1)      CALL TO ORDER: Mayor West called the meeting to order at 7:00 p.m.
2)      FLAG SALUTE
3)      INVOCATION:  Bill Lewis of Griffith Avenue Baptist Church offered the invocation.
4)      ROLL CALL

Absent: Member Wegman
Assistant City Attorney  George Yin, Assistant City Manager Zervis, City Clerk Hight, Executive Assistant Rodriguez, Public Works Director Allen, Community Development Director Heiser, Sgt Armendariz

6)      COMMUNICATIONS FROM THE AUDIENCE: None

7)      CONSENT CALENDAR:
a)      Approval of Minutes from the following meetings:
Joint Budget Workshop/Study Session on March 17, 2009
Special Meeting on April 7, 2009
Regular Meeting on April 7, 2009

b)      Approval of Bill Paying List.

c)      Acceptance of Sheriff's Activity Report for the Month of March 2009.

d)      Acceptance of Code Enforcement Report for the Month of March 2009.

e)      Acceptance of Monthly Building Permit Report for March 2009

f)      Acknowledge Receipt of Correspondence.

g)      Approve the Reading of All Ordinances and Resolutions by Title Only and  
      Approve Publication of All Ordinances in Summary Form.


Member Cortez made a motion to approve, 2nd by Member Espitia.  Motion carried 4-0-1 Member Wegman absent.
        
8)      Acceptance of Monthly Financial Report Related to Status of Quimby Fee Account.

Assistant City Manager Zervis gave the report of $287,640.77 and reported no change since the last report was given.  No action taken.

9)      Report, Public Hearing and Possible Approval, RE:  A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO ADOPTING COMMUNITY DEVELOPMENT APPLICATION FEE SCHEDULE COMBINING RESOLUTION NO. 2007-2409 AND RESOLUTION NO. 2007-2473 RELATING TO DEVELOPMENT AND MAINTENANCE OF CITY FILES AND UPDATE EXISTING FEES PREVIOUSLY ADOPTED. (Heiser)

Mayor West opened the public hearing.  
Community Development Director gave a brief staff report and asked to receive public comment but recommended taking no action this evening.

There was no comment from the public.

Mayor West closed the public hearing at 7:04 p.m.

Member Cortez made a motion to continue item to May 5th, 2nd by Member Espitia.  Motion carried 4-0-1.  Member Wegman absent.

10)     Report and Possible Approval, Re: 2009-2614 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO MODIFYING REFUSE FEE RESOLUTION 2007-2418 TO INCLUDE COST FOR ADDITIONAL SOLID WASTE CAN (BLACK), GREEN WASTE CAN (GREEN) AND CITY ROLL-OFF BIN RENTAL FEES. (Allen)

Public Works Director Allen gave a staff report of the fee for additional containers and how staff came to the fee amount.
There was discussion regarding refuse weight verses flat fee per month.

Member Cortez made a motion to approve the resolution, 2nd by Member Hively.  Motion carried with the following vote:
AYES:        Espitia, Cortez, Hively
        NOES:        West
        ABSTAIN: None
        ABSENT:   Wegman
        City Clerk Hight read the resolution title
 
11)     Report and Discussion, RE: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO REGARDING WATER CONSERVATION MEASURES. (Allen)

Public Works Director Allen gave a brief report and asked for Council comments and guidance before the creation of the final ordinance.
There was discussion regarding involving the public for comment, comparing other cities in kind ordinances, and enforcement issues.  
Assistant City Manager Zervis asked Council to submit their guideline ideas to staff within the week so that staff could share information with the City Attorneys office for the creation of the document.

No action taken.

12)     Report and Possible Minute Action, RE: Formation of a Two Member Wasco Union High School Relations Committee. (Zervis)
Assistant City Manager Zervis asked for a two member subcommittee to meet with the Wasco High School District on any issues that affect both City and District.
Member Espitia made a motion to appoint Member Cortez and Mayor West to the committee, 2nd by Member Cortez motion carried 4-0-1 Member Wegman absent.  

13)     Report and Possible Minute Action, RE: Wasco Housing Authority Commissioner Appointment. (Mayor West and Council Member Wegman)

Mayor West reported that he and Member Wegman had met and were recommending Geary Anderson to a 4-year term as Commissioner as he had only served a few months in this term.

Member Espitia made a motion to approve appointment, 2nd by Member West.  Motion carried 4-0-1 Member Wegman absent.

14)     REPORTS FROM CITY STAFF
Sgt Armendariz gave a brief staff report and invited council to the Boxing Exhibition on May 1st
@ 6:00p.m.

15)     REPORTS FROM CITY ATTORNEY- none

16)     REPORTS FROM CITY MANAGER- none

17)     REPORTS FROM CITY COUNCIL-
Cortez- spoke about the positive meeting with the Recreation and Parks and the many interested community members present.

Espitia- spoke about the Recreation and Parks workshop and told of the approximate 16 acre park and the importance of community attendance.

Member Espitia made a motion to recess to the RDA agenda at 7:36 p.m.
        Mayor West reconvened the regular meeting and recessed to closed session at 7:37 p.m.
        
18)     CLOSED SESSION:
a)      Public Employee Recruitment - City Manager, Government Code Section 54957.  

b)      The City Council will recess to a Closed Session pursuant to Government Code Section 54956.9(b); Conference with Legal Counsel -- Anticipated Litigation -- 1 case

Mayor West reconvened regular meeting at 8:07 p.m.
Assistant City Attorney George Yin reported that no reportable action was taken in closed session.

19)     ADJOURNMENT   
Member Cortez made a motion to adjourn at 8:07 p.m., 2nd by Member Espitia.  Motion carried, meeting adjourned.
