1)      CALL TO ORDER: Mayor West called the meeting to order at 7:00 p.m.

2)      FLAG SALUTE
3)      INVOCATION:  Bill Lewis of Griffith Ave. Baptist Church offered the invocation.
4)      ROLL CALL

5)      PRESENTATIONS AND AWARDS:  None

6)      COMMUNICATIONS FROM THE AUDIENCE:
Ukania Morales 1700 Poppy Court presented a list of vehicles parked illegally on residential streets of Wasco.  She spoke to Council about their expenses of storing their vehicles in a legal storage.  She asked if they could have a waiver and park their vehicles at their residence too.

Staff said that they would meet with Mrs. Morales and follow up with code enforcement regarding the list of offenders.

Steve Warren 721 Trenton, Delano addressed the council with an invitation to join Assemblyman Gilmore at Barker Park for a free energy program to be held at Barker Park on Saturday October 24th, from 11:30 - 3:00 p.m.  

7)      CONSENT CALENDAR:
a)      Approval of Minutes from the regular meeting on October 6, 2009.

b)      Approval of Bill Paying List, total amount of $359,168.19.

c)      Acceptance of Sheriff's Activity Report for the Month of September 2009.

d)      Acceptance of Code Enforcement Report for the Month of September 2009.

e)      Acceptance of Animal Control Report for the Month of September 2009.

f)      Acceptance of Monthly Building Permit Report for September 2009.

g)      Acceptance of Investment Policy and Compliance Report for the Month of September 2009.

h)      Community Development Department Project Status Report for the Month of September 2009.

i)      Second Reading and Possible Adoption of an Ordinance, RE: 09-589 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING ORDINANCE REGARDING WATER CONSERVATION WATERING HOURS: SECTION 13.22.050 (b) (c).

j)      Report and Possible Approval, RE: 09-2670 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING THE ANNUAL TRANSPORTATION DEVELOPMENT ACT STREETS AND ROADS CLAIM FOR FISCAL YEAR 2009-2010 AND AUTHORIZING ITS FILING WITH THE KERN COUNCIL OF GOVERNMENTS.

k)      Report and Possible Approval, RE:  Awarding of Construction Monitoring Contract for the Wastewater Treatment Plant Centrifuge Project to Palmetto Engineering.

l)      Report and Possible Approval, RE:  Awarding of the Beckes Street repaving project from 5th Street to 7th Street.

m)      Report and Possible Approval, RE:  Amendment to Contract, General Conditions, and Plans and Specifications for the Wastewater Treatment Plant Centrifuge Project.

n)      Acknowledge Receipt of Correspondence.

o)      Approve the Reading of All Ordinances and Resolutions by Title Only and  
      Approve Publication of All Ordinances in Summary Form.

Without discussion Member Wegman made a motion to approve, 2nd by Member Hively.  Motion carried with the following vote:

AYES:        West, Cortez Espitia, Hively, and Wegman.
        NOES:        None
        ABSTAIN:  None
        ABSENT:    None

8)      Acceptance of Monthly Financial Report Related to Status of Quimby Fee Account.
City Manager Jim Zervis gave the balance total of $255,074.72.  No action taken.

9)      Public Hearing, Second Reading, and Possible Adoption of an Ordinance, RE:  AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO, CALIFORNIA  AMENDING CHAPTER 10.48 TRUCK ROUTES, SECTION 10.48.010. (Allen)
Mayor West opened the public hearing.
Public Works Director Allen gave the staff report on established truck routes and recommended approval.

Mayor West asked for comment, hearing none, closed the public hearing at 7:12p.m.

Without discussion, Member Cortez made a motion to approve, 2nd by Member Espitia.
Motion carried with the following vote:
AYES:        West, Cortez Espitia, Hively, and Wegman.
        NOES:        None
        ABSTAIN:  None
        ABSENT:    None
        City Clerk Hight read the ordinance title.

Mayor West abstained from item #10 and #12 and left council chambers.

10)     Report, Public Hearing and Possible Introduction of an Ordinance, RE: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING TITLE 17 OF THE CITY OF WASCO MUNICIPAL CODE, SECTION 17.74 (NONCONFORMING STRUCTURES, USES, LOTS AND SIGNS) AS REFLECTED IN EXHIBIT A. (Allinder)

Mayor Pro Tem Espitia opened the public hearing.
PMC Consultant Allinder gave staff report.  She spoke of the Planning Commissions approval and council recommended approval of this item.

        There was brief discussion regarding the amendment and its worthiness.   

        With no further discussion Mayor Pro Tem Espitia closed the public hearing at 7:16.

Member Wegman made a motion to approve, 2nd by Member Cortez.  Motion carried with the following vote:
AYES:        Cortez Espitia, Hively, and Wegman.
        NOES:        None
        ABSTAIN:  West
        ABSENT:    None
        City Clerk Hight read the ordinance title

        Mayor West continued to abstain from item 12) Member Cortez made a motion to hear item 12) now, 2nd by Member Hively.  Motion carried.  

11)     Report and Possible Approval, RE: 09-2671 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO FINDING AND DETERMINING THAT A PROJECT AREA COMMITTEE NEED NOT BE FORMED IN RELATION TO THE PROPOSED WASCO REDEVELOPMENT PROJECT AREA NO. 2. (Allinder)
Mayor West returned to Council Chambers.

PMC Consultant Allinder gave report and recommended approval.

Without discussion, Member Hively made a motion to approve, 2nd by Member Espitia.  Motion carried with the following vote:
AYES:        West, Cortez Espitia, Hively, and Wegman.
        NOES:        None
        ABSTAIN:  None
        ABSENT:    None

12)     Report and Possible Approval, RE:  09-2672 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING THE LOCAL PROPOSITION 1B STREETS AND ROADS BUDGET FOR FISCAL YEAR 2008-2009. (Allen)
Mayor Pro Tem Espitia read the resolution.
Public Works Director Allen gave report and recommended approval.
Without discussion Member Cortez made a motion to approve, 2nd by Member Hively.  Motion carried with the following vote:
AYES:        Cortez Espitia, Hively, and Wegman.
        NOES:        None
        ABSTAIN:  West
        ABSENT:    None

Member Cortez made a motion to return to item 11), and return to regular agenda thereafter 2nd by Member Hively.  All in favor, motion carried

13)     Report and Possible Approval, RE: 09-2673 A RESOLUTION APPROVING THE FORM OF AND AUTHORIZING THE EXECUTION AND DELIVERY OF A PURCHASE AND SALE AGREEMENT AND RELATED DOCUMENTS WITH RESPECT TO THE SALE OF THE SELLER'S PROPOSITION 1A RECEIVABLE FROM THE STATE; AND DIRECTING AND AUTHORIZING CERTAIN OTHER ACTIONS IN CONNECTION THEREWITH. (Zervis)

City Manager Zervis gave staff report and recommended approval.  He recommended approval for City Manager and City Attorney be authorized to review and possibly approve all related documentation.
There was brief discussion regarding recourse back to the city for repayment.
Member Cortez made a motion to approve, 2nd by Member Hively.  Motion carried with the following vote:

AYES:        West, Cortez Espitia, Hively, and Wegman.
        NOES:        None
        ABSTAIN:  None
        ABSENT:    None

14)     Report and Possible Minute Action, RE: Wasco Recreation and Parks Appointment. (Council Member Hively and Council Member Wegman)
City Clerk Hight gave a brief report and asked for direction to advertise position.
Member Cortez made a motion to approve recommendation and advertise, 2nd by Member Hively.  Motion carried with a 4-0-1 vote.  Member Espitia abstained.

15)     REPORTS FROM CITY STAFF

Allen stated that PG&E have removed the poles from Central Ave and will be repairing road soon.  He also gave an update on Poso reconstruction, Water meter installation and wastewater project, all are progressing.
Allinder reported that Circle K has received their final approval, and Denny's will be pouring concrete at their site next week.
        
Sgt Armendariz: reported that Lieutenant Cornelison is back in Wasco.  He also stated that Wasco Tribune Editor Alexis Stokes rode with local deputies to cover traffic enforcement issues.  Sgt also stated that he or staff would follow up with Mrs. Morales on her previous complaint about parking enforcement.

16)     REPORTS FROM CITY ATTORNEY none

17)     REPORTS FROM CITY MANAGER
Police service analysis interviews will begin soon and will be hosting a steering committee meeting.  The Planning Commission meeting has been rescheduled due to a lack of quorum.

18)     REPORTS FROM CITY COUNCIL
Espitia asked for a record of attendance at meetings of appointed boards.
Wegman stated the desire to reduce PC board to 5 instead of 7.
        Hively Asked when the grass would be seeded at the Soccer Park.
West asked about the watering of the trees that have been planted and suggested deep watering method.

        Member Cortez made a motion to recess to RDA agenda at 7:49, 2nd by Member Hively.  
        Mayor West reconvened regular meeting at 8:03 and recessed to closed session.

19)     CLOSED SESSION:

a)      Conference with Legal Counsel Regarding Claim Filed by Employee for Worker's Compensation Benefits Per Government Code Section 54956.9(a).

Attorney Schroeter reported that no reportable action was taken in closed session.
        
20)     ADJOURNMENT Member Cortez made a motion to adjourn at 8:15 p.m., 2nd by Member Espitia.  Motion carried meeting adjourned.
