City Council Minutes
TUESDAY, September 5, 2006 – 7:00pm


1.      CALL TO ORDER- Mayor West called the meeting to order at 7:00 p.m.      
2.      FLAG SALUTE                                                             
3.      INVOCATION:  Pastor Jim Wheeler of Grace Community Church delivered the invocation.
4.      ROLL CALL: Mayor West, Council Members: Cortez, Pearson, Espitia and Wegman.  
        Others Present- City Manager Pennell, City Attorney L. Peake, City Clerk Hight, Executive       Secretary Krause, Finance Director Wooner, Public Works Director Jones, Superintendent of       Streets and City Projects Wren, Planning Director Woodcock, Sr. Planner McNamara.

5.      PRESENTATIONS AND AWARDS:
Mayor West presented a plaque to John Wooner for his dedication and service to the city of Wasco during his seven years of employment.  

6.      COMMUNICATIONS FROM THE AUDIENCE:
Paul Neufeld 947 Evergreen Ct. presented the Council and audience with a cake in celebration of closing escrow on the golf course.

Mayor West adjourned the meeting for 10 minutes for cake and punch.  

Reconvened at 7:23 p.m.
 
7.      CONSENT CALENDAR:

A) Approval of Minutes from the following Meetings:
Regular and Special Joint Meetings on July 18, 2006
Special Meeting on August 8, 2006
Special Joint Meeting on August 15, 2006
Special Meeting on August 22, 2006
B) Approval of Bill Paying List.

C) Acceptance of Building Permit Report for July 2006.

D) Approval of Bid Award to Griffith Company for the Wasco Sidewalk Improvements Project for installation of new sidewalk, curb and gutter at various locations along 6th Street between G Street and railroad tracks at a cost not to exceed $44,122.

E) Approval of a #06-2362 Resolution the City Council of the City of Wasco Declaring the Results of the Special Election held August 29, 2006 in Special Police Tax Area    
                Zone 2006-3.
F) Acknowledge Receipt of Correspondence.

G) Approve the Reading of All Ordinances and Resolutions by Title Only and  
      Approve Publication of All Ordinances in Summary Form.

Espitia made a motion to approve the calendar, 2nd by Pearson.  Motion carried with the following vote:
        AYES:        West, Cortez, Espitia, Pearson, and Wegman.
        NOES:        None
        ABSTAIN: None
        ABSENT:   None
        Attorney Peake read the resolution title.


8.      Report, Public Hearing and Possible Introduction of an Ordinance, RE: AN ORDINANCE AMENDING SECTION 17.19.01.(H)(4) OF THE CITY OF WASCO MUNICIPAL CODE RELATED TO THE DESIGN REQUIREMENTS FOR THE SITING OF MANUFACTURED HOUSING UNITS ON RESIDENTIAL LOTS
Mayor West opened the public hearing.  Woodcock gave a brief staff report.  There were no public comments.  Mayor West closed the public hearing at 7:25.  Pearson made a motion to approve, 2nd by Cortez.  Motion carried with the following vote:
        AYES:        West, Cortez, Espitia, Pearson, and Wegman.
        NOES:        None
        ABSTAIN: None
        ABSENT:   None
        Attorney Peake read the ordinance title.

9.      Report, Public Hearing and Possible Introduction of an Ordinance, RE: AN ORDINANCE AMENDING SECTION 17.79.06(P) OF THE CITY OF WASCO MUNICIPAL CODE RELATED TO THE USE OF PORTABLE CANOPIES AND PORTABLE CARPORTS
Mayor West opened the public hearing.  Woodcock gave a brief staff report.  

Vernice Priest, Palm Ave. spoke in favor of her canopy.
Dee Bolin 747 Oak spoke in favor of carports.
Steve Gair 416 Stacy Ct.  encouraged a decision and the enforcement of decision.
Doug Laughlin 1609 5th St. spoke in opposition of changing the ordinance.
After a lengthy discussion, Mayor West closed the public hearing at 7:40.

Cortez requested staff to bring back to council two options regarding grandfathering.
West requested staff to bring back to council an option of side-yard/rear-yard with no reference to front yard.

Cortez made a motion to continue the public hearing, 2nd by Pearson.  All in favor motion carried.

10.     Report, Public Hearing and Possible Approval, RE: A RESOLUTION OF THE CITY OF WASCO, CALIFORNIA, DECLARING ITS INTENTION TO VACATE A PORTION OF PALM AVENUE BETWEEN 5TH STREET AND 7TH STREET IN THE CITY OF WASCO, COUNTY OF KERN, STATE OF CALIFORNIA
        Mayor West opened the public hearing.  Pennell requested this be continued until Sept.  19th meeting.  
        Cortez made a motion to continue, 2nd by Espitia.  All in favor, motion carried.

11.     Report, Public Hearing and Possible Introduction of an Ordinance, RE: AN ORDINANCE OF THE CITY OF WASCO APPROVING ZONE CHANGE 06-08 REGARDING CERTAIN REAL PROPERTY IN THE CITY OF WASCO (located at the northeast corner of the intersection of Poso and Central Avenues) Mayor West opened the public hearing.  There were no comments from the audience.  Mayor West closed the public hearing at 7:55 p.m.  Cortez made a motion to approve, 2nd by Pearson.  Motion carried with the following vote.
                AYES:        West, Cortez, Pearson
                NOES:        Espitia, Wegman
                ABSTAIN: None
                ABSENT:   None
                Attorney Peake read the ordinance title.

12.     Report, Public Hearing and Possible Approval, RE: A GENERAL PLAN AMENDMENT RELATED TO PROPERTY INCLUDED IN ANNEXATION 39
        Mayor West opened the public hearing.  Pennell requested this be continued until Sept.  19th meeting.  Cortez made a motion to continue, 2nd by Espitia.  All in favor, motion  carried.

13.     Report and Possible Minute Action, RE:  Approval to contract with URS Corporation to provide contract planning services and Authorizing the City Manager to Negotiate Agreement
        Woodcock gave a brief explanation of action taken to secure position.  After a brief    discussion a motion was made by Cortez to approve, 2nd by Espitia.  All in favor        motion carried.

14.     Report and Possible Minute Action, RE: Recommendation to Appoint Rick Meridth, Eric Merz and Javier Carabarin to the Economic Development Committee. Pennell gave a brief staff report.  Wegman made a motion to approve, 2nd by Espitia.  All in favor motion carried

15.     Report and Possible Minute Action, RE: Committee Recommendation concerning Appointment to fill Wasco Housing Authority Board vacancy of unexpired term to expire May 18, 2009.  Pearson reported that the committee had received on applicant, Jerry Garza.  Cortez made a motion that this be tabled until and interview could be held, 2nd by Wegman.  All in favor, motion carried.

16.     Discussion and Possible Minute Action, RE: Possible Establishment of Building and Developer Fee Deferment Program.  Cortez requested that woodcock give an explanation of the deferment fee program.  After a lengthy discussion the Mayor requested that staff accumulate additional information and report back to council.
        Cortez made a motion to instruct staff to research and accumulate additional information as requested, 2nd by Pearson.  Motion carried with a 4-1-0 vote.  Wegman       opposed.
