1)      CALL TO ORDER:  Mayor West called the meeting to order at 7:00p.m.

2)      FLAG SALUTE
3)      INVOCATION:  Councilmember Wegman offered the invocation.

7)      CONSENT CALENDAR:

a)      Approval of Minutes from the following meetings:
Special Meeting on December 23, 2008
Regular Meeting on January 6, 2009.

b)      Approval of Bill Paying List.

c)      Acceptance of Sheriff's Activity Report for the Month of December 2008.

d)      Acceptance of Code Enforcement Report for the Month of December 2008.

e)      Acceptance of Monthly Building Permit Report for December 2008.

f)      Second Reading and Possible Adoption of an Ordinance, Re:  09-582 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING SECTION 2.30.120 OF THE WASCO MUNICIPAL CODE TO UPDATE THE CONFLICT OF INTEREST CODE TO REVISE THE DESIGNATED POSITIONS FOR WHICH STATEMENTS OF ECONOMIC INTEREST ARE REQUIRED TO BE FILED.

g)      Report and Possible Approval Re:  Authorization to File the Federal Fiscal Year 2009 Certifications and Assurances for the Federal Transit Administration Assistance Programs and Authorize the City Attorney and Public Works Director to Execute all Documents.

h)      Acknowledge Receipt of Correspondence.

i)      Approve the Reading of All Ordinances and Resolutions by Title Only and  
      Approve Publication of All Ordinances in Summary Form.

Mayor West asked for comment or questions, hearing none, Member Wegman made a motion to approve calendar, 2nd by Member Espitia.  

Motion carried with the following vote:
AYES:        West, Espitia, and Wegman.

8)      Acceptance of Monthly Financial Report Related to Status of Quimby Fee Account.

City Manager Mittag gave a report of the fund balance of $296,204.37.  No action taken.

9)      Report and Possible Approval, RE:  09-2590 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING AN APPLICATION AND CONTRACT EXECUTION FOR FUNDING FROM THE GANG RESISTANCE EDUCATION AND TRAINING (G.R.E.A.T.) PROGRAM OF THE U.S. DEPARTMENT OF JUSTICE, OFFICE OF JUSTICE PROGRAMS' BUREAU OF JUSTICE ASSISTANCE AND AUTHORIZING THE MAYOR (OR MAYOR PRO TEM, IN MAYOR'S ABSENCE) TO EXECUTE A GRANT AGREEMENT AND ANY AMENDMENTS THERETO WITH THE U.S. DEPARTMENT OF JUSTICE FOR THE PURPOSES OF THIS GRANT. (Zervis)

Finance Director Zervis gave a report and read verbiage of the application and spoke of the intention to work in cooperation with the Elementary School District if application is successful.  The grant requires a 10% match and the local school board has agreed to meet those funds.  

        Translator was available for services.

Mayor West asked for comment or questions.  Hearing none, Member Wegman made a motion to approve, 2nd by Member Espitia.  Motion carried with the following vote:

10)     Report and Possible Approval, RE: 09-2591 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING A COMMUNICATIONS SITE LEASE AGREEMENT BETWEEN THE CITY OF WASCO AND UNWIRED BROADBAND, INC. (Zervis)

Finance Director Zervis gave a brief report of the history of the lease and the desire of Unwired Broadband to continue with a 5-year renewable lease, where the rate would increase from $500.00 to $650.00 per month and increase 5% annually.  

Mayor West asked if there were questions or comments, hearing none, Member Wegman made a motion to approve, 2nd by Member Espitia.  Motion carried with  the following vote:

        AYES:        West, Espitia, and Wegman.
        NOES:        None
        ABSTAIN: None
        ABSENT:   Cortez, Hively

11)     Report and Possible Minute Action, RE:  Consider Approval of Request for Lobbyist Expenses from Kern COG. (Mittag)

City Manager Mittag gave a brief report of Kern COG Board of Directors request for local cities to support and commit to funding a lobbying program and provided a couple of different scenarios of support.    

There was a brief discussion regarding which option to support.

Member Wegman made a motion to approve the $1131.00 Even Distribution support, 2nd by Member Espitia.  Motion carried with a 3-0-2 vote.  Members Cortez and Hively absent.

12)     Report and Possible Approval, RE: Assistant City Manager Position Description and Approval of Employee Contract for Assistant City Manager. (Mittag)

City Manager Mittag gave a brief report recommending Finance Director Jim Zervis for the position of Assistant City Manager.  Mr. Mittag sited Zervis' services as acting City Manager and the increase in salary which is within the 3.11% guidelines.

Member Wegman made a motion to approve, 2nd by Member Espitia.  Motion carried with a 3-0-2 vote.  Members Cortez and Hively absent.
        
13)     REPORTS FROM CITY STAFF
Allen: Gave a brief project report on Poplar and Broadway and the Soccer Park.

Council Member Cortez arrived at 7:15 p.m.

Sgt Armendariz: Gave a report on recent DUI checkpoint and recent "In Custody Death."

Zervis:  Gave a brief report of the alternate work schedule, citizens are taking advantage of the extra time that the office is open and as of yet, no complaints about being closed alternate Fridays.
Reported on the Annin Soccer Park grant possibilities, from the National Forrest Service.
Expressed his appreciation for the opportunity to serve as Assistant City Manager.

Heiser: Gave a project update report of Downtown Draft Plan, Carls Jr., Circle K on Highway 46, 7th and Central project is currently on hold.  

Hight: gave a report of a letter of appeal from resident Maribel Moreno regarding the Cooking Oil Waste Facility project.
Asked for direction regarding posting of vacant seat for Recreation Director due to the fact that recent appointee Chris Ballard cannot fulfill his appointment due to non residency issues.  

        There were question answered by staff concerning property on the corner of 6th and F streets.
        
14)     REPORTS FROM CITY ATTORNEY - None

15)     REPORTS FROM CITY MANAGER -  Recent trade show has provided two hits, prospect will be in Wasco next week to look at property.

16)     REPORTS FROM CITY COUNCIL
Cortez: apologized for arriving late, and congratulated Jim Zervis on his appointment to Assistant City Manager and spoke of his support.
Wegman:  Congratulated Jim Zervis on his appointment.  Asked staff to check on grease pits behind local business on highway 46, and asked for clarification on Truck and Bobtail truck parking.
Espitia: Congratulations to Jim Zervis on his appointment.  Thanked Public Works.  Reported he would be in Sacramento attending meetings regarding grants.

        Member Cortez made a motion to adjourn to RDA, at 7:40 p.m.
        
        Mayor West reconvened regular meeting at 7:43 p.m.

        Member Wegman made a motion to move into closed session at 7:43.

        Mayor West reconvened regular meeting at 7:53.

17)     CLOSED SESSION:

a)      Public Employee Recruitment - City Manager, Government Code Section 54957.  

Attorney Garcia gave a report of information provided, no reportable action taken.

18)     ADJOURNMENT Member Cortez made a motion to adjourn at 7:53 p.m. 2nd by Member Wegman.  Motion carried 4-0-1 Member Hively absent.
