TUESDAY, November 6, 2007 – 7:00pm
        

1)      CALL TO ORDER:  Mayor Espitia called the regular meeting to order at 7:00 p.m.
2)      FLAG SALUTE
3)      INVOCATION:  Pastor Scott Allred of the First United Methodist Church delivered the invocation.

4)      ROLL CALL: Mayor Espitia, Member Cortez, Wegman, West.   Member Hively absent
  Attorney E Plaza, City Manager Mittag, City Clerk Hight, Executive Assistant Rodriguez, Finance Director Zervis, Public Works Director Allen, Interim Planning Director Raper, Sgt Lee

5)      PRESENTATIONS AND AWARDS - None

6)      COMMUNICATIONS FROM THE AUDIENCE:
Jose Lona 575 Shamrock Ct.  spoke in support of enacting a speed limit on Hwy 43, the entrance to Wasco.
        Mr. Lona also spoke in favor of certain pedestrian crosswalks around town.
Susie Cooper will wait to speak on cargo containers as it is an agendised item for tonight’s meeting.
Rayna Alverado spoke on the need for a lighted crossing or controlled crossing at 6th and G streets.

7)      CONSENT CALENDAR:

a)      Approval of Minutes from the Following Meeting:
Regular Meeting October 16, 2007

b)      Approval of Bill Paying List.

c)      Report and Possible Acceptance of the low bid proposal for janitorial services from Morris Janitorial and authorize the City Manager to sign all contracts pertaining to this bid.

d)      Report and Possible Approval of Transfer of Revenue Acquired from Salvage.

e)      Report and Possible Approval, RE: #2007-2478 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING APPLICATIONS AND CONTRACT EXECUTION FOR FUNDING FROM THE SAFE ROUTES TO SCHOOL PROGRAM OF THE STATE DEPARTMENT OF TRANSPORTATION AND AUTHORIZING THE CITY MANAGER TO SIGN CONTRACT DOCUMENTS AND ANY AMENDMENTS THERETO WITH THE STATE OF CALIFORNIA FOR THE PURPOSES OF THIS GRANT.

f)      Second Reading and Possible Adoption of an Ordinance, RE: 2007-552 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING TITLE 8 OF THE WASCO MUNICIPAL CODE TO REQUIRE RESIDENCY RESTRICTIONS FOR REGISTERED SEX OFFENDERS.

g)      Report and Possible Minute Action, RE:  Approval of Site License Agreement for Tower at 764 E Street and Authorize City Manager to Execute All Related Documents. (Mittag)

h)      Acknowledge Receipt of Correspondence.

i)      Approve the Reading of All Ordinances and Resolutions by Title Only and  
      Approve Publication of All Ordinances in Summary Form.


Member Wegman made a motion to approve remaining calendar, 2nd by Member West.  All in favor, motion carried with the following vote.
AYES:        Espitia, Cortez, Wegman and West.
        NOES:        None
        ABSTAIN: None
        ABSENT:   Hively

8)      Report, Public Hearing and Possible Approval, RE: #2007-553 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING THE WASCO CODE OF ORDINANCES TO AMEND TITLE 17 OF THE CITY OF WASCO ZONING ORDINANCE IN AMENDING TITLE 17, CHAPTERS 17.79 PROPERTY MAINTENANCE AND TABLE 17-1 AND 17-3 AS REFLECTED IN EXHIBIT A. (Raper)
Mayor Espitia opened the public hearing.
Interim Planning Director Raper gave a report of letters being sent to affected property owners.  Staff also explained that according to 17.79.03 single family residential homes are prohibited from having cargo containers on their property.

Susie Cooper 1820 spoke in opposition to the ordinance and wanted a solution from council on what to do with her container that is on her property.

Keith Henderson 651 Beckes spoke in opposition stating that he has had a container on the property for some time.

        John Olson 1916 Poso opposed.

        Staff gave instructions for individuals to apply for a Conditional Use Permit with the planning department.
There was also a brief discussion regarding a solution for a trade of a shed for the property owner and a cargo container for the city.  Staff will meet with Mrs. Cooper to work on a solution.
Mayor Espitia closed the public hearing at 7:42 p.m.
        
        Member West made a motion to continue to the next meeting.

        There was further discussion regarding the nature of this amendment.
        
        Member West’s motion died for lack of second.

        Member Cortez made a motion to waive the first reading and adopt the Ordinance, 2nd by Member Wegman.
All in favor motion carried with the following vote.
AYES:        Espitia, Cortez, Wegman and West.
        NOES:        None
        ABSTAIN: None
        ABSENT:   Hively

9)      Report and Possible Approval, RE: 2007-2479 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO ESTABLISHING REIMBURSEMENT POLICY AND PROCEDURE FOR SUBDIVISION IMPROVEMENTS AND PUBLIC WORKS PROJECTS. (Raper)
Interim Planning Director gave a brief report regarding the adoption of the resolution would set a policy for staff when seeking reimbursement for infrastructure improvements.  
Mayor Espitia asked for comments from the public, there were none.

Member Cortez made a motion to approve remaining calendar, 2nd by Member West.  All in favor, motion carried with the following vote.
AYES:        Espitia, Cortez, Wegman and West.
        NOES:        None
        ABSTAIN: None
        ABSENT:   Hively

10)     Report and Possible Approval, RE: 2007-2480 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO ACCEPTING THE PROJECT FUNDING LIST FOR THE FISCAL YEAR 2007-08 ALLOCATION OF PROPOSITION 1B FUNDS. (Zervis)
Finance Director Zervis gave a brief report of 1B projects.

Mayor Espitia asked for comments, there were none.

Member Wegman made a motion to approve, 2nd by Member Cortez.  All in favor, motion carried with the following vote.
AYES:        Espitia, Cortez, Wegman and West.
        NOES:        None
        ABSTAIN: None
        ABSENT:   Hively  
        City Clerk Hight read the resolution title

11)     Report and Request for Direction Regarding the Proposed Revisions to Wasco Municipal Code 5.16.120 Governing Prohibitive Conduct of Food Vending Vehicles. (Zervis)
Finance Director Zervis asked for direction and explained the proposed revisions to the existing ordinance.  Council gave direction and instructed staff to bring back proposal for vote at a future meeting.  No action taken.

12)     Report and Possible Minute Action, Re: Consider Filling Vacancy on Parks and Recreation District and Planning Commission. (City Clerk Hight)

City Manager Mittag gave a brief report and asked for council direction.   Member West suggested that the committee of Member Wegman and himself meet to discuss further direction and the setting of interviews.
No further action taken.

13)     REPORTS FROM CITY STAFF
Zervis: CDBG 35,000 grant funding and that Rosie Mosqueda had her baby.
Allen: reported that the 5th street project is progressing and the reorganization of the green waste management fees.

Sgt. Lee: brief staff report of activity in the city.

14)     REPORTS FROM CITY ATTORNEY: None

15)     REPORTS FROM CITY MANAGER: Commended the Sheriffs Department Deputies who spotted the fires and called for assistance.

16)     REPORTS FROM CITY COUNCIL
Cortez: Asked staff to look in to the possibility of a stop light or controlled stop at the intersection of Filburn and Palm Ave.

17)     CLOSED SESSION – NONE

18)     ADJOURNMENT to Wasco Redevelopment Agency Meeting.  Mayor Espitia adjourned to the RDA at 8:18 p.m.
