West.  Motion carried.

Mayor Pro Tem Hively reconvened regular meeting at 7:45p.m.

Member West made a motion to move into closed session at 7:45p.m., 2nd by Member Wegman.  Motion carried.

Mayor Pro Tem Hively reconvened regular meeting at 9:15   p.m.

17)     CLOSED SESSION:

a)      Approval of close session minutes from the February 2, 2010 meeting.

b)      Conference with Labor Negotiators:

Attorney Schroeter reported that on item 7a)  (correction) the minutes for March 2, closed session were approved on motion of Wegman/West, all in favor 3-0-2

Attorney Schroeter reported that there was no other reportable action taken.

18)     ADJOURNMENT
Member Wegman made a motion to adjourn the regular meeting at 9:16 p.m., 2nd by Member West.
All in favor, motion carried.
