WASCO CITY COUNCIL
MINUTES OF REGULAR MEETING
JULY 19, 2005

1.  CALL TO ORDER-  Mayor Wegman called the meeting to order at 7:00 p.m.

2.  FLAG SALUTE.

3.  INVOCATION-Pastor Marvin Cockrell-Truelight Baptist Church.

4.  ROLL CALL- Present: Mayor Wegman, Council Members Pearson, Espitia, West & Cortez, City Manager Pennell, Attorney Alan Peake, City Clerk Gibson, Executive Secretary Krause, Public Works Director Jones, Planning Director Woodcock, Senior Planner McNamara, HR Director Randhawa, Supt. of Streets & Projects Wren, Economic Development Director Mittag, Housing Supervisor Litten, Housing Tech. Felix and Sgt. McDonald.  Finance Director Wooner was absent.

5.  PRESENTATIONS AND AWARDS-  NONE.

6.  COMMUNICATIONS FROM AUDIENCE-  NONE.

7.  CONSENT CALENDAR-

        a.  Approve minutes from the July 5, 2005 regular City Council meeting.
        
        b.  Approval of bill paying list.

        c.  Acceptance of June 2005 Building Permit Report.

        d.  Approval of modification of mileage rate reimbursement to reflect the 2005  Internal Revenue Service Standards.

        e.  Approval of agreement with Sally Livingston for Professional Grant Writing  and Implementation Services at $28.00 per hour, expiring June 30, 2006.

        f.  Approval of agreement with the State Controller for preparation of 2004-2005        Street Report, at a cost not to exceed $2000.00.

        g.  Acknowledge receipt of correspondence.

        h.  Acknowledge the reading of all ordinances and resolutions by title only and         approve the publication of all ordinances in summary form.

Councilmember Pearson asked that item “b” be pulled for further discussion.  Motion to approve the remaining items by Councilmember Espitia, 2nd by Councilmember Cortez.  All in favor, motion carried.

After a brief discussion of item “b”, Councilmember Cortez made a motion to approve, 2nd by Councilmember Pearson.  All in favor, motion carried.

8.  Presentation by Irene Morales and possible minute action, re: Ice cream vending from motor vehicles-  Ms. Morales, 1700  Poppy Court, handed out written information (including a petition) on her family’s ice cream business. There was considerable discussion on both sides of the issue.

A motion was made by Councilmember Pearson to appoint a committee consisting of Council Members West and Espitia to study the existing ordinance and any possible amendments, 2nd by Councilmember West.  All in favor, motion carried.

9.  Second reading, public hearing and possible adoption of: 2005-499 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO ESTABLISHING A SPECIAL TAX FOR POLICE PROTECTION SUBJECT TO VOTER CONFIRMATION (Tracts 6282, 6432, 6449, 6473 & 6451).  

Mayor Wegman opened the public hearing at 8:00 p.m.  Senior Planner McNamara made a brief staff report.  No public comments were offered and the public hearing was closed at 8:05 p.m.  

 Motion to approve and adopt by Councilmember Pearson, 2nd by Councilmember Espitia.  Motion carried with the following vote:

        AYES: Mayor Wegman, Council Members Pearson, Cortez & Espitia
        NOES: Councilmember West
        ABSTAIN: NONE
        ABSENT: NONE

Attorney Peake read the ordinance title.

10.  Report, public hearing and possible minute action, re: Acceptance of the Annual Grantee Performance Report for the 2004 Community Development Block Grants (CDBG) Housing Rehabilitation Projects and Public Works Projects-  Housing Tech. Felix asked in Spanish if there was anyone in attendance that needed the report interpreted. There were no requests noted. The public hearing was opened at 8:00 p.m.

Housing Supervisor Litten read the prepared report statement and solicited questions or comments.  There were no requests noted and the public hearing was closed at 8:15 p.m.

Motion to approve made by Councilmember Espitia, 2nd by Councilmember West.  All in favor, motion carried.

11.  Report and possible approval, re: 2005-2258  A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO APPROVING AMENDMENT TO THE COMMUNITY DEVELOPMENT BLOCK GRANT PARTICIPATION GUIDELINES-  Housing Supervisor Litten explained that this resolution would raise the current maximum assistance from $45,000 to $60,000.

Motion to adopt by Councilmember Espitia, 2nd by Councilmember West.  Motion carried with the following vote:

        AYES: Mayor Wegman, Council Members Pearson, West, Espitia & Cortez
        NOES: NONE
        ABSTAIN: NONE
        ABSENT: NONE
Attorney Peake read the resolution title.

12.  Report and possible minute action, re: Approval of Classification Study concerning Job Specifications- Motion by Councilmember Pearson to defer to the meeting of August 16th to allow more time for review, 2nd by Councilmember Espitia.  All in favor, motion carried.

13.  REPORTS FROM CITY ATTORNEY- NONE.

14.  REPORTS FROM CITY STAFF- Public Works Director Jones reported on the rat/mold abatement project at City Hall.  Planning Director Woodcock briefly reported on planning issues.

15.  REPORTS FROM CITY MANAGER- NONE.

16.  REPORTS FROM CITY COUNCIL- Councilmember Pearson commented on the shortage of power from PG&E to power our wells.  Councilmember West said that the groundskeeper at the golf course can not take appropriate care of the course without the proper equipment.  In reply to a question posed by Mayor Wegman, Public Works Director Jones said that dead plants along Hwy. 43 would be replaced prior to the Rose Festival.  Staff will be looking for any available landscaping grants that might be available for Hwy. 43 and Hwy. 46. Sgt. McDonald reported that a list is of areas in need of traffic surveys

8:45 p.m.  Motion by Councilmember Pearson to continue this meeting until after the RDA meeting, 2nd by Councilmember Espitia.  All in favor, motion carried.  Meeting reconvened at 8:48 p.m.


17. CLOSED SESSION-

        a) Conference with Legal Counsel, re: Initiation of potential litigation (one case)     by the City of Wasco,  Gov’t. Code Section 54956.9(c).

8:46 p.m. Councilmember Espitia made a motion to adjourn to closed session, 2nd by Councilmember Pearson.  All in favor, motion carried.

9:45 p.m.  Open meeting reconvened and Attorney Peake made the following report :

“Information provided and by unanimous consent, directions were given.”

18.  ADJOURNMENT- 9:46 p.m.  Motion by Councilmember Espitia, 2nd by Cortez.  All in favor, motion carried.
