1)      CALL TO ORDER Mayor Pro Tem Espitia called the meeting to order at 7:00 p.m.

2)      FLAG SALUTE
3)      INVOCATION:  Scott Allred of First United Methodist delivered the invocation.
4)      ROLL CALL
Mayor West, Members; Espitia, Hively Wegman
ABSENT: Member Cortez,

5)      PRESENTATIONS AND AWARDS-  none

6)      COMMUNICATIONS FROM THE AUDIENCE:
Bob Reeves 2325 Sunset was heard stating his concerns regarding trash and street repair along Beckes street.
        
City Manager Zervis said that he would meet with Mr. Reeves to discuss his concerns.

        
7)      CONSENT CALENDAR:

a)      Approval of Minutes from the following meetings
Special Joint Meeting on October 14, 2009
Regular Meeting on October 20, 2009

b)      Approval of Bill Paying List, total amount of $993,077.16.

c)      Second Reading and Possible Adoption of an Ordinance, RE:09-591 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING TITLE 17 OF THE CITY OF WASCO MUNICIPAL CODE, SECTION 17.74 (NONCONFORMING STRUCTURES, USES, LOTS AND SIGNS) AS REFLECTED IN EXHIBIT A.

d)      Acknowledge Receipt of Correspondence.

e)      Approve the Reading of All Ordinances and Resolutions by Title Only and  
      Approve Publication of All Ordinances in Summary Form.
        
Member Wegman made a motion to approve items 7a, 7b, 7d and 7e, 2nd by Member Hively.  Motion carried with a 4-0-1 vote.  Member Cortez absent.

Member Espitia made a motion to approve item 7c, 2nd by Member Wegman.  Motion carried with the following vote:

AYES:  Members Hively, Espitia and Wegman
        NOES:  None
        ABSTAIN:  West
        ABSENT: Cortez

City Clerk Hight read the ordinance title.

8)      Report and Possible Introduction of an Ordinance, RE:  AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING ORDINANCE NO. 453 AND WASCO MUNICIPAL CODE SECTION 13.08.020.J PROVIDING FOR THE INSTALLATION OF WATER METERS, PAYMENT OF COSTS WITH REGARD THERETO AND IMPOSITION OF LIENS. (Allen)

Public Works Director Allen gave the staff report.

Staff has identified a potential issue that may occur during installation of the service meters.
There could be issues with reconnection of the new meter to the old service lines from the meter to the house.  The portion of the service is on private property owned by the property owner.  There may be some lines that will be impossible for the contractor to be able to connect due to deterioration of the service line.  The municipal currently does not allow city employees to enter the property to replace the lines without the permission of the homeowner or allow the city to recoup the charges.   This amendment allows installation, payment of costs and imposition of liens.

In formation will be given to the property owner by way of hand delivery.  There would be an appeal process and a 10 day notice.

There was discussion regarding the charges for replace or repair of the service line.  Staff proposed a possible repayment program for residents that needed to utilize a repayment program.  City Manager stated that such a program could be brought before the council at the next meeting.

Bob Reeves asked if this was also state mandated.  Staff affirmed.

Without further discussion, Member Wegman made a motion to approve, 2nd by Member Espitia.  Motion carried with the following vote:

AYES:  Mayor West, Members Hively, Espitia and Wegman

        ABSENT: Cortez

9)      Report and Possible Approval, RE:  A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO DECLARING SUPPORT FOR THE "SAN JOAQUIN VALLEY CLEAN ENERGY PARTNERSHIP" LED BY THE SAN JOAQUIN VALLEY AIR POLLUTION CONTROL DISTRICT AND THE SAN JOAQUIN VALLEY CLEAN ENERGY ORGANIZATION TO MAXIMIZE ACCESS, SERVICES, AND RESOURCES FROM THE ENERGY EFFICIENCY AND CONSERVATION BLOCK GRANT PROGRAM THROUGH THE CALIFORNIA ENERGY COMMISSION. (Allen)

Public Works Director gave the staff report and recommended approval stating that the City of Wasco is eligible for an EECBG allocation of $138,781.27 and proposes to use the funds to upgrade the street lights on 7th street to LED.
Member Wegman made a motion to approve, 2nd by Member Hively.  Motion carried with the following vote:
AYES:  Members Hively, Espitia and Wegman
        NOES:  None
        ABSTAIN:  West
        ABSENT: Cortez
City Clerk Hight read the resolution title.

10)     Report and Possible Minute Action, RE: Approval of  a Job Description for the Position of Custodian and an Amendment to the 2009/10 Annual Operating Budget to Authorize and Include the Custodian position. (Zervis)

City Manager Zervis gave staff report and recommended approval of proposed job description for a fulltime custodian position.  He reported the current status of the janitorial contract that has expired with Morris Janitorial and the increased costs of their proposal.

Zervis stated that the position would be cost neutral for the city.

There was discussion regarding the accountability and working hours of janitorial position.

No action taken.

11)     REPORTS FROM CITY STAFF
Allen gave a progress report of Beckes Street paving, Soccer Park landscaping and seeding, water meter project and Speies Construction mobilization.
        Lieutenant Cornelison introduced Sgt Craig to council and staff.
Sgt. Craig greeted council and outlined a few of his accomplishments and his plans for foot patrol, bike patrol and traffic enforcement.

12)     REPORTS FROM CITY ATTORNEY none

13)     REPORTS FROM CITY MANAGER
Zervis welcomed Sgt Craig.  He told of the groundbreaking ceremony celebrating ERA funds.
He reported that on Monday November 16th and 17th continued public safety analysis meetings with people in the community and the public forum workshop.  

14)     REPORTS FROM CITY COUNCIL
Hively said that it looked like Denny's was quickly progressing.  He asked the sheriffs department to keep an eye on car thefts, as they seemed to be increasing.
Mayor West recessed to the RDA agenda at 7:55 p.m.
Mayor West reconvened and recessed to a joint closed session with the RDA at 7:56 p.m.

Mayor Pro Tem Espitia reconvened the meeting at 9:05 p.m.
  
15)     CLOSED SESSION:

a)      Government Code Section 54956.9(a): Pending Litigation.
McIntosh v. City of Wasco

b)      Conference with Real Property Negotiator (City Manager) Regarding Price and Terms of Payment for Real Property Described as 810 8th Street, Wasco CA  93280 Per Government Code Section 54956.8.

c)      Conference with legal counsel re claim filed by Kenneth Vils per Government Code Section 54956.9(b).

Attorney Schroeter stated that no reportable action was taken during closed session.

16)     ADJOURNMENT Member Hively made a motion to adjourn, 2nd by Member Espitia.  
Motion carried meeting adjourned.
