1)      CALL TO ORDER: Mayor West called the meeting to order at 7:00p.m.

2)      FLAG SALUTE
3)      INVOCATION:  Jim Zervis offered the invocation.

7)      CONSENT CALENDAR:

a)      Approval of Minutes from the Regular Meeting on December 16, 2008.

b)      Approval of Bill Paying List.

c)      Second Reading and Possible Adoption of an Ordinance, Re:  09-581 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING ZONE CHANGE 08-06 AND ADOPTION OF MITIGATED NEGATIVE DECLARATION (SCH# 2008097703) - AN AMENDMENT TO THE CITY OF WASCO'S OFFICIAL ZONING MAP, TO RE-CLASSIFY 1.7 ACRES OF LAND CURRENTLY ZONED R-1-6 (LOW DENSITY RESIDENTIAL 6,000 SQ. FT. LOT) TO COMMUNITY COMMERCIAL RETAIL AND HIGH DENSITY RESIDENTIAL AND TO RE-CLASSIFY 12.3 ACRES OF LAND FROM C-R (COMMERCIAL RETAIL) TO R-3 (HIGH DENSITY RESIDENTIAL) FOR THE PROPOSED WASCO CENTER, LOCATED NORTH OF HWY 46, WEST OF N. PALM AVE, EAST OF N. MAGNOLIA AVE AND SOUTH OF MARGALO RD AS REFLECTED IN EXHIBIT A.

d)      Acknowledge Receipt of Correspondence.

e)      Approve the Reading of All Ordinances and Resolutions by Title Only and  
      Approve Publication of All Ordinances in Summary Form.

With no discussion Member Wegman made a motion to approve calendar, 2nd by Member Cortez.  Motion carried with the following vote:
AYES:        West, Cortez, Espitia, Hively, and Wegman.
        NOES:        None
        ABSTAIN: None
        ABSENT:   None
        City Clerk Hight read the resolution title

8)      Report, Public Hearing and Possible Approval, RE:  AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING SECTION 2.30.120 OF THE WASCO MUNICIPAL CODE TO UPDATE THE CONFLICT OF INTEREST CODE TO REVISE THE DESIGNATED POSITIONS FOR WHICH STATEMENTS OF ECONOMIC INTEREST ARE REQUIRED TO BE FILED. (Plaza)
Mayor West read and opened the public hearing.
Attorney Plaza gave a brief report of the action taken in the ordinance amendment.
Mayor West asked for public comment, hearing none closed the public hearing at 7:04 p.m.
Member Cortez made a motion to approve first reading, 2nd by Member Wegman.
Motion carried with the following vote:
AYES:        Wegman, Cortez, Espitia, Hively, and West.
        NOES:        None
        ABSTAIN: None
        ABSENT:   None
        City Clerk Hight read the ordinance title

9)      Report and Possible Approval RE: 09-2589 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO TO GRANT ANOTHER DESIGNATED PERIOD FOR TWO YEARS ADDITIONAL SERVICE CREDIT. (Zervis)
Finance Director Zervis gave a report regarding the approval of this item opens a 90 day retirement window where eligible employees can retire and receive two additional years of service credit.
There was a brief discussion of future windows and procedures for reopening the window.
Member Hively made a motion to approve, 2nd by Member Wegman.  Motion carried with the following vote:
AYES:        Wegman, Cortez, Espitia, Hively, and West.
        NOES:        None
        ABSTAIN: None
        ABSENT:   None

10)     Report and Possible Approval RE: The Issuance of a Certification of Compliance with Government Code Section 20903. (Zervis)
Finance Director Zervis gave a report regarding the approval of this item which opens a 90 day sign up window from January 7, 2009 through April 7, 2009 and is the final action needed.
Mayor West asked for comment or questions, hearing none, Member Cortez made a motion to approve, 2nd by Member Espitia.  Motion carried with the following vote:
AYES:        Wegman, Cortez, Espitia, Hively, and West.
        NOES:        None
        ABSTAIN: None
        ABSENT:   None
        
11)     Report and Possible Minute Action, RE: Planning Commissioner Appointments. (Mayor West and Council Member Wegman)
Member Wegman made a motion to reappoint incumbents Dwayne Hutson, Dave German and Jill Drescher to 4-year term on the Planning Commission, 2nd by Member Espitia.  Motion carried with a 5-0-0 vote.

12)     Report and Possible Minute Action, RE: Kern Mosquito and Vector Control District Appointment. (Mayor Pro Tem Espitia and Council Member Cortez)
Member Espitia made a motion to reappoint incumbent Roy Johnson to 4-year term on the Kern Mosquito Vector Control Board, 2nd by Member Wegman.  Motion carried with a 5-0-0 vote.
Mr. Johnson was present and thanked staff for their aid in the process and thanked council he appointment.

13)     REPORTS FROM CITY STAFF-
Fire department staff gave a report on the recent fire of refuse on J Street.  Staff reported that there were 30 plus Firefighters present.  He stated that they had good support from Sheriffs Department and water supply.

14)     REPORTS FROM CITY ATTORNEY- none

15)     REPORTS FROM CITY MANAGER- none

16)     REPORTS FROM CITY COUNCIL
Cortez: commended the Sheriffs Department on recent DUI check point.
Hively: commended the Sheriffs Department on recent gang enforcement deterrent
        
Member Cortez made a motion to recess to RDA agenda at 7:20p.m., 2nd by Member Espitia.  Motion carried.

Mayor West reconvened regular meeting at 8:00p.m.

17)     CLOSED SESSION:

a)      The City Council will recess to a Closed Session pursuant to Government Code Section 54956.9(a); Conference with Legal Counsel -- Pending Litigation.
City Manager Mittag reported that staff was directed to hold a public hearing on the matter.
b)      Public Employee Recruitment - City Manager, Government Code Section 54957.  
City Manager Mittag reported that direction was provided regarding the review process.

18)     ADJOURNMENT : Member Cortez made a motion to adjourn at 8:00 p.m., 2nd by Member Espitia.  Motion carried.
