1) CALL TO ORDER: Mayor Espitia called the meeting to order at 7:01 p.m.

Member Wegman asked that tonight’s meeting be dedicated in memoriam BettyLou Ellis.

g) Second Reading and Possible Adoption of an Ordinance, RE: 2007-553 AN ORDINANCE OF THE CITY COUNCIL OF CITY OF WASCO AMENDING TITLE 17 ZONING TO AMEND SECTION 17.79 (PROPERTY MAINTENANCE), TABLE 17-1 (PERMITTED AND CONDITIONALLY PERMITTED USES IN NON-RESIDENTIAL ZONES) AND TABLE 17-3 (PERMITTED AND CONDITIONALLY PERMITTED USES IN RESIDENTIAL ZONES) AS SHOWN IN EXHIBIT A.
h) Acknowledge Receipt of Correspondence.
i) Approve the Reading of All Ordinances and Resolutions by Title Only and
Approve Publication of All Ordinances in Summary Form.
City Manager Mittag pulled the bill paying list.
Member Wegman made a motion to approve the remaining calendar, 2nd by Member
West. Motion carried with the following vote:
AYES: Espitia, Wegman and West.
NOES: None
ABSTAIN: None
ABSENT: Cortez, Hively,
City Clerk Hight read the ordinance title.
Member West made a motion to approve the bill paying list with the exception of the Attorneys billing, 2nd by Member Wegman. Motion carried with the following vote:
3-0-2. Members Cortez and Hively absent.
8) Acceptance of Monthly Financial Report Related to Status of Quimby Fee Account.
City Manager Mittag reported that there was no change in the report from last month.
No action taken.
9) Report, Public Hearing and Possible Introduction of an Ordinance, RE: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING THE WASCO CODE OF ORDINANCES TO AMEND TITLE 17 OF THE CITY OF WASCO ZONING ORDINANCE (ZOTA 07-13) IN AMENDING TITLE 17, CHAPTERS 17.19 (RESIDENTIAL DISTRICT DESIGN STANDARDS) AND TABLE 17-3 AND 17-4 AS REFLECTED IN EXHIBIT A. (McNamara)
Mayor Espitia opened the public hearing. Sr. Planner McNamara gave a report of the amendment.
There was discussion regarding the standards and the need to meet State Law.
Member Wegman questioned the size of secondary dwellings.
Mayor Espitia questioned secondary homes with second stories.
Mayor Espitia asked for comments from the audience, there were none.
Mayor Espitia closed the public hearing at 7:19 p.m.
Member West made a motion to approve the first reading, 2nd by Member Wegman. Motion carried with the following vote:
AYES: Espitia, Wegman and West.
NOES: None

10) Report and Possible Approval, RE: 2007-2481 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING THE CONTRACTUAL AGREEMENT BETWEEN THE DEPARTMENT OF TRANSPORTATION AND THE CITY OF WASCO FOR THE UTILIZATION OF 5311 MONIES ALLOCATED UNDER THE FEDERAL TRANSIT ACT FOR 4 BUS SHELTERS AND, AUTHORIZING THE CITY MANAGER TO EXECUTE ALL RELATED DOCUMENTS. (Allen)
Public Works Director Allen gave a brief report and requested approval of agreement for fixed route bus shelters for the community.
Mayor Espitia asked for comments, there were none.
Member Wegman made a motion to approve, 2nd by Member West. Motion carried with the following vote:

11) Report, Public Hearing and Possible Introduction of an Ordinance, RE:
Mayor Espitia opened the public hearing.
a) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO REPEALING THE EXISTING 15.04 AND ENACTING NEW CHAPTER 15.04 OF THE CITY OF WASCO MUNICIPAL CODE, AND ADOPTING BY REFERENCE THE CALIFORNIA CODE OF REGULATIONS TITLE 24, 2007 EDITION OF THE CALIFORNIA BUILDING STANDARDS CODE. (Glaser)
b) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO, COUNTY OF KERN, STATE OF CALIFORNIA REPEALING CHAPTER 15.08 AND ADDING NEW CHAPTER 15.08 TO THE CITY OF WASCO MUNICIPAL CODE, WHICH INCLUDES ADOPTION OF THE 2007 CALIFORNIA FIRE CODE AS MODIFIED BY KERN COUNTY ORDINANCE CODE CHAPTER 17.32. (Glaser)
Chief Building Inspector Glaser gave a brief report, repealing Title 15, Chapters 15.04 and 15.08 and replacing them with the amended Chapters to meet State standards.
Glaser reported that the fireworks update section 5.32.070E was mistakenly omitted and would be brought back to Council.
Mayor Espitia asked for comments, there were none.
Mayor Espitia closed the public hearing at 7:28 p.m.

12) REPORTS FROM CITY STAFF
Executive Assistant Rodriguez reminded council of the Christmas Parade on December 3rd.
Finance Director Zervis reported that staff and Mrs. Cooper were working on a solution to the cargo container in her yard. Zervis also reported that the abandoned property on Hwy 46 and Magnolia is being cleared.
Public Works Director Allen reported 9th street is paved, the 5th street project is progressing, and that traffic studies will soon be under way on Poso, Palm and Central.

Wegman encouraged staff and fellow councilmember’s to attend the Blueprint meeting on the 28th at the Veterans Hall and asked staff to send flyers to local organizations, making them aware of the meeting.
She also reported on the deficits found in the Caltrans report on the State of CA. for funding.
