1)      CALL TO ORDER Mayor Espitia called the meeting to order at 7:00 p.m.

2)      FLAG SALUTE
Member Wegman asked that tonight's meeting be dedicated in memory of residents Bill Avalos and Angie Munoz.

3)      INVOCATION:  Danny Scott of Free Will Baptist Church offered the invocation.
4)      ROLL CALL

5)      PRESENTATIONS AND AWARDS:   none

6)      COMMUNICATIONS FROM THE AUDIENCE:

John Martin, business owner, inquired about a stay of administration fees regarding a dumpster at local residence.  Staff will meet with Mr. Martin.

Member Cortez arrived at 7:03 p.m.

7)      CONSENT CALENDAR:       
a)      Approval of Minutes from the regular meeting on February 16, 2010

b)      Approval of Bill Paying List, total amount of $670,246.02

c)      Second Reading and Possible Adoption of an Ordinance, RE:  10-603 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING WASCO MUNICIPAL CODE SECTION 15.04.030 TO REFERENCE THE UPDATED 2008 CALIFORNIA ENERGY CODE AS REFLECTED IN EXHIBIT A.

d)      Notice of Acceptance & Bond Reduction for Circle K - J Street Improvements.

e)      Acknowledge Receipt of Correspondence.

f)      Approve the Reading of All Ordinances and Resolutions by Title Only and  
      Approve Publication of All Ordinances in Summary Form.

Without discussion, Member West made a motion to approve, 2nd by Member Hively. All in favor motion carried with the following vote:
AYES:        Cortez, Hively, Wegman, West and Espitia
        NOES:        None

8)      Report, Public Hearing and Possible Approval, RE: 10-2696 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO AUTHORIZING THE CITY OF WASCO TO JOIN THE CaliforniaFIRST PROGRAM; AUTHORIZING THE CALIFORNIA STATEWIDE COMMUNITIES DEVELOPMENT AUTHORITY TO ACCEPT APPLICATIONS FROM PROPERTY OWNERS, CONDUCT CONTRACTUAL ASSESSMENT PROCEEDINGS AND LEVY CONTRACTUAL ASSESSMENTS WITHIN THE TERRITORY OF THE CITY OF WASCO; AND AUTHORIZING RELATED ACTIONS. (Zervis)
Mayor Espitia opened the public hearing.
City Manager Zervis gave the staff report stating that this is a voluntary program for property owners to finance energy efficiency improvements over a 5-20 years on their property tax bill. Mr. Zervis introduced Allen Krauter who was in attendance to answer any questions.
After brief discussion, Mayor Espitia closed the public hearing at 7:15 p.m.  Member Cortez made a motion to approve, 2nd by Member Hively.
Motion carried with the following vote:
AYES:        Cortez, Hively, Wegman, West and Espitia
        NOES:        None
        ABSTAIN: None
        ABSENT:   None

9)      Report and Possible Approval, RE: 10-2697 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO AUTHORIZING SACRAMENTO COUNTY TO APPLY FOR FUNDS ON BEHALF OF THE CITY OF WASCO. (Zervis)

City Manager Zervis reported that this was a follow-up item for the CaliforniaFIRST program for the participation fee to be reimbursed to the city.

There were no questions, Member Wegman made a motion to approve, 2nd by Member West.  Motion carried with the following vote:

AYES:        Cortez, Hively, Wegman, West and Espitia
        NOES:        None
        ABSTAIN: None
        ABSENT:   None

Mayor Espitia cited Conflict of Interest, stating his employer being the Wasco Recreation and Parks District, and left the council chamber.

10)     Report and Possible Approval, RE: An Agreement between the City of Wasco and the Wasco Recreation and Parks District for the Maintenance and use of the Annin Soccer Park. (Zervis)
City Manager Zervis gave report of the proposal received from the Wasco Recreation and Parks for the maintenance of the Annin Soccer Park.  He told of other bids submitted and recommended the more cost effective proposal being $700.00 a month from the Wasco Recreation and Parks District.
There was brief discussion regarding park usage and possible revenue from rentals, management/programming of users, possible green space maintenance inclusion.

After brief discussion, Member Wegman made a motion to approve, 2nd by Member Cortez.
Motion carried with the following vote:
AYES:        Cortez, Wegman, West, and Hively
        NOES:        None
        ABSTAIN: None
        ABSENT:   Espitia
        
Mayor Espitia returned to council chambers and thanked Mayor Pro Tem Hively for presiding.

11)     Report and Possible Minute Action, RE: Wasco Housing Authority Commissioner Appointments.
City Attorney Schroeter reported that according to State Law one of the two tenant commissioners should be a resident of 62 years of age or greater.  Re-advertising was not necessary but notice to tenants would be prudent to solicit interest from tenants of that age group.

There was brief discussion regarding past interest of tenants and difficulty in finding residents to serve.  

Member Hively made a motion to notice tenants of 62 years of age or greater with a two week time frame to respond to the clerks office, 2nd by Member Wegman.
All in favor motion carried 5-0-0.

12)     REPORTS FROM CITY STAFF
Sgt Craig gave a report on recent activity including crosswalk enforcement, handicapped parking enforcement, and DUI checkpoints.

Sgt Craig introduced Commander Kenny Williams as the new commander for the Wasco Sub Station replacing Commander Moore.

13)     REPORTS FROM CITY ATTORNEY none

14)     REPORTS FROM CITY MANAGER
Mr. Zervis reported that he received a call from WUHS Superintendant McCray stating her approval of the crosswalk enforcement near the High School grounds.  He commended staff in their efforts to set barricades and take necessary measures to ensure public safety during the recent storm.
        
15)     REPORTS FROM CITY COUNCIL
Cortez: thanked the Sheriffs Department for their good work in Wasco.
        Hively: reported attendance at the Denny's grand opening.
        West: reported attendance at the Denny's grand opening and the hiring of 68 local residents.
        Wegman: thanked the Sheriffs Department for their good work in Wasco.

Member Hively made a motion to recess to the RDA agenda at 7:43 p.m., 2nd by Member Cortez, motion carried.

Member Wegman made a motion to recess into closed session at 7:44 p.m., 2nd by Member Cortez, motion carried.

Mayor Espitia reconvened regular meeting at 8:44 p.m.

16)     CLOSED SESSION:

a)      Approval of close session minutes from the February 16, 2010 meeting.

b)      Conference with legal counsel regarding claim filed by Vanessa Garcia per Government Code Section 54956.9(b).

c)      Government Code Section 54956.9(a): Pending Litigation.

d)  Conference with legal counsel regarding possible initiation of litigation (one case) per Government Code section 54956.9(c).

Attorney Schroeter reported that Member Cortez reported a conflict of interest on item 16)b and left the closed session citing family relation to Ms. Garcia.  

Attorney Schroeter reported that on item 16)b a motion by Member Espitia and 2nd by Member Wegman to deny claim, motion carried 4/0/1, Member Cortez absent.

No further reportable action taken.

17)     ADJOURNMENT Mayor Espitia adjourned regular meeting at 8:45p.m.
