July 15, 2008 – 7:00pm
City Council Chambers

1)      CALL TO ORDER: Mayor Wegman called the regular meeting to order at 7:00p.m
and dedicated the meeting to her newborn great nephew.

2)      FLAG SALUTE
3)      INVOCATION: Marvin Cockrell of True Light Baptist Church delivered the invocation.
4)      ROLL CALL
        Mayor Wegman, Members; Cortez, Espitia, Hively, West
Attorney  E Plaza, City Manager Mittag, City Clerk Hight, Executive Assistant Rodriguez, Finance Director Zervis, Public Works Director Allen, Community Development Director Johnson, Sgt Lee


5)      PRESENTATIONS AND AWARDS:

a)   Proclamation recognizing Probation, Parole and Community Supervision Week  
        during the week of July 13 - 19, 2008, presented to Kathy Lemon from the Probation Department.
Mayor Wegman presented the proclamation to Ms. Kathy Lemon from the Probation Department.   Ms. Lemon thanked the Council for the invitation and the continued support and cooperation with the Probation Agency.

6)      COMMUNICATIONS FROM THE AUDIENCE:

Mr. Lona1575 Shamrock Ct. asked council about the requested stop lights at the corners of 7th and Palm, 7th and F Street, Poso and Palm and Filburn and Hwy 43.

7)      CONSENT CALENDAR:
a)      Approval of Minutes from the Following Meeting:
Regular Meeting on July 1, 2008

b)      Approval of Bill Paying List.

c)      Acceptance of Sheriff’s Activity Report for the Month of June 2008.

d)      Acceptance of Monthly Building Permit Report for June 2008

e)      Acknowledge Receipt of Correspondence.

f)      Approve the Reading of All Ordinances and Resolutions by Title Only and  
      Approve Publication of All Ordinances in Summary Form.


Mayor Wegman asked for comment or questions, hearing none, Member Cortez made a
motion to approve, 2nd by Member Espitia.  Motion carried with a 5-0-0 vote.

8)      Report, Public Hearing, and Possible Approval, RE:  A CDBG Program Grantee Performance Report for the City of Wasco.  (Zervis)

Mayor Wegman opened the public hearing.
Finance Director Zervis gave report.  
Zervis told the audience that translation was available.
Zervis circulated a sign in sheet through the audience.
Zervis presented the required reading.

Mayor Wegman asked if there were questions or comments, hearing none closed the public hearing at 7:25 p.m.

Member Cortez made a motion to approve, 2nd by Member West.  Motion carried with the following vote:
AYES:        Wegman, Cortez, Espitia, Hively, and West.
        NOES:        None
        ABSTAIN: None
        ABSENT:   None
        
9)       Report and Possible Approval, RE: 08-2551 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING AN APPLICATION TO THE CALIFORNIA DEPARTMENT OF WATER RESOURCES FOR FUNDING UNDER THE 2008 URBAN DROUGHT ASSISTANCE GRANT PROGRAM; THE EXECUTION OF A STANDARD AGREEMENT IF SELECTED FOR FUNDING; AND AUTHORIZING THE MAYOR (OR MAYOR PRO TEM, IN MAYOR’S ABSENCE) TO SIGN CONTRACT DOCUMENTS AND ANY AMENDMENTS THERETO WITH THE STATE OF CALIFORNIA FOR THE PURPOSES OF THIS GRANT. (Zervis)

Finance Director Zervis gave report and staff recommended approval.
Mayor Wegman asked for comment or questions.  Hearing none, Member West made a motion to approve, 2nd by Member Hively.  
Motion carried with the following vote:

10)     Report and Possible Approval, RE: 08-2552 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING THE PREVIOUSLY DESIGNATED REDEVELOPMENT SURVEY AREA.  (Zervis)

Finance Director Zervis gave report and staff recommended approval.
Mayor Wegman asked for comment or questions.  
Member Cortez asked for clarification of the expansion, staff answered.  Member West asked if future annexations could or would be automatically included in survey area.  Staff answered that annexations would come back before council.
Member Cortez asked for clarification on the study area and ethical restrictions of voting.  Attorney Plaza answered that restrictions did not apply for this vote.
Mayor Wegman asked for any further comment or questions.  Hearing none, Member West made a motion to approve, 2nd by Member Hively.
 
Motion carried with the following vote:
AYES:        Wegman, Cortez, Espitia, Hively, and West.
        NOES:        None
        ABSTAIN: None
        ABSENT:   None

11)     Report and Possible Approval, RE:  08-2553 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING AN ENGAGEMENT LETTER FOR SERVICES BETWEEN THE CITY OF WASCO AND ALBERT & ASSOCIATES, LLP TO CONDUCT THE ANNUAL CITY AUDIT AND RELATED SERVICES FOR THE FISCAL YEAR ENDED JUNE 30, 2008; AND ANY RELATED DOCUMENTS NECESSARY TO COMPLETE THE ENGAGEMENT. (Zervis)

Finance Director Zervis gave a brief report and recommended approval.
Mayor Wegman asked for comment or questions, hearing none, Member Espitia made a motion to approve, 2nd by Member Cortez.
Motion carried with the following vote:

12)     Report and Possible Approval, RE:  08-2554 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO ABANDONING A PORTION OF RIGHT-OF-WAY ALONG STATE ROUTE 46 BETWEEN POPLAR AVENUE AND PALM AVENUE IN FAVOR OF THE CALIFORNIA DEPARTMENT OF TRANSPORTATION. (Allen)

Public Works Director Allen gave a brief report and recommended approval.
Mayor Wegman asked for comment or questions, hearing none, Member Cortez made a motion to approve, 2nd by Member Espitia.
Motion carried with the following vote:
AYES:        Wegman, Cortez, Espitia, Hively, and West.
        NOES:        None
        ABSTAIN: None

13)     Report and Possible Minute Action, RE: Designation of Voting Delegate and Alternate Voting Delegate to the 2008 League of California Cities Annual Conference.  (Mayor Wegman)
Mayor Wegman nominated Member Hively as the delegate and herself as the alternate.
Member Espitia made a motion to approve nomination, 2nd by West.  Motion carried with a 5-0-0 vote.

14)     Report:  Status Report on Repair of the Asphalt Road on Scofield Avenue. (Allen)
Public Works Director Allen gave report of repair on Scofield.  He reported of sub grade failures and that staff learned a how to prevent and or repair when this happens.  The road will be open by Friday evening for traffic.
        
15)     REPORTS FROM CITY STAFF
Johnson: asked for time from council members to meet and talk about their goals for the city.
        Allen: gave a progress report on E Street, D Street and Broadway.
        Zervis: gave a report on Prop 1B funding.
Sgt. Lee: Thanked Council for SAL building and reported that there are two new deputies in town, progress report on 6 week old assault case, and the department paperless reporting system.
Hight: reported that the nomination period for the November 4, 2008 election opened July 14, and closes August 8, at 5:00 p.m.

16)     REPORTS FROM CITY ATTORNEY
Plaza: Reminded Council to give her input on the EIR legal challenge.

17)     REPORTS FROM CITY MANAGER-none

18)     REPORTS FROM CITY COUNCIL
Mayor Wegman welcomed Mr. Johnson and thanked him for the opportunity to speak with him.

19)     CLOSED SESSION- none

20)     ADJOURNMENT Member Espitia made a motion to adjourn to regular Wasco Redevelopment Agency Meeting @ 7:57 p.m., 2nd by Member West.  Motion carried.
