WASCO CITY COUNCIL
MINUTES OF REGULAR MEETING
October 18, 2005


1)      CALL TO ORDER- Mayor Wegman called the meeting to order at 7:05 p.m.

2)      FLAG SALUTE.

3)      INVOCATION- Pastor Bill Lewis – Griffith Avenue Baptist Church.

4)      ROLL CALL- Present: Mayor Wegman, Council Members Pearson, Espitia, West & Cortez.
Staff Present: City Manager Pennell, City Attorney Peake, City Clerk Hight, Executive Secretary Krause, Finance Director Wooner, Public Works Director Jones, Planning Director Woodcock, Supt. of Streets & Projects Wren, Chief Building Inspector Glaser, Code Enforcer Reyes, Housing Supervisor Litten, Econ. Dev. Director Mittag and Sgt. McDonald.

6)      COMMUNICATIONS FROM THE AUDIENCE- NONE

7)      CONSENT CALENDAR: The Consent Agenda consists of items that in staffs' opinion are routine and non-controversial.  These items are approved in one motion unless a Councilmember or member of the public removes a particular item.

a)      Approval of Minutes from the following Meetings:
10/03/2005 Special Joint Meeting of City Council and Recreation & Parks District
10/04/2005 Special Joint Meeting of City Council and Wasco Planning Commission
10/04/2005 Regular City Council Meeting
b)      Approval of Bill Paying List.
c)      Sheriff’s Monthly Activity Reports for July and August 2005.
d)      Approval of No. 2005-2275 A Resolution of the City Council of the City of Wasco Approving Kern          Council of Governments Transportation Development Act Streets and Roads Claim for Fiscal Year                   2005-2006.
e)      Approval of a Bid Award to execute a Lease/Purchase Agreement with 3D Imaging Systems for Kyocera       KM-3035 Digital Printer/Copier for Public Works Department in the amount of $233 per month for 36                       months.
f)      Approval of a Resolution of the City of Wasco Approving the Final Subdivision Map,  
Improvement Plans, Improvement Security and Subdivision Agreement for Tract 6282 (Central Avenue, South of K-Mart), Accepting for Public Use all Dedications for the Purposes for which they are offered, Authorizing the City Manager to Execute the Subdivision Agreement, and Authorize the City Clerk to Endorse the Final Map and Transmit same to the County Clerk’s Office.

g)      Approval of Mid-Management Designation of Water Superintendent Position.
h)      Acceptance of September 2005 Building Permit Report.
i)      Acknowledge Receipt of Correspondence
j)      Approve the Reading of All Ordinances and Resolutions by Title Only and  
Approve Publication of All Ordinances in Summary Form.

City Manager Pennell asked that item “f” be removed from the consent calendar and be tabled for the November 1, 2005 meeting.

Councilmember Espitia asked that item “g” be removed for discussion.

Motion made by Pearson to approve the remaining consent calendar, 2nd by Cortez.  Motion carried with the following vote:

AYES:  Mayor Wegman, Council Members Pearson, Cortez, Espitia and West. NOES: NONE
ABSTAIN: NONE
ABSENT: NONE

Attorney Peake read the resolution title for item “d”.

After a brief discussion, Espitia made a motion to approve item “g”, 2nd by West.  All in favor, motion carried.

8.) Second Reading, Public Hearing and Possible Adoption of an Ordinance No. 05-501, RE: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING CERTAIN SECTIONS OF TITLE 15 OF THE WASCO MUNICIPAL CODE RELATED TO UNIFORM CODES Mayor Wegman opened the Public Hearing.  Chief Building Inspector Glaser gave a brief report.  There were no public comments. Public hearing closed at 7:11 p.m.

Motion made to adopt by West, 2nd by Pearson.  Motion carried with the following vote:

AYES: Mayor Wegman, Council Members Cortez, Pearson, Espitia and West.
NOES: NONE
ABSTAIN: NONE
ABSENT: NONE

9.) Report and Possible Approval of No. 2005-2276, A RESOLUTION OF THE CITY COUNCIL APPROVING THE FINAL SUBDIVISION MAP, IMPROVEMENT PLANS, IMPROVEMENT SECURITY AND SUBDIVISION AGREEMENT FOR TRACT 6449 PHASE 1 (East of Central Avenue, South of 7th Street), ACCEPTING FOR PUBLIC USE ALL DEDICATIONS FOR THE PURPOSES FOR WHICH THEY ARE OFFERED, AUTHORIZING THE CITY MANAGER TO EXECUTE THE SUBDIVISION AGREEMENT, AND AUTHORIZE THE CITY CLERK TO ENDORSE THE FINAL MAP AND TRANSMIT SAME TO THE COUNTY CLERK’S OFFICE.  Planning Director Woodcock gave a report.  

After a brief discussion a motion was made by Pearson to approve, 2nd by Cortez.  Motion carried with the following vote:

AYES: Mayor Wegman, Council Members Cortez, Pearson, Espitia and West.
NOES: NONE
ABSTAIN: NONE
ABSENT: NONE

10.)  SIDEWALK INSTALLATIONS –

Report and Possible Approval 2005-2277, A RESOLUTION OF THE CITY OF WASCO APPROVING GRANT FUNDS FROM THE WASCO REDEVELOPMENT AGENCY IN THE AMOUNT OF $4,335 TO VICTORIA JACKSON FOR SIDEWALK INSTALLATION AT 1000 D STREET. Housing Supervisor Litten gave a report.

Motion made by Cortez to approve, 2nd by West.  Motion carried with the following vote:

AYES: Mayor Wegman, Council Members Cortez, Pearson, Espitia and West.
NOES: NONE
ABSTAIN: NONE
ABSENT: NONE

Report and Possible Approval of No. 2005-2278,  A RESOLUTION OF THE CITY OF  WASCO APPROVING GRANT FUNDS FROM THE WASCO REDEVELOPMENT AGENCY IN THE AMOUNT OF $4,285 TO JOSE AND AMPARO VERDOZA FOR SIDEWALK INSTALLATION AT 1105 BROADWAY.  Housing Supervisor Litten gave a report.  

After a brief discussion a motion was made by Espitia to approve, 2nd by Cortez.  Motion carried with the following vote:

AYES: Mayor Wegman, Council Members Cortez, Pearson, Espitia and West.
NOES: NONE
ABSTAIN: NONE
ABSENT: NONE

11.)  Report and Possible Minute Action, RE: Possible Sale of Water Building Property located at Birch and 12th Streets.  After discussion, Councilmember Pearson made a motion to have staff look into the feasibility of the project, 2nd by Cortez.  All in favor, motion carried.

12.)  REPORTS FROM CITY ATTORNEY-NONE

13.)  REPORTS FROM CITY STAFF
Mittag reported on a $3500.00 PG&E grant for developing marketing tools.
Woodcock reported that there would be several planning applications coming before them very soon.
Wooner reported that Public Works has received $29,000 .00 from Prop 42.
Sgt. McDonald reported that they are looking into a daytime curfew ordinance similar to the one used by the City of Monrovia.

14.)  REPORTS FROM CITY MANAGER
Mr. Pennell reported on the following three items.
1. There will be a Kern County Transportation Forum on Wednesday October 18th.  He will be in attendance.
2. Commander Craig Porter has been promoted to Chief Deputy and reassigned to County Headquarters.
3. Recommended that tonight’s meeting be adjourned in Bonnie Johnson’s memory.

15.)  REPORTS FROM CITY COUNCIL
Pearson advised staff that it was time to take a look at front yard fencing, pool visibility and visual barriers.  He also asked that a code enforcement report be submitted each month.
Espitia inquired about the oiling of the local streets.
Mayor Wegman expressed her disappointment with the swimming pool issue at Palm and 1st .

Cortez made a motion to recess to the RDA at 7:57 p.m., 2nd by Pearson.  All in favor, motion carried.

Reconvened regular Council Meeting at 7:58 p.m.

16.)CLOSED SESSION - Annual) Performance Evaluation – City Manager
                Government Code Section 54957
Attorney Peake reported that the evaluation has been discussed and will be continued at the meeting on November 1, 2005.

Regular City Council meeting reconvened at 9:22 p.m.

17.)  ADJOURNMENT – 9:30 p.m.  Cortez made a motion to adjourn in memory of Bonnie Johnson, 2nd by Pearson.   All in favor, motion carried.
