TUESDAY, August 21, 2007 – 7:00pm
1. CALL TO ORDER: Mayor Espitia called the meeting to order at 7:00 p.m.

6. COMMUNICATIONS FROM THE AUDIENCE:
Marty Jones 2200 Garden St. asked the council to “let the people of Wasco have a voice.”
Tracy Jones 2200 Garden St. read scripture.
Susanna Rios 2332 Sharon Ct. reported that the recall petitions are being circulated and that they are deemed confidential.
Vanessa Michelle 1216 Berkshire Rd. Bakersfield, thanked the Council, and staff for their support and information in the writing of her thesis.
7. CONSENT CALENDAR:
a)Approval of Minutes from the Following Meeting:
Regular Meetings on August 7, 2007
b)Approval of Bill Paying List.
c)Acceptance of Sheriff’s Activity Report for the Month of July 2007.
d)Acceptance of Code Enforcement Reports:
Wasco Code Compliance Officer – July 2007
Fire Prevention Services – July 2007
e)Acceptance of Monthly Building Permit Report for July 2007.
f)Acknowledge Receipt of Correspondence.
g) Approve the Reading of All Ordinances and Resolutions by Title Only and Approve Publication of All Ordinances in Summary Form.
Member Cortez pulled item 7b for discussion.
Member Cortez made a motion to approve remaining calendar, 2nd by Member West. All in favor motion carried with a 4-0-1 vote. Member Wegman absent.
There was a brief discussion regarding the bill paying list. Member West made a motion to approve, 2nd by Member Hively. Motion carried with a 3-1-0-1 vote. Member Wegman absent and Member Cortez opposed.
8. Acceptance of Monthly Financial Report Related to Status of Quimby Fee Account.
Mayor Espitia abstained from item and gave the gavel to Mayor Pro Tem Cortez.
There was discussion regarding setting a meeting with the Wasco Parks and Recreation Board.
Member Hively made a motion to accept monthly report, 2nd by Member West. Motion carried with a 3-0-1-1 vote. Member Wegman absent, Mayor Espitia abstained.
9. Report and Possible Approval, RE: 2007-2463 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING TAX REVENUE EXCHANGE AGREEMENT CONCERNING CITY OF WASCO ANNEXATION NO. 39 (Zervis)
Finance Director Zervis gave report and introduced the resolution. There were no comments or questions. Member Cortez made a motion to approve, 2nd by member Hively. Motion carried with the following vote:
AYES: Espitia, Cortez, Hively and West.
NOES: None
ABSTAIN: None
ABSENT: Wegman

10. Report and Possible Approval, RE: 2007-2462 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO AUTHORIZING THE SIGNATURE OF THE CERTIFICATE OF ACCEPTANCE FOR THE STREET RIGHT-OF-WAY DEED GRANTED BY THE WASCO HIGH SCHOOL DISTRICT OVER A PORTION OF PALM AVENUE. (Wren)
Member Hively abstained from item.
City Projects Manager Wren gave report and introduced the resolution. There were no comments or questions. Member Cortez made a motion to approve, 2nd by member West.
Motion carried with the following vote:
AYES: Espitia, Cortez and West.
NOES: None
ABSTAIN: Hively

11. Report and Possible Approval, RE: 2007-2461 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING THE REVISED CONTRACTUAL AGREEMENT BETWEEN THE COUNTY OF KERN AND THE CITY OF WASCO FOR COUNTY PROVISION OF FIRE PROTECTION DUTIES AND ENFORCEMENT OF STATE FIRE MARSHAL REGULATIONS. (Zervis)
Finance Director Zervis gave the report and introduced the resolution. There was a brief discussion regarding terms and services.
Deputy Fire Chief Phil Castle gave a brief report of history of the City of Wasco and Fire Services from the county.
Member Cortez made a motion to approve, 2nd by Member West. Motion carried with the following vote:
AYES: Espitia, Cortez, Hively and West.
NOES: None
ABSTAIN: None
ABSENT: Wegman

12. Report and Possible Introduction of an Ordinance, RE: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO, CALIFORNIA, AMENDING TITLE 1 OF THE WASCO MUNICIPAL CODE BY ADDING CHAPTER 1.20 ENTITLED “ADMINISTRATAIVE CITATIONS,” WHICH ESTABLISHES PROCEDURES FOR ISSUING AND ENFORCING ADMINISTRATIVE CITATIONS AND AMENDING CHAPTER 1.08 REGARDING FINE AMOUNTS FOR MISDEMEANORS AND INFRACTION OFFENCES. (Zervis)
Finance Director Zervis stated that this was a discussion item only and was seeking direction from Council before proceeding.
There was a brief discussion regarding advisory council and who they would be.
Gordon Drescher opposed and spoke of weed abatement issue.
Susie Rios 2434 Sharon Ct. opposed.
Gary Jones 2200 Jubilee asked about low income families in town and how they would pay fee.
Marty Jones 2200 Garden cautioned Council regarding a revenue stream.
Doug Laughlin 1609 5th Place did not think this would work, he has had a problem for over 8 months that still has not been addressed.
Member West suggested the formation of a committee to review the item.
Member Hively made a motion to set a committee to review and make a recommendation, 2nd by Member West. Mayor Espitia appointed Members West and Hively to the committee. Motion carried with a 4-0-1 vote. Member Wegman absent.
13. Report and Possible Minute Action, RE: Consider Sale of City Owned Vehicles, Equipment and Scrap Metals as Salvage. (Allen)
Public Works Director Allen gave report and asked for approval to proceed. There were no questions or comments.
Member Cortez made a motion to approve, 2nd by Member Hively. Motion carried with a 4-0-1 vote. Member Wegman absent.
14. Report and Possible Minute Action, RE: Consider Appeal Fee Reduction or Waiver of Planning Commission Action per Request by Mr. Gerardo Rios. (Raper)
Interim Planning Director Raper gave report and asked for direction.
There was a brief discussion regarding the fee process.
Susanna Rios 2332 Sharon Ct questioned the process for determining fees.
Member Cortez made a motion directing staff to revisit the fee structure and waive this appeal fee for Mr. Rios, 2nd by member West. Motion carried with a 3-0-1-1 vote. Member Wegman absent, Mayor Espitia Abstained.
15. Report and Possible Minute Action, RE: Consider Draft Ordinance Concerning City Council Meetings and Other Procedures. (Garcia)
City Attorney Garcia gave report stated that this was a discussion item only and was seeking direction from Council before proceeding.
Marty Jones 2200 Garden St. Cautioned Council about proceeding with item.
Korinna Campbell 2680 Silvertree Lane opposed.
Susanna Rios 2332 Sharon Ct. opposed.
Member Hively suggested the formation of a committee.
Member Cortez made a motion to not proceed.
No action taken.
16. Report and Award Bid to Qualified Contractor for 7th Street Project and Authorize City Manager to Execute All Related Documents. (Wren)
City projects Manager Wren gave report and recommended rejection of bids. After brief discussion Member Cortez made a motion to reject all bids, 2nd by member Hively. Motion carried with a 4-0-1 vote. Member Wegman absent.
17. Report and Possible Minute Action, RE: Wasco Housing Authority Commissioner Appointments. (Mayor Pro Tem Cortez and Councilmember Hively)
Member Cortez gave a brief report and recommended Miguel Raya for the at large position on the Wasco Housing Authority Commission to fill vacated seat of Reggie Reyes.
Member Cortez made a motion to approve, 2nd by Member Hively. Motion carried with a 4-0-1 vote. Member Wegman absent.
18. REPORTS FROM CITY STAFF
Raper: Report on KFC and A&W progress.
Allen: City has completed waterline project on D street and will repave after Festival.
19. REPORTS FROM CITY ATTORNEY
Report of all legal activities has been submitted and is on file for review
20. REPORTS FROM CITY MANAGER
Ribbon Cutting at Hwy 46 and Griffith for the new Stop Light
21. REPORTS FROM CITY COUNCIL
West: ACAP regarding intervention funds.
Cortez: WRPD park subsidy contract has expired. Suggested a meeting with Wasco Recreation and Parks, WUHS and WUESD.

Mayor Espitia adjourned to RDA at 9:07 p.m.
Mayor Espitia reconvened regular meeting at 9:09 p.m.
