City Council Chambers
        

1)      CALL TO ORDER Mayor Espitia called the meeting to order at 7:01 p.m.
2)      FLAG SALUTE
3)      INVOCATION:  Pastor Bill Lewis of Griffith Avenue Baptist Church offered the invocation.
4)      ROLL CALL: Mayor Espitia, Members: Cortez, Hively, Wegman, West
        Assistant Attorney  Plaza, City Manager Mittag, City Clerk Hight, Executive Assistant Rodriguez, Finance Director Zervis, Public Works Director Allen, City Projects Manager Wren, Interim Planning Director Raper, Human Resource Manager Randhawa, Sgt Lee

5)      PRESENTATIONS AND AWARDS:  Hillary Baird, Regional Public Affairs Manager, South San Joaquin Valley Division League of California Cities.
        Ms Baird was not present and Mayor Espitia moved forward on the agenda.

6)      COMMUNICATIONS FROM THE AUDIENCE:

Interim Planning Director Jake Raper introduced new employee Assistant Planner Zoraida
Cruz to the Council

        Member Wegman made a motion to return to item (5) Presentations and Awards as Ms. Baird         arrived, 2nd by Member Cortez.  All in favor motion carried.

Hillary Baird, Regional Public Affairs Manager, South San Joaquin Valley Division League of California Cities presented certificate’s of appreciation to Member Wegman and Mayor Espitia for their involvement with the League.

Member Wegman made a motion to return to item (7) Consent Calendar, 2nd by Member Cortez.  All in favor motion carried.

7)      CONSENT CALENDAR:

a)      Approval of Minutes from the Following Meeting:
Regular Meeting September 4th
Special Joint Meeting September 18th

b)      Approval of Bill Paying List.

c)      Report and Possible Approval to Authorize staff to accept and award lowest qualifying bid for uniform service contract to AmeriPride Corp. and Authorize City Manager to Execute Contract.

d)      Second Reading and Possible Adoption of an Ordinance, RE: 07-551 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING ZONE CHANGE 07-01 REGARDING CERTAIN REAL PROPERTY IN THE CITY OF WASCO.

e)      Second Reading and Possible Adoption of an Ordinance, RE: 07-542 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING WASCO MUNICIPAL CODE, TITLE 17, ZONING, CHAPTER 17.75 PERMIT PROCEDURES.

f)      Second Reading and Possible Adoption of an Ordinance, RE: 07-543 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING WASCO MUNICIPAL CODE, TITLE 17, ZONING, TO ADD CHAPTER 17.66 RIGHT TO FARM.

g)      Second Reading and Possible Adoption of an Ordinance, RE: 07-544 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING WASCO MUNICIPAL CODE, TITLE 17, ZONING, TO ADD CHAPTER 17.64 WILLIAMSON ACT REGULATIONS.

h)      Second Reading and Possible Adoption of an Ordinance, RE: 07-545 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING WASCO MUNICIPAL CODE, TITLE 17, ZONING, CHAPTER 17.51 DESIGN DISTRICTS, SECTION 17.75.05 HWY 46 DESIGN CORRIDOR.

i)      Second Reading and Possible Adoption of an Ordinance, RE:  07-546 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING WASCO MUNICIPAL CODE, TITLE 17, ZONING, AMENDING 17.54 PRECISE DEVELOPMENT (P-D) COMBINING DISTRICT/PERMIT REVIEW GUIDELINES.

j)      Second Reading and Possible Adoption of an Ordinance, RE:  07-547 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING WASCO MUNICIPAL CODE, TITLE 17, ZONING, TO ADD CHAPTER 17.68 MINERAL EXTRACTION.

k)      Second Reading and Possible Adoption of an Ordinance, RE: 07-548 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING WASCO MUNICIPAL CODE, TITLE 17, ZONING, TO ADD CHAPTER 17.67 OIL AND GAS PRODUCTIONS.

l)      Second Reading and Possible Adoption of an Ordinance, RE:  07-549 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING THE WASCO CODE OF ORDINANCES TO AMEND TITLE 16 OF THE CITY OF WASCO SUBDIVISION ORDINANCE IN AMENDING PLATES R-1 AND R-2.

m)      Second Reading and Possible Adoption of an Ordinance, RE:  07-550 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING THE WASCO CODE OF ORDINANCES TO AMEND TITLE 16 OF THE CITY OF WASCO SUBDIVISION ORDINANCE IN AMENDING PLATE D-5 DRAINAGE BASIN SCREENING.

n)      Acknowledge Receipt of Correspondence.

o)      Approve the Reading of All Ordinances and Resolutions by Title Only and  
      Approve Publication of All Ordinances in Summary Form.

Member Cortez requested that items D – M be pulled for vote.

Member West made a motion to approve the remaining calendar, 2nd by Member Cortez.

Member West made a motion to approve items D – M, 2nd by Member Hively, Motion carried with the following vote:

AYES:        Espitia, Hively, Wegman and West.
        NOES:        None
        ABSTAIN: Cortez
        ABSENT:   None

8)      Report and Possible Approval, RE: 2007-2474 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO IN THE MATTER OF THE APPLICATION OF RAMON OLIVAS FOR CONDITIONAL USE PERMIT 07-02 LOCATED AT 1204 E STREET DISAPPROVAL. (Raper)
Mayor Espitia recused himself and gave the gavel to Mayor Pro Tem Cortez.
Mayor Pro Tem Cortez opened the item and asked if there were any questions from council or public.  There were none.
Interim Planning Director Raper gave a brief report.
Member Hively made a motion to approve resolution, 2nd by Member Wegman.  Motion carried with the following vote:
AYES:        Cortez, Hively, Wegman
        NOES:        None
        ABSTAIN: Espitia and West
        ABSENT:   None
        City Clerk Hight read the resolution title.

9)      Report and Possible Minute Action, RE: Wasco Recreation and Parks District Appointments. (Councilmembers Hively & Wegman)
Member Hively reported that he and Member Wegman met and interviewed two applicants for appointment to the Recreation and Parks Board.  Their recommendation for the appointment was Richard Reding.
Member Hively made a motion to appoint Richard Reding for the appointment, 2nd by Member Wegman.  Motion carried with a 4-0-1 vote.  Mayor Espitia abstained.

Mayor Pro Tem Cortez returned the gavel to Mayor Espitia.

10)     Report and Possible Minute Action, RE: Consider Approval and Execution of a Production Agreement with DataProse, Inc. for Outsourcing the Printing and Mailing of Utility Bills.
Finance Director Zervis gave a brief report.  There was discussion regarding possible future services related to this agreement, monthly cost and related staffing issues.
 
Member Wegman made a motion to approve, 2nd by Member Cortez.  Motion carried with a 5-0-0 vote.

11)     Report and Possible Minute Action, RE: Consider Approval of Extension for Wastewater Municipal Farm Lease and Authorization of Mayor to Execute the Agreement.

Public Works Director Allen gave a brief report and recommended approval.  

Mayor Espitia asked for public comment.  There were none.

Member Wegman made a motion to approve, 2nd by Member West.  Motion carried with a 5-0-0 vote.
        
        Mayor Espitia recused himself and gave the gavel to Mayor Pro Tem Cortez

12)     Report and Possible Minute Action, RE: Consider Revised Agreement with Wasco Recreation and Parks District for Operation and Maintenance of Parks for July 2007 – June 2008.
City Manager Mittag gave a brief report of changes made in the agreement; therefore it is being brought back to council again.  

Mayor Pro Tem Cortez asked if there were any questions or comments.  There were none.

Member Wegman made a motion to approve, 2nd by Member Hively.  Motion carried with a 4-0-1 vote.  Mayor Espitia abstained.

13)     Discuss Use of Vacant City Property at the Northeast Corner of 8th Street and G Street.
City Manager Mittag requested direction from council regarding the use of the property.
There was discussion regarding the relocation of the Historical Society to the property, community input and the creation of a committee.  Direction was given to bring back at the next meeting.  No further action taken.

14)     Report and Possible Minute Action, RE:  Consider Approval of Retainer Agreement with Remy, Thomas, Moose and Manley, LLP and Authorize City Manager to Execute the Agreement.
Interim Planning Director Raper reported that this agreement would provide independent legal service to review the EIR and ensure all legal requirements are met.

Mayor Espitia asked if there were any questions or comments.
Member West inquired about the depth of review regarding land use.  Staff answered.

With no further comments, Member Cortez made a motion to approve, 2nd by Member Hively.  Motion carried with a 5-0-0 vote.

15)     Report and Possible Minute Action, RE:  Consider Support for Measure G, a Local School Improvement Measure.  
City Manager Mittag asked for direction.

Mayor Espitia and Member Cortez spoke in support.

Member Cortez made a motion to approve and support, 2nd by Member West.  Motion carried with a 4-0-1 vote.  Member Hively abstained.

16)     REPORTS FROM CITY STAFF

City Clerk Hight read the Resolution title to item (8)
RE: 2007-2474 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO IN THE MATTER OF THE APPLICATION OF RAMON OLIVAS FOR CONDITIONAL USE PERMIT 07-02 LOCATED AT 1204 E STREET DISAPPROVAL.

Raper: reported that notices are being sent to property owners who are within 300 feet of the Rose City Industrial Park.

Zervis: reported that the County Board of Supervisors approved the Tax Share for Annexation 39 and money should be coming in this year.
The audit is moving along and should be available next month.
Rosie Mosqueda is gone on maternity leave.

        Allen: 5th Street Waterline project is progressing and notices are sent out.
        Staff is beginning reconstruction of Scofield Road 650 feet from north to south of the Prison and       500 feet from the county line   north on the 15th of this month.

        REPORTS FROM CITY ATTORNEY-None

17)     REPORTS FROM CITY MANAGER
Commended public works for their efforts on the two projects underway at this time.

18)     REPORTS FROM CITY COUNCIL
Hively: stated doubts regarding viability of Ethanol Plants.
West: inquired of Clerks office if in fact Ms Hardin had resigned from the Wasco Housing Authority.
Cortez: requested information regarding detailed billing from City Attorneys office and update on Granicus.
Espitia: Commended Public Works for jobs well done.

20)     ADJOURNMENT:  Member Wegman made a motion to adjourn to RDA at 7:59 p.m.
All in favor, motion carried 5-0-0.
